Often it’s a spouse, parent, or adult child asking on behalf of an injured rider. This page gives a plain answer about upfront costs, what can still be owed, and why timing matters.

Do Georgia motorcycle-versus-semi-truck injury lawyers charge anything upfront if the case is not won?

No attorney fee is owed if the case is not won. T. Madden & Associates, P.C. works on a no-fee-unless-we-win basis, but the client may still be responsible for court costs and case expenses, so ask how those are handled.

The firm has practiced since 1999. It has offices in Jonesboro (Clayton County), Atlanta, Decatur, Macon and Augusta. The firm also offers a free first consultation. That consultation is confidential, with no obligation to continue.

A crash with a semi truck can involve more than one party. Our overview of truck accident claims in Georgia covers the wider picture and how these cases usually move.

How does a contingency fee work in a motorcycle and semi truck crash case?

A contingency fee is a share of what is recovered, not an hourly bill. The percentage is set in a written agreement. Our fee is paid only if we win the case, and it comes from the recovery. The client may still be responsible for court costs and case expenses.

The exact arrangement depends on the facts of the case. Read the agreement before you sign. Ask how the percentage applies and what gets paid first.

Fault matters in motorcycle cases. Insurers and defendants may argue the rider shared the blame. Under O.C.G.A. § 51-12-33, damages are reduced in proportion to the injured person’s share of fault. A plaintiff who is 50 percent or more responsible is not entitled to receive any damages.

The same statute splits liability among defendants. Each person’s share is set by its own percentage of fault. Those shares are not joint liability, so a truck company and a driver may each owe a separate portion.

What court costs and case expenses could the client still owe?

Court costs and case expenses are separate from the attorney’s fee. They are the costs of moving a claim forward. Under the agreement, they may still be the client’s responsibility.

Common examples include filing fees, copying charges for medical records, and the cost of getting crash reports and other records. These costs can add up over time, so ask for them in writing.

Medical bills are handled under their own rules. Under O.C.G.A. § 51-12-1.1, medical expense damages are limited to the reasonable value of medically necessary care. Under O.C.G.A. § 51-12-7, necessary expenses from an injury are a legitimate item in the estimate of damages.

If the rider has Medicare, questions about how medical bills are paid should be raised with the firm early in the case.

Ask when expenses are repaid from a recovery. Get that answer in writing before you agree to anything.

Why does timing matter when a semi truck is involved in a motorcycle crash?

Timing matters because insurers may make a settlement offer before the full extent of injuries is known. An early offer can arrive while medical care is still ongoing. Read the guide on quick settlement risks after a motorcycle crash before you respond to any call.

Georgia also has filing deadlines for injury claims. Waiting too long can limit options, so the timing of a first conversation matters.

Accepting a payment can affect later claims. A release (a written promise not to sue further) may close off more than the check covers. Before you sign or cash anything, ask what it covers and what it ends.

The real question is when to gather information. It is not a prediction of how any claim will end.

How do commercial truck records and evidence affect the work on a case?

Semi truck cases often depend on company records. Federal rules require carriers to keep some of them for set periods.

Under 49 C.F.R. § 395.8, a motor carrier must keep each driver’s records of duty status and supporting documents for not less than 6 months from the date of receipt. Under 49 C.F.R. § 379.3, companies subject to this part keep records for the minimum periods in appendix A. After those periods, records may be destroyed at company discretion, but this does not excuse compliance with any other governmental body’s lawful requirements prescribing longer retention periods for any category of records.

Drug and alcohol testing also has deadlines.

Scene photos, witness names, and crash details are commonly gathered early, before they are lost. For more on this, read commercial truck evidence in motorcycle crashes.

Talk with our team about your motorcycle and semi truck crash

You may be reading this because someone you love was hurt on a motorcycle in a crash with a semi truck.
