A catastrophic injury lawyer in Augusta helps people hurt in serious accidents pursue claims for harm that may last for years. T. Madden & Associates, P.C. is a Georgia personal injury firm in practice since 1999, with an office in Augusta. This guide explains what counts as a catastrophic injury, how these harms happen around Augusta, Georgia’s filing deadlines, and what the free first consultation involves.
What Counts as a Catastrophic Injury in an Augusta Case
A catastrophic injury is a severe harm that can change how you work, move, and care for yourself. Common examples include traumatic brain injury, spinal cord injury, amputation, severe burns, and multiple serious fractures.
These injuries often bring long recovery periods. Some never heal fully. Others leave lasting limits on walking, lifting, or thinking clearly at work.
The long-term picture matters most. Ongoing medical care, rehabilitation, and changes in your ability to earn a living often shape a claim more than the first hospital bill does. A spinal cord injury cost review reports that direct health-care costs of spinal cord injuries are substantial and variable.
That is why an early bill can understate the harm. Your lawyer will look at what your injury may cost over months and years, not only what has been billed so far. For the full picture, read our catastrophic injury lawyer guide for Georgia.
If a serious injury has changed your life in Augusta, you may have a claim, and you don't have to face the next steps alone. Reach out to our team today. Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

How Catastrophic Injuries Happen Around Augusta
Serious injuries in the Augusta area often come from crashes, falls, medical errors, nursing home harm, and unprotected premises. Our firm handles car and truck wrecks, motorcycle and e-bike crashes, slip and falls, medical malpractice, nursing home abuse, negligent security, and wrongful death.
Busy roads carry passenger cars and commercial trucks side by side. When a large vehicle strikes a smaller one, the force can cause a brain injury. The Brain Injury Association of America describes how brain injuries from vehicle crashes can affect work, home life, and relationships.
Motorcycle and e-bike riders have little between their bodies and the pavement. A fall at speed can cause head, spine, or limb injuries.
Nursing home residents have legal protections. Under O.C.G.A. § 31-8-108, each resident must receive care with reasonable care and skill. Residents also may inspect and copy their medical records, unless medically contraindicated. Early review of those records can show what happened.
Georgia Deadlines and Why Early Action Matters
In most Georgia personal injury cases, you have two years from the injury to file a lawsuit. The general rule for injuries to the person appears in O.C.G.A. § 9-3-33.
Medical malpractice has its own clock. Under O.C.G.A. § 9-3-71, a malpractice action generally must be brought within two years after the injury or death. For medical malpractice claims, O.C.G.A. § 9-3-71(b) sets a five-year statute of ultimate repose: the action cannot be filed more than five years after the date on which the negligent or wrongful act or omission occurred. O.C.G.A. § 9-3-73 contains exceptions to this limit. Under § 9-3-73(e), the limitations of subsections (b) and (c) do not apply where a foreign object has been left in a patient’s body; under O.C.G.A. § 9-3-72, those cases must be brought within one year after the negligent or wrongful act or omission is discovered, but a chemical compound, fixation device, or prosthetic aid or device does not count as a “foreign object” for this rule.
Wrongful death claims raise their own questions about who may sue and when. Those questions need prompt review.
Evidence fades. Crash reports, medical records, photos, video, and witness names can be lost or become harder to find over time. Acting soon gives a lawyer time to gather them while the facts are fresh. The right timing depends on the facts of your case.
Who Can Bring a Claim and What It May Cover
The person who was hurt can usually bring a personal injury claim. After a death, certain family members may bring a wrongful death claim.
Under O.C.G.A. § 51-4-2, a surviving spouse, or a child or children if there is no spouse, may recover for the death the full value of the life of the decedent, as shown by the evidence. If no one is entitled to sue, the administrator or executor may bring the action, under O.C.G.A. § 51-4-5.
Damages fall into two groups. General damages are those the law presumes to flow from a wrongful act. Special damages actually flow from the act and must be proved, under O.C.G.A. § 51-12-2.
Medical expenses are limited to the reasonable value of medically necessary care, under O.C.G.A. § 51-12-1.1. Future economic losses may be reduced to present value under O.C.G.A. § 51-12-13.
Georgia also reduces damages by your share of fault, a rule called modified comparative fault. Under O.C.G.A. § 51-12-33, you recover nothing if you are 50 percent or more responsible. Every claim is different, so we review the details before we discuss value.
