Brain injuries, spinal injuries, broken bones and internal bleeding are among the most serious. Some symptoms do not appear until hours or days after the crash. Every injury also leaves a trail of medical, police and trucking records that matters later. T. Madden & Associates, P.C. has practiced personal injury law since 1999. This page is general information, not legal advice.

Why 18-Wheeler Crashes Often Cause More Serious Injuries

A loaded tractor-trailer weighs far more than a passenger car, so the forces in a collision are usually larger. The people in the smaller vehicle absorb much of that force. Impacts can land on the side, rear or front of a car, and rear-end crashes are a common pattern. Federal rules for rear impact guards on trailers state their purpose as reducing deaths and serious injuries when light vehicles hit the rear of a trailer (federal rear impact guard standard). The Insurance Institute for Highway Safety’s large-truck fatality data also covers the longer stopping distance of tractor-trailers. Injuries may not be obvious at the scene. Anyone hurt in a crash should get checked by a medical provider, because symptoms can develop later.

If a semi-truck crash left you with injuries that are still being diagnosed, our team can review your records with you in a free, confidential first consultation. Each group needs its own kind of care and its own records.

Traumatic brain injuries. Automobile crashes can cause traumatic brain injuries, which range from concussions to severe injuries (traumatic brain injury basics). Symptoms can appear hours or days after the impact, so early evaluation matters.

Spinal cord injuries. Spinal cord injuries from motor vehicle crashes, including commercial truck crashes, can be serious and need urgent attention (spinal cord injury overview). Neck and back fractures can cause lasting loss of movement or feeling.

Broken bones and crush injuries. Pelvis, leg and arm fractures are common. A person pinned inside a vehicle can suffer crush injuries.

Internal and chest injuries. Internal bleeding, rib fractures and punctured lungs can be hidden at the scene.

Soft tissue and other injuries. Whiplash, sprains, burns, lacerations and nerve damage all need written documentation.

Serious Injuries Common in Truck Rear-End Collisions

When a truck strikes a smaller vehicle from behind, the occupants often take the impact at the back of their car. That pattern often leads to neck, back and head injuries. Motorcycle riders and e-bike users struck by a truck can be thrown onto the road surface. That can cause head trauma and broken limbs.

The way the crash happened matters for the claim. Medical providers record how an injury occurred, and that account links the injury to the collision. Write down the sequence of events while your memory is fresh. Note the lane, the time, the weather and what you saw and heard.

When an Injury Is Catastrophic

A catastrophic injury is one that causes permanent or long-term impairment, disability or the need for lifelong care. Examples include paralysis, amputation, severe brain injury and severe burns. These injuries often require long-term medical planning, such as rehabilitation, equipment and future care.

Whether an injury is catastrophic is decided by medical records and the findings of the treating doctors. It is not decided by how the injured person describes the pain. Early and consistent records are the foundation for that finding.

How Truck Crash Injuries Are Documented

Each injury leaves a record, and those records are easiest to build when they start at the scene. Keep copies of every one of the following:

The EMS run report and emergency room chart, which record first symptoms, vital signs and initial diagnoses.

Imaging such as X-rays, CT scans and MRIs, which show fractures, bleeding and soft tissue damage.

Follow-up visits, notes from other treating doctors, physical therapy records and prescription records, which show how the injury progressed.

Itemized bills and proof of lost wages from your employer.

The police crash report.

A personal journal of pain, limits on daily activities and missed events.

Gaps in treatment give the other side a reason to question the injury. Steady, documented care protects the record. Under Georgia law, medical damages are limited to the reasonable value of medically necessary care (O.C.G.A. § 51-12-1.1). Some providers treat under a letter of protection, a promise to be paid from a later settlement or judgment. That arrangement and its bills can be requested in a case under the same statute.

Evidence That Only Exists in Truck Accident Cases

Trucks create records that passenger cars do not. Some of those records can be lost if no one asks for them early.

Electronic control module data. A truck’s electronic control module can record speed, braking and throttle before a crash, if the data is preserved.

Driver logs. Motor carriers must keep driver records of duty status and supporting documents for at least 6 months from the date of receipt (49 C.F.R. § 395.8).

Maintenance records. Inspection and maintenance records must be kept for 1 year where the vehicle is housed, and for 6 months after it leaves the carrier’s control (49 C.F.R. § 396.3).

Post-crash alcohol testing. In defined cases, the employer must test surviving drivers for alcohol. If a test is not given within two hours, the employer must keep a record of the reasons (49 C.F.R. § 382.303).

Dashcam and company camera footage. This footage may be overwritten if it is not preserved promptly.

Early written requests to preserve evidence can go to the trucking company and its insurer. Georgia generally sets a two-year deadline for injury lawsuits, counted from when the claim accrues (O.C.G.A. § 9-3-33).

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Who Can Be Held Liable Besides the Truck Driver

The trucking company can be held responsible for a driver’s negligence when the driver was doing the company’s work. Georgia law makes a person liable for torts committed by a worker by the person’s command or in the prosecution and within the scope of the person’s business (O.C.G.A. § 51-2-2). The truck’s owner, a leasing company or a maintenance contractor may share responsibility, depending on the vehicle’s condition. Cargo loaders may be considered when improperly secured cargo caused the crash.

Georgia also divides fault among the people involved. Damages are reduced by the injured person’s own share of fault. A person who is 50 percent or more responsible recovers no damages. Each liable party pays its own share, not a joint amount (O.C.G.A. § 51-12-33). Liability depends on the facts, so each potentially responsible party should be identified early.

Talk With Our Team About Your Injuries and Records

Your injury records and the crash facts decide what can be proven.
