Possibly, yes. Georgia uses a shared-fault rule. That position is an opening argument. It is not a final ruling on who pays.

Insurers often raise fault early. They may do it before anyone has pulled the driver’s logs, the truck’s data, or the police file. A fault label placed on a crash at the scene is not the end of the story. The question is decided through evidence.

You may be reading this for someone else. A spouse, parent, or adult child may be the one who was hurt, and you’re trying to understand what comes next. The same basic rules apply whether you were hurt or you are helping someone who was.

It helps to ask a few plain questions early. What exactly is the other side saying you did? What is their basis for that claim? Who else was on the road or working on that truck? Written answers give you something concrete to review.

If a truck driver or insurer has blamed you for your crash, you don't have to sort out the fault question alone. Under this rule, a fault finding reduces your damages. It does not automatically erase them, but if you are 50 percent or more responsible, you may not receive any damages.

The key line is 50 percent. The statute says the plaintiff (the injured person who files the claim) “shall not be entitled to receive any damages if the plaintiff is 50 percent or more responsible for the injury or damages claimed (O.C.G.A. § 51-12-33).” Fault below 50 percent still allows recovery, reduced by your share. Fault at 50 percent or more bars damages under this rule.

Under subsection (a), the trier of fact (the jury, or whoever decides the case) sets the fault percentage. The judge then reduces the damages in proportion. The fault question asks who did what, and it is measured in percentages.

How a Fault Percentage Reduces What You Recover

A fault percentage reduces the damages award by that share of the total. Here is a labeled hypothetical, not a prediction:

Total damages: $100,000

Fault assigned to the injured person: 20 percent

Reduction: $20,000

Amount recoverable: $80,000

Damages are the money awarded for the harm you suffered. The statute reduces “the amount of damages otherwise awarded” by your percentage. The reduction comes off the damages figure, not off a separate amount.

Fault percentages are not set in advance. They are decided on the facts of each crash, so two similar wrecks can produce different numbers. Fault is often one of the most contested parts of a truck case, which is why the records matter.

Why More Than One Party May Share Responsibility in a Truck Crash

More than one person or business can share fault in a truck crash. Possible parties include the driver, the trucking company, the vehicle owner, a maintenance contractor, a company that loaded the cargo, or another motorist.

Georgia can hold an employer responsible for work-related driving. Under O.C.G.A. § 51-2-2, a person is liable for torts committed by a servant (a worker) “in the prosecution and within the scope of his business.” In plain terms, a company can answer for a driver’s negligence while the driver was doing company work.

A driver’s own mistakes and a company’s responsibility are separate questions. Both can be examined in the same case. A settlement offer from a trucking company raises its own questions, so review it with those in mind.

Evidence That Often Matters When Fault Is Disputed

The records that often shape fault include the driver’s hours, the truck’s data, and the crash scene file. Federal rules limit driving time. Under 49 CFR 395.3, a driver may not drive after 14 consecutive hours from coming on duty that followed 10 consecutive hours off duty. A driver also may not drive once more than 8 hours have passed without a 30-minute break, unless a short-haul exception applies.

Federal rules also bar a driver from operating when fatigue or illness makes it unsafe, under 49 CFR 392.3.

The test must be done as soon as practicable, under 49 CFR 382.303. If a test is not given within two hours, the employer must keep a record of why.

Other evidence matters too. Police reports, photographs, witness statements, dashcam or traffic camera footage, and medical records can show how the crash happened and when treatment began. Records can be overwritten, lost, or thrown out. Early requests help make sure the file is complete.

Can You Still Recover Lost Wages If Fault Is Disputed?

Lost wages can be part of a truck crash claim. If you are found partly at fault, a fault percentage reduces the wage portion along with the rest of your damages.

Under O.C.G.A. § 51-12-2, special damages are those that “actually flow from a tortious act” and “must be proved in order to be recovered.” Lost income is a loss you show with records, so plan to document it from the start.

Useful proof includes pay stubs, tax records, employer verification of missed time, and doctor’s notes that restrict work. A lost wage verification form can also help organize the details. Many people skip the work-restriction notes or don’t keep pay records for time off. Those gaps are hard to fill in later.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

The Time Limit for Filing a Georgia Truck Crash Claim

Georgia generally gives two years to bring an injury claim. The clock runs from when the right of action accrues, not from when the insurer finishes its review. Some claims have their own rules, so have the dates checked early.

Talk Through Your Facts With Terance Madden at T.
