It does not win a case on its own. Federal rules limit how long a truck driver can drive and how much rest the driver needs. If a driver or carrier broke those rules, and the break connects to your crash, that violation becomes a key part of the proof.

This guide explains the rules, the records that show a violation, how Georgia law divides fault, and what to do next. T. Madden & Associates, P.C. has practiced law in Georgia since 1999.

What the Hours-of-Service Rules Require

Federal rules limit how long a driver of a property-carrying commercial motor vehicle may drive. They also require rest. The core limits are simple to state.

A driver must take 10 consecutive hours off duty before driving. The driver may not drive after 14 consecutive hours on duty that follow that rest. Under 49 C.F.R. § 395.3, a driver may drive a total of 11 hours during the period specified in paragraph (a)(2) of that section. 49 CFR § 395.3 sets these limits.

Weekly caps apply too. A driver may not drive after 60 hours on duty in 7 consecutive days if the carrier does not operate commercial motor vehicles every day of the week, or after 70 hours on duty in 8 consecutive days if the carrier operates commercial motor vehicles every day of the week. The cap depends on whether the carrier runs every day of the week. An off-duty period of 34 or more consecutive hours can end those periods.

The rules have a clear purpose. 49 CFR § 392.3 provides that a motor carrier shall not require or permit a driver to operate a commercial motor vehicle while the driver’s ability or alertness is so impaired, or so likely to become impaired, through fatigue, illness, or any other cause, as to make it unsafe to begin or continue operating it.

If a truck driver may have been past the federal driving limit when you were hurt, you may have a claim worth reviewing, and our team is ready to talk it through with you. Carriers must require each driver to use an electronic logging device (ELD), unless the driver is allowed to record duty status manually under 49 CFR § 395.8. 49 CFR § 395.8 sets that requirement. The ELD record shows driving, on-duty, and off-duty time.

Logs are not the only record. Carriers must keep supporting documents, such as dispatch records, trip records, and expense receipts tied to on-duty time that is not driving. 49 CFR § 395.11 covers those documents. Drivers must submit them to the employer within 13 days of either the 24-hour period to which the documents pertain or the day the document comes into the driver’s possession, whichever is later. This does not apply to drivers for a private motor carrier of passengers (nonbusiness).

Carriers must keep records of duty status for not less than 6 months from the date of receipt. That short window is why early action matters. Federal rules also ban false reports about duty status, and ban tampering with an ELD so that the device does not accurately record and retain required data. No motor carrier or driver may obscure, deface, destroy, mutilate, or alter existing information contained in a supporting document.

Comparing records is where the real work happens. A log may show a driver resting in one town. Fuel receipts, toll records, dispatch messages, and GPS data may place the truck on the highway at that same time. A conflict like that is what our team tests.

Can a Violation Prove Fault in Georgia?

But the injured person must still connect it to the crash. A rule break shows a driver or carrier ignored a safety rule. The real question is whether that break caused or contributed to your injuries.

Georgia uses modified comparative fault, which means shared fault reduces what you can recover. O.C.G.A. § 51-12-33 reduces damages by the injured person’s percentage of fault. If that person is 50 percent or more responsible, recovery is barred. Each at-fault party pays only its own share, not a joint amount.

Georgia defines ordinary negligence as failing to use the care an ordinarily prudent person would use in similar circumstances. O.C.G.A. § 51-1-2 states that standard.

Defense arguments often claim another driver caused the crash, the road was at fault, or a sudden emergency left no time to react. The logs and supporting records help answer those points. They show the driver’s hours, location, and timing before the crash.

Evidence That Tends to Matter Most

The strongest proof usually starts with the logs. Pull the ELD data for the 24 hours before the crash. Compare it with the truck’s route, timestamps, and stops.

Next come dispatch messages, fuel and toll receipts, and GPS or telematics data. These show where the truck was and when it was there.

The crash report, photographs, vehicle damage, and any dashcam or traffic camera video also matter. They show how the crash unfolded and what the scene looked like.

Carrier files matter too. Training, hiring, and supervision records may show whether the carrier watched driver compliance. Medical records tie your injuries to the crash, which matters as much as fault.

What to Preserve and Do First

Preserve every crash-related document now. That includes bills, photos, medical records, texts, and emails. Write down what you remember while it is fresh.

Send a written preservation request early. It tells the carrier and its insurer that logs, ELD data, and dispatch records must be kept. Carriers must keep logs for at least 6 months, so waiting can cost you evidence.

Avoid giving recorded statements to the carrier’s insurer before you speak with our team. Keep track of your treatment too. Gaps in care are often used to challenge injury claims. Read our guide on treatment gaps in truck crash insurance claims. If your vehicle needs repair, see who pays for car repair after a truck crash. For medical bills while a claim stays open, see letter of protection in truck crashes.

Georgia Time Limits to Keep in Mind

Georgia generally requires a personal injury lawsuit to be brought within two years after the right of action accrues. O.C.G.A. § 9-3-33 sets that two-year period for injuries to the person. The same statute gives loss-of-consortium claims four years.

Other claim types, including some wrongful death claims, can follow different timing rules. Because deadlines vary, early review helps. Evidence such as logs and dispatch records is easier to gather while it still exists.

For the full picture, read our truck accident lawyer guide for Georgia.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk With the Firm About Your Crash

If a truck driver may have been past the federal driving limit when your crash happened, you may have a claim worth reviewing.
