Adrenaline can hide pain and injuries for hours, so an early check matters.

Stay at the scene if you can. Do not move your bike unless it blocks traffic or creates danger.

Collect these details if you can:

The truck’s company name and DOT number, if visible

The trailer number and the driver’s name

The truck’s license plate number

Photos of both vehicles, the road, skid marks, lane lines, traffic signals and any visible injuries

Names and phone numbers of witnesses

Keep your statements short and factual. Do not guess about who caused the crash. Insurance adjusters may call early and ask for a recorded statement. It is reasonable to say you need time before giving one.

What evidence should be preserved after a semi truck crash?

Save your gear, your bike and every digital record of the crash before anyone repairs or replaces them. Damage and phone data can show what happened in ways memory cannot.

Keep your helmet, riding gear and clothing as they were after the crash. Do not repair or sell the motorcycle until it has been photographed and inspected. Save phone photos, videos, texts and any ride-tracking or navigation data from that day.

The truck side matters too. Federal rules require a motor carrier to keep records of duty status and supporting documents for at least six months from the date of receipt, under 49 C.F.R. § 395.8(k). Under 49 C.F.R. § 379.3, companies subject to this part shall retain records for the minimum retention periods provided in appendix A to this part. After the required retention periods, the records may be destroyed at the discretion of each company’s management. It shall be the obligation of the subject company to maintain records that adequately support financial and operational data required by the Secretary. The company may request a ruling from the Secretary on the retention of any record. The provisions of this part shall not be construed as excusing compliance with the lawful requirements of any other governmental body prescribing longer retention periods for any category of records. Under 49 C.F.R. § 395.8(k), a motor carrier must retain records of duty status and supporting documents for a period of not less than 6 months from the date of receipt. Under 49 C.F.R. § 379.3, it shall be the obligation of the subject company to maintain records that adequately support financial and operational data required by the Secretary, and the minimum retention periods are provided in appendix A to this part. Because those time limits are short, a lawyer can ask the carrier in writing to keep them.

How do you get the police report after a motorcycle accident in Clayton County?

The police report comes from the agency that responded to the crash. That may be a city police department or the sheriff’s office. Ask that agency for a copy, and ask which office holds the crash report.

The report lists the parties, the vehicles, the road conditions and the officer’s observations. It is one document among many, so keep your own photos and notes too. Georgia’s Department of Transportation explains its crash reporting system, including how crash reports are obtained, on its GDOT crash reporting page.

Timing varies from one agency to another. For how long the process usually takes, read how long a police report takes in Georgia. For who may access a report, see who can access police reports.

Why does medical treatment and documentation matter after a motorcycle wreck?

Medical care creates the record that links your injuries to the crash. Get checked the same day, even when the pain seems small. Motorcycle crashes often cause fractures, road rash, head and spine injuries and internal injuries. Some of these do not show symptoms right away.

Keep every appointment, prescription receipt and bill. Follow the treatment plan you are given. Insurers may question a gap in care, so a missed follow-up can be used against you.

Georgia law also limits how medical bills are counted. Special damages for medical and healthcare expenses are limited to the reasonable value of medically necessary care, under O.C.G.A. § 51-12-1.1. If treatment is provided under a letter of protection, the letter and itemized charges are relevant and discoverable in a claim.

What deadlines apply to a motorcycle injury claim in Georgia?

Georgia generally requires a personal injury lawsuit within two years after the right of action accrues, under O.C.G.A. § 9-3-33. Other deadlines apply in some cases, so write down every date that starts from the crash.

Claims against a city or other municipal government have a shorter first step. Under O.C.G.A. § 36-33-5, the claim must be presented in writing to the governing authority within six months of the event. The description of the extent of the injury shall include the specific amount of monetary damages being sought from the municipal corporation.

Under O.C.G.A. § 36-33-5, no person, firm, or corporation having a claim for money damages against a municipal corporation on account of injuries to person or property shall bring an action against the municipal corporation for such injuries without first giving the notice provided in that Code section.

Talks with an insurance company are not a lawsuit. General damages are those the law presumes to flow from a wrongful act, and they can be recovered without proof of an amount. Special damages actually flow from the act and must be proved, under O.C.G.A. § 51-12-2. Medical bills are a common example of special damages.

Damages compensate for injury. Where an injury is of a character capable of being estimated in money, compensation is the measure of damages; if an injury is small or the mitigating circumstances are strong, nominal damages only are given, under O.C.G.A. § 51-12-4.

Fault also matters. Georgia’s modified comparative fault rule reduces damages by the injured person’s percentage of fault (O.C.G.A. § 51-12-33; Quynn v. Hulsey, 310 Ga. 473 (2020)). That is why facts gathered at the scene matter.

No dollar figure can be predicted from a crash description alone. Each claim depends on its own medical records and facts. For how settlement money is divided among costs, fees and liens, read how a $25,000 settlement is split.

When should you talk with a lawyer about a motorcycle crash with a semi truck?

You can talk with a lawyer once you know the basic facts of your crash and your injuries.
