The three routes that matter most are your own uninsured motorist coverage, your medical payments coverage, and the at-fault driver’s liability policy if that driver is identified.

Uninsured motorist (UM) coverage is often the main route when the other driver can’t be found. Medical payments (MedPay) coverage, if you carry it, is written to help pay medical bills after a crash. Your policy wording controls how each one works.

If the driver who left was driving a commercial truck, the picture can change. Company policies and carrier involvement can add parties to the claim.

Steps to take after a Georgia car crash

Many people involved in a crash have questions about what to do at the scene. The Georgia Department of Driver Services publishes general information about crashes.

Reporting the crash to police creates an early record of what happened. That record can matter later, especially if the other driver is never found. Georgia’s unknown-driver rules also tie your insurance rights to reporting, as the next sections explain.

Which insurance can respond when the at-fault driver is gone?

Uninsured motorist coverage is the main path when the at-fault driver can’t be identified. Georgia law requires auto liability policies issued in the state to include an endorsement that pays the insured for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured, sustained from the owner or operator of an uninsured motor vehicle, within the limits set out in the statute. The O.C.G.A. § 33-7-11 statute sets out that requirement.

The Georgia auto insurance guidance from the state insurance regulator explains that this coverage can apply when an uninsured driver causes the accident.

MedPay can help with medical bills while the claim is open. If the at-fault driver is identified later, that driver’s liability insurance may become part of the claim. Your own coverage may still fill gaps the other policy leaves behind.

Georgia’s hit-and-run rules for uninsured motorist claims

In a hit-and-run or other crash where the at-fault vehicle cannot be identified, an uninsured motorist claim in Georgia must meet a reporting condition. Under O.C.G.A. § 33-7-11(b)(2), it also generally requires actual physical contact with the unknown vehicle, unless an eyewitness other than the injured person corroborates how the crash happened. Under O.C.G.A. § 33-7-11, the injured person must report the accident as Code Section 40-6-273 requires before recovering under that endorsement.

That reporting step is why the first hours matter. Photos, witness names, and a prompt police report help show the crash happened as described.

The exact requirements depend on your policy language and the facts of the crash. Save every document from the scene and from your insurer. Keep copies of every claim number, letter, and call summary.

Paying medical bills while the claim is still open

Start a written list on day one. List every provider, every bill, and every payment source, including health insurance, MedPay, and UM coverage. Each can pay different bills.

Georgia law limits medical expense damages to the reasonable value of medically necessary care. Under O.C.G.A. § 51-12-1.1, if you have health insurance, the evidence includes both the amounts charged and the amounts actually needed to satisfy those charges under the insurance contract.

If a provider treats you under a letter of protection, that arrangement can be requested as evidence in a claim. Keep a running log of appointments, prescriptions, and mileage to medical visits.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What to do and what to avoid saying to insurance companies

Write down the time, place, direction of travel, and weather as soon as you can. Add what you remember while it’s fresh.

Photograph vehicle damage, road conditions, visible injuries, and debris or skid marks before vehicles are moved, when that is safe. Get the names and contact details of any witnesses.

Be careful with recorded statements and medical releases. Georgia’s auto claim tips advise avoiding statements about fault.

Fault matters because of comparative fault. Under O.C.G.A. § 51-12-33, a plaintiff’s damages are reduced by the plaintiff’s percentage of fault. A plaintiff who is 50 percent or more responsible recovers nothing.

How long do you have to bring a claim in Georgia?

Georgia generally gives two years to bring an injury claim. Under O.C.G.A. § 9-3-33, actions for injuries to the person must be brought within two years after the right of action accrues. Loss of consortium claims have four years under the same section.

Plan around the two-year date. Insurance policies may set shorter notice deadlines, so track every date an insurer or provider gives you.

How do criminal cases relate to the filing deadline?
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can I still recover if I was partly at fault?

Yes, but your award is reduced by your share of fault (O.C.G.A. § 51-12-33; Quynn v.
