What a Red Light Accident Claim Covers
A red light accident claim is a personal injury claim after a driver enters an intersection against a red signal and causes a crash. Drivers, passengers, pedestrians, cyclists, motorcycle riders and e-bike riders can all be hurt in these crashes. When someone dies, the family may have a wrongful death claim instead.
Many red light cases involve car and truck wrecks. Others involve motorcycle or e-bike crashes at signalized intersections. The claim asks the at-fault party to pay for the harm the crash caused.
T. Madden & Associates, P.C. represents people hurt in these crashes. Attorney Terance Madden has practiced law since 1999. It has offices in Jonesboro (Clayton County), Atlanta, Decatur, Macon and Augusta. Terance Madden is the responsible lawyer for this page.
If a driver ran a red light and left you hurt, you may have a claim worth reviewing, and our team can look at it with you in a free first consultation. Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Why Red Light Crashes Happen and Who Is Responsible
Fault usually turns on what the driver who entered on red was doing. Common causes include rushing a yellow light, driving distracted, driving impaired and turning on a changing signal. Side-impact (T-bone) crashes and rear-end collisions after sudden braking are common patterns at signals.
Georgia divides fault among the people involved. Under O.C.G.A. § 51-12-33, the judge reduces damages by the injured person’s share of fault. A person who is 50 percent or more responsible cannot receive damages.
Georgia law also requires the fault of everyone who contributed to the injury to be considered. A commercial driver’s employer may be liable for the driver’s negligence within the scope of the job, under O.C.G.A. § 51-2-2. Evidence that often matters includes the crash report, nearby video, vehicle damage, witness statements and medical records.
Injuries and Compensation a Red Light Claim May Include
Red light crashes often cause fractures, spinal injuries, traumatic brain injuries and soft-tissue injuries. Some symptoms appear days later. Prompt medical care protects your health and connects your injuries to the crash.
Georgia separates damages into two groups. Under O.C.G.A. § 51-12-2, general damages are presumed to flow from a wrongful act. Special damages actually flow from the act and must be proved.
Necessary expenses from an injury count, too. Under O.C.G.A. § 51-12-7, those expenses are a legitimate item in the estimate of damages.
Medical bills get special scrutiny. Under O.C.G.A. § 51-12-1.1, medical expenses are limited to the reasonable value of medically necessary care. If you have health insurance, the evidence can include both the amounts charged and the amounts actually needed to satisfy those charges. Keep every bill, statement and record from day one.
How a Red Light Case Works With Our Team
Your case starts with a free first consultation. The firm then handles evidence gathering and insurance contact. The first consultation is confidential, with no obligation to continue.
- Free consultation. Describe the crash, your injuries and any insurance calls you’ve received. You can start a free case evaluation online.
- Evidence. Our team requests the crash report, looks for video before it’s overwritten, gathers witness details and collects medical records.
- Insurance contact. Adjusters can be asked to direct communication to the firm once it represents you.
- Demand and negotiation. The claim is documented and presented to the at-fault party’s insurer.
- Filing, if needed. If no fair resolution is reached, a lawsuit may be filed. Georgia generally allows two years for injury claims under O.C.G.A. § 9-3-33. Claims against a city follow a six-month written notice rule under O.C.G.A. § 36-33-5.
Our first consultation is free, confidential, and carries no obligation to continue. Fees are owed only if we win, but you may still be responsible for court costs and case expenses.

When a red light crash is fatal, Georgia law lets a surviving spouse recover for the homicide of a spouse or parent. If there is no surviving spouse, a child or children may recover. The law measures that recovery as the full value of the life of the decedent, as shown by the evidence, under O.C.G.A. § 51-4-2.
We explain each stage in plain language, so you know what is happening and what decisions come next.
Questions About Red Light Accident Claims
Do I still have a claim if the other driver admitted running the light?
An admission helps. A claim still needs the crash report, video and medical records, and our team gathers them.
Can I recover if I was partly at fault?
Yes, if you are less than 50 percent at fault. Georgia reduces your damages by your share of fault under O.C.G.A. § 51-12-33.
Should I speak with the other driver’s insurance adjuster?
Adjusters work for the other side’s insurer. Talking with a lawyer before giving a recorded statement is a sound step.
What if the other driver has no insurance?
Insurance coverage after a crash can affect your options, so ask us about the coverage that applies to your situation.
How long do I have to file?
Georgia generally allows two years for personal injury claims under O.C.G.A. § 9-3-33.
Is the first consultation free?
Yes. The first consultation is free, confidential and carries no obligation to continue.

What to Do After a Red Light Crash
Get Medical Care
Even if you feel fine, see a doctor promptly. Some injuries, such as concussions and soft tissue damage, may not show symptoms right away.
Report the Crash
Call the police so an official crash report is created. Note the officer's name and badge number and the report number if one is given.
Document the Scene
Photograph vehicle damage, signals, skid marks and visible injuries. Write down witness names and contact details while the details are fresh.
