Hold nothing back from your own injury lawyer, even the facts that seem unhelpful.

Why the words you use after a truck crash carry weight

Your words can become part of the claim record, so the first days after a crash matter. Many people reading this are hurt themselves. Others are a spouse, parent, or adult child trying to help someone who is still shaken and in pain.

Statements can reach the other driver’s insurer, medical staff, coworkers, and social media. This question usually comes up in two places: talking with an insurance adjuster, and talking with your own injury lawyer. The adjuster works for the other side’s insurer. Your lawyer works for you.

Georgia also sets a clock on injury claims. Under O.C.G.A. § 9-3-33 (Cameron v. JMP Pizza, Inc. A courtesy “I’m sorry” can be repeated back later as an admission. Phrases like “I didn’t see the truck,” “I should have stopped,” and “I wasn’t paying attention” cause the most trouble.

Georgia shares fault between the people involved. Under O.C.G.A. § 51-12-33, the trier of fact (the jury, or the judge if there’s no jury) sets your percentage of fault. The judge then reduces your damages to match. If you are 50 percent or more responsible, you are not entitled to receive any damages under subsection (g).

Truck crashes often involve more than two parties, such as a trucking company or a cargo loader. Under O.C.G.A. § 51-12-33, the trier of fact shall consider the fault of all persons or entities who contributed to the alleged injury or damages under subsection (c), whether or not they were, or could have been, named as a party to the suit. A guess about who caused the crash can be wrong and costly. Say what you saw and what you did. Leave the judgment about fault to the facts.

Minimizing your injuries, such as “I’m fine” or “it’s just a scratch”

Don’t call your injuries minor until a doctor has examined you. Neck, back, and head injuries can show symptoms hours or days after a crash. If you say “I’m fine” at the scene and symptoms appear later, that early remark can be quoted back.

Describe your pain honestly. Report every symptom to your doctor, even the ones that seem small. Don’t guess at the cause. Say “my neck has hurt since the crash,” not “the seatbelt probably did it.”

Keep every appointment. Georgia limits medical expenses to the reasonable value of medically necessary care, under O.C.G.A. § 51-12-1.1 subsection (b). Subsection (f) keeps each side’s right to challenge reasonableness and medical necessity. Gaps in treatment give the other side a reason to question an injury, so keep your records complete.

Guessing about what happened, including speed, signals, and cargo

Only state what you directly saw, heard, and did. Say “I don’t know” about the rest. Guesses about the truck’s speed, the color of a light, or what was loaded can conflict with records you haven’t seen yet.

Truck crash records are detailed. The Federal Motor Carrier Safety Administration publishes national statistics on crashes involving large trucks and buses. That is one reason the facts of your crash matter more than any impression you have in the moment.

If the other vehicle left the scene, write down everything you remember right away. Include its color, markings, and direction of travel. In an underride crash, where a car slides under a trailer, describe where each vehicle was as you saw it. Write down the time and place while your memory is fresh.

Recorded statements and quick calls with an adjuster

Don’t give a recorded statement or sign a release until you understand your injuries and your claim. An adjuster for the other driver’s insurer is not on your side. A recorded answer can be used later, and small details can change in your memory over a few weeks.

Before any call, ask for the request in writing. Write down the adjuster’s name, company, and claim number. Keep copies of every letter and email.

It’s reasonable to say you want to talk with a lawyer first. Keep your answers short and factual, such as “I’m still being checked by a doctor, and I’ll follow up in writing.” Don’t accept a quick payment or sign anything that closes the claim before you know your medical costs.

Holding nothing back from your injury lawyer, and what you post online

Tell your own injury lawyer everything, including facts that seem unhelpful. Don’t exaggerate, don’t minimize, and don’t leave out a past injury. Prior neck or back problems, earlier accidents, old claims, and gaps in treatment all matter.

A lawyer can’t plan around a fact he hasn’t heard. Sharing details early helps the lawyer assess the claim accurately. Letters of protection, which are arrangements where a provider treats you now and is paid from a later settlement or judgment, are also examined under Georgia law. See O.C.G.A. § 51-12-1.1 subsection (d).

Social media posts, texts, and talks with coworkers or friends may be requested in a lawsuit. Stop posting about the crash, your activities, and your injuries. In a deposition or in court, you answer under oath, so consistent and accurate answers protect you.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What to tell your own insurer after a crash

Give your own insurer the basic facts: the date, time, location, vehicles, and people involved.
