Most requests run through a claim or lawsuit, not a phone call to the driver.

If you’re researching a truck driver logbook after crash Georgia, you’re not alone. This question can come up early, while a loved one is still in the hospital and the details are unclear.

The carrier, not the driver, holds the official files. A driver may keep personal copies of some papers, but the company keeps the records it must maintain. That is why a written request sent early matters.

A logbook is also only one piece. It sits beside electronic data, video, dispatch messages, and receipts. Each source can support or challenge the others. When they line up, the crash timeline becomes clearer. When they don’t, the gap is worth asking about.

If a truck crash has you or a family member sorting through questions about records, you don't have to work out the next step alone. Each entry is a duty status: driving, on duty but not driving, resting in the sleeper berth, or off duty.

Federal rules require each change of duty status to record the city, town, or village, with the State abbreviation. That lets investigators check the location on a map. See the federal duty status rules.

The log also shows whether the driver stayed within federal hours-of-service limits. Under the federal driving time rules, and except as otherwise provided in 49 C.F.R. § 395.1, a driver must first complete 10 consecutive hours off duty before starting a work shift. Driving can’t continue past 14 consecutive hours after coming on duty, and total driving in that window can’t exceed 11 hours.

Weekly caps apply too: 60 hours in 7 days, or 70 hours in 8 days, depending on whether the carrier runs trucks every day of the week.

Compare the entries to the time of the crash. A log that shows the driver near the end of a legal window at the moment of impact matters. A clean-looking log is not proof of compliance, though. It has to be checked against other evidence.

Electronic Logging Devices, Dashcam Video, and Other Trucking Data

Many commercial trucks use an electronic logging device (ELD) that records driving data automatically. Some trucks also carry video cameras or engine recorders that add more detail.

Under federal ELD recording rules, an ELD automatically records the date, time, truck location, engine hours, and vehicle miles. It also records the driver, vehicle, and carrier identification. When a truck is moving and no status change has happened in the past hour, it records an entry anyway.

Drivers can edit ELD records, but the rules are strict. Under federal ELD edit rules, a driver must annotate each change. The carrier must not alter or erase the original hours-of-service information. An edited log isn’t automatically false, so look for the notes that explain each change.

Other records can include:

Dashcam video, facing the road or the driver, where installed.

Engine control module (“black box”) data, which may show speed, braking, and throttle before impact.

Dispatch and trip records, expense receipts related to on-duty not driving time, and electronic messages.

How Long Trucking Companies Must Keep Records

Federal rules require a carrier to keep a driver’s records of duty status and supporting documents for at least six months from the date of receipt. That is the minimum, set out in federal record retention rules.

FMCSA guidance says the same six-month period applies to electronic duty-status records and supporting documents. It also says that a record of duty status kept manually on a specified grid must be recorded in duplicate for each 24-hour period. See the FMCSA guidance on ELD records.

Under 49 C.F.R. § 379.3, companies subject to this part shall retain records for the minimum retention periods provided in appendix A to this part. Other government requirements that call for longer retention still apply, under federal records rules.

Under 49 C.F.R. § 379.3, companies subject to that part must retain records for the minimum retention periods in appendix A to that part, and after those periods the records may be destroyed at the discretion of each company’s management. That is why timing matters. A preservation letter is a written request asking the company to keep specific records, such as logs, ELD data, video, and dispatch messages. Send it quickly, and keep a copy of what you sent and when.

Crash-Scene Evidence That Supports Truck Records

Scene evidence, such as the police report, photos, and witness names, helps confirm the trucking records. The time and place recorded at the scene can be compared with ELD entries and video timestamps.

Write down the company name and any numbers on the truck while they are visible. Those details help identify the carrier quickly.

After a crash involving a commercial vehicle on a public road, the employer must test a surviving driver for alcohol in some cases. These include a crash that caused a death, or a crash where the driver gets a moving-traffic citation within 8 hours. The citation must relate to injury needing immediate treatment away from the scene, or to disabling damage needing a tow. See federal post-accident testing rules.

For controlled substances, 49 C.F.R. § 382.303 requires the employer to test each surviving driver who was performing safety-sensitive functions with respect to the vehicle if the accident involved the loss of human life, or who receives a citation within thirty-two hours of the occurrence under State or local law for a moving traffic violation arising from the accident, when the accident is one of the types the regulation lists. The alcohol test should happen within 2 hours. If it doesn’t, the employer must record why. Attempts to test for alcohol stop at 8 hours, and drug testing stops at 32 hours.

See federal post-accident alcohol rules.

Steps to Take Now If You Were Hurt or Are Helping a Family Member

Keep your own records, write down details while they’re fresh, and watch the deadline. Georgia’s general deadline for injury claims is two years. The Georgia injury deadline statute, O.C.G.A. § 9-3-33, says actions for injuries to the person must be brought within two years after the right of action accrues. The statute begins with “Except as otherwise provided in this article,” so exceptions may apply. Certain loss-of-consortium claims have a four-year period.

Start with these steps:

Keep medical visit records, bills, and photos of your injuries and the scene.

Track missed work and the pay you lost.

Write down the names and contact details of anyone who saw the crash.

Note the date, time, and location while you still remember them.

Hold off on recorded statements to the trucking company or its insurer until you understand the process.

If you’re helping a family member, gather these same notes. Keep them with the injured person’s papers so nothing gets lost.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk With T.
