Under our contingency fee arrangement, our fee is a share of what the client recovers. Here is how that share works, which costs sit outside it, and what to check before you sign.

Short Answer: Accident Lawyers Usually Work on a Contingency Fee

Yes. Accident lawyers commonly take a contingency fee, which is a percentage of the money recovered. That covers car, truck, motorcycle, e-bike and slip and fall claims, along with wrongful death cases.

Terance Madden has practiced law since 1999. He handles these matters on a no-fee-unless-we-win basis, but you may still be responsible for court costs and case expenses.

The exact percentage is written in the fee agreement you sign. Read it before you agree to anything, and ask about any line you don’t understand.

Injury claims often involve insurance companies, medical bills and a lot of paperwork. A contingency fee means you don’t pay an hourly bill while treatment is still going on. The firm’s offices are in Jonesboro (Clayton County), Atlanta, Decatur, Macon and Augusta.

How Contingency Fees Work in Personal Injury Cases

A contingency fee is paid from money recovered for the client, not from hourly billing. The lawyer’s pay depends on the result, so the fee and the recovery move together.

The percentage applies to the gross amount recovered. Gross means the total before fees and case costs come out. Fees are typically taken from the settlement or judgment itself.

Because the fee follows the recovery, the hours a lawyer works don’t set the fee. The written agreement sets the amount.

Some agreements change the percentage at key points, such as before a lawsuit is filed or after trial begins. Your agreement is the only document that sets those stages and figures for your case.

Fault also changes the amount being divided. Georgia reduces damages in proportion to the injured person’s share of fault, under O.C.G.A. § 51-12-33. A plaintiff found 50 percent or more responsible cannot receive any damages.

Breaking Down the Numbers: Attorney Fees vs. Case Costs

Attorney fees and case costs are separate charges, and both should be spelled out in writing. Mixing them up is one of the most common mistakes people make when they review a claim.

Case costs are the out-of-pocket expenses of building and presenting a claim. Common examples include court filing fees, charges for medical and accident records, deposition costs, investigation costs and fees for outside witnesses, such as doctors who testify.

Case costs are not the attorney’s percentage. The agreement should say whether costs come out of your share and in what order. Ask how they are paid before you sign.

Medical bills add another layer. Georgia law says that when a provider treats an injured person under a letter of protection, meaning payment comes from the claim’s result, that arrangement is relevant. The itemized charges and the referral source are relevant too, and they can be requested during the case. Georgia also limits medical expense damages to the reasonable value of medically necessary care, under O.C.G.A. § 51-12-1.1.

A Simple Settlement Breakdown Example

Here is a hypothetical example. The numbers are for illustration only and are not a prediction of any claim’s value.

Assume a gross settlement of $30,000. Assume a 35 percent fee, which is $10,500. Assume $1,500 in case costs. The client’s net would be $18,000.

Notice the order. The fee comes off the gross amount first, and case costs come off next. Your agreement might order these steps differently, so read it closely.

Check every line of the closing statement against the agreement. If a deduction does not appear in the agreement, ask about it before any money is paid out.

Keep the agreement, the cost list and the final statement together. That way, each number can be traced back to a written term.

What Georgia Requires in a Contingency Fee Agreement

In practice, the percentage and cost terms sit in the written fee agreement you sign. You can read about those rules at the State Bar of Georgia ethics rules.

Before any money changes hands, ask for a copy of the agreement. Read how the percentage changes at each stage of the case.

Look for how case costs are paid, and whether they come out before or after the fee. Write down any question you have and ask for the answer in writing.

Terance Madden’s first consultation is free, confidential and carries no obligation to continue. You can ask these questions there before you commit to anything.

Common Questions About Paying a Lawyer After an Accident

Most people ask two things: whether they pay anything up front, and whether the percentage can change. Short answers to each question are below.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Do you have to pay a lawyer upfront for a car accident claim?

Under a contingency arrangement, no attorney fee comes out of your pocket before a recovery, but you may still be responsible for court costs and case expenses. Case costs still need a clear answer in your agreement.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can you negotiate a car accident lawyer’s fee?

The percentage is a term of the written agreement, so it is discussed before the lawyer starts work. Ask about it during your consultation.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How does a fee relate to the value of a claim?

The fee follows what is recovered, and fault can reduce that amount under Georgia’s comparative fault rules (O.C.G.A. § 51-12-33; Quynn v. Hulsey, 310 Ga. 473 (2020)). Each claim is different, so no lawyer can say in advance what a particular case will recover.
</details>

Questions to Ask Before You Sign a Fee Agreement

Before you sign, ask four things. Ask what percentage applies at each stage. Ask how case costs are deducted, what happens to costs if nothing is recovered, and who pays court costs.

Think about your own situation. Maybe a family member was hit by a truck and is still in treatment. Or maybe you slipped in a store and worry that bills will keep arriving. Those are the moments when fee terms matter most.

For how truck claims work in Georgia, read our truck accident lawyer guide for Georgia.

If you’re weighing a fee while someone you love recovers from a crash, you don’t have to sort out the numbers alone.
