What Our Car Accident Representation Covers

Our car accident work covers the crash types and losses below. Each claim depends on how the crash happened and what injuries followed.

Crash types we handle include:

  • Rear-end and intersection crashes
  • Left-turn and lane-change crashes
  • Crashes caused by distracted or impaired drivers
  • Truck and commercial vehicle crashes
  • Crashes that hurt pedestrians

Georgia law requires drivers to act carefully around people on foot. Under O.C.G.A. § 40-6-93, every driver must exercise due care to avoid colliding with any pedestrian upon any roadway.

Losses a claim may address include:

  • Medical care. Under O.C.G.A. § 51-12-1.1, medical expenses are limited to the reasonable value of medically necessary care.
  • Other costs from the injury. Under O.C.G.A. § 51-12-7, necessary expenses from an injury are a legitimate part of the damages estimate.
  • Time away from work and future limits on daily life.
  • Pain and suffering.

Under O.C.G.A. § 51-12-2, special damages must be proved, so bills and records matter.

Your own auto policy may also matter. Under O.C.G.A. § 33-7-11, Georgia auto policies must include uninsured motorist coverage unless the insured rejects it in writing.

If a fair resolution can’t be reached with insurers, we can file a lawsuit.

How a Car Accident Claim Moves Forward

A car accident claim usually moves from your first call to a consultation, an investigation, treatment records, a demand to the insurer, and, if needed, a lawsuit.

  1. First call. Share the crash date, location, vehicles, and injuries. Calls can be made 24/7.
  2. Free consultation. A lawyer reviews the facts, your injuries, and the insurance details, then explains your options.
  3. Investigation. The file grows with the police report, photos, and witness details.
  4. Medical documentation. Treatment records and bills are kept in order so the reasonable value of medically necessary care can be documented.
  5. Demand and negotiation. The claim goes to the insurer, and negotiations begin.
  6. Filing or resolution. If a resolution isn’t reached, a lawsuit is filed within the Georgia time limit.

Georgia’s Office of the Commissioner of Insurance says to promptly notify police and your insurer, collect accident and witness information, document the scene, and avoid statements about fault (Georgia auto claim tips). A common mistake is discussing fault before your injuries are known.

The State Patrol is involved in investigating fatal and major-injury crashes, and victims or family members can request the status of an investigation (Georgia Department of Public Safety).

How long each step takes depends on your treatment, the insurer’s response, and whether the case goes to court.

Georgia Rules That Shape a Car Accident Claim

Georgia generally gives two years to file a personal injury lawsuit (O.C.G.A. § 9-3-33; Kenneth B. Cameron v. Jmp Pizza, Inc (2026)). Waiting too long can cost you the claim.

  • Filing deadline. Under O.C.G.A. § 9-3-33, injury actions must be brought within two years after the right of action accrues. Injuries to reputation have a one-year limit, and loss of consortium claims have four years. The statute says “except as otherwise provided,” so other rules can apply.
  • Shared fault. Under O.C.G.A. § 51-12-33, damages are reduced in proportion to the injured person’s fault. A plaintiff who is 50 percent or more responsible for the injury recovers nothing.
  • Separate shares. Each liable person pays only its own apportioned share. That share is not joint liability.
  • Nonparties. The fault of everyone who contributed to the injury is considered, regardless of whether that person was, or could have been, named as a party to the suit. Negligence or fault of a nonparty is considered if the plaintiff entered into a settlement agreement with the nonparty or if a defending party gives notice not later than 120 days prior to the date of trial that the nonparty was wholly or partially at fault.

Car Accident Lawyer Questions Answered

When should I call a car accident lawyer?

Call soon after a crash that caused injuries. Calling early also helps when fault is disputed, a commercial vehicle is involved, or an insurer has made an offer.

How much do car accident lawyers charge in Georgia?

The firm’s fee terms are covered in the fee section above. Court costs and case expenses are covered there too.

How much of a $25,000 settlement will I keep?

The amount you keep depends on the facts of your case and the costs involved. The firm reviews these with you at the free consultation.

What if the other driver has no insurance?

Georgia auto policies generally must include uninsured motorist coverage unless the insured rejects it in writing. A lawyer can review your policy during the consultation.

Do I need a lawyer if the crash was minor?

A free consultation can help you understand your injuries and your options. Minor-looking crashes can still lead to lasting injuries.
