Tax treatment is a separate question from the injury claim, and this page covers the claim side. Georgia law decides what a settlement can pay for, and each category follows its own rules. T. Madden & Associates, P.C. has practiced injury law since 1999 and does not give tax advice.

What a Georgia Truck Accident Settlement Pays For

A truck accident settlement pays for general damages and special damages. General damages are the losses the law presumes from any wrongful act, and they can be recovered without proof of an amount. Special damages actually flow from the crash and must be proved. (b) Special damages are those which actually flow from a tortious act; they must be proved in order to be recovered.

Medical bills, lost income and other out-of-pocket costs usually fall into the special damages group. Georgia also treats necessary expenses from an injury as a legitimate item in the estimate of damages under O.C.G.A. § 51-12-7.

Damages are meant to compensate for an injury. If an injury is small or the mitigating circumstances are strong, nominal damages only are given, under O.C.G.A. § 51-12-4. That is why the proof behind each claim matters as much as the bills themselves.

If an insurer's offer after your truck crash has you unsure what the money covers, our team can talk it through with you in a free, confidential consultation. Under § 51-12-1.1(c), the court considers both the amounts billed and the amounts actually needed to satisfy those charges under the insurance contract. That holds whether or not the insurance was used. The number on a hospital bill is not the whole story.

Some injured people receive treatment under a letter of protection, which is a promise to be paid from the eventual settlement. Under § 51-12-1.1(d), that letter, the itemized charges, any sale of the bill below invoice price, and the identity of any referral source can be relevant and discoverable. Keep every letter you sign, because these details can come up in the claim.

Damages That Have Their Own Limits

Punitive damages, emotional distress and future money each follow a separate rule. Punitive damages are not compensation. Under O.C.G.A. § 51-12-5.1(c), they are awarded solely to punish, penalize, or deter a defendant, and they must be specifically prayed for in the complaint.

For most truck crash cases, the cap matters. Unless the case is provided for by subsection (e) or (f) of § 51-12-5.1, such as a defendant who acted with specific intent to cause harm or was substantially impaired by alcohol or drugs, punitive damages are limited to $250,000.00 under § 51-12-5.1(g).

If the entire injury is to your peace, happiness, or feelings, the jury sets the measure of damages, and punitive damages are not awarded. That rule appears in O.C.G.A. § 51-12-6. Future economic losses, such as future medical costs or lost wages, may be reduced to present value using a 5 percent discount rate or another rate the jury finds appropriate, under § 51-12-13(a).

Wrongful Death Recoveries After a Truck Crash

When a truck crash causes a death, the recovery is measured differently. A surviving spouse may recover the full value of the life of the decedent, as shown by the evidence, under O.C.G.A. § 51-4-2(a). If there is no surviving spouse, a child or children may recover that same measure.

Where no person is entitled to bring an action for the wrongful death of a decedent under O.C.G.A. § 51-4-2 or § 51-4-4, the administrator or executor of the decedent may bring the action and may recover and hold the amount for the benefit of the next of kin, under § 51-4-5(a) and (b), and in such a case the amount of the recovery is the full value of the life of the decedent.

Two details often matter. A surviving spouse who shares a recovery with children receives no less than one-third of it, under § 51-4-2(d)(2). If there is no surviving spouse and an action for wrongful death is brought by a minor child or minor children, the natural guardian, guardian, or next friend of any such minor child must qualify as a conservator if necessary to receive payment of the settlement, hold and use the settlement for the benefit of the minor, be accountable for it as provided in Code Section 29-3-1, and obtain court approval of the settlement as provided in Code Section 29-3-3, as set out in O.C.G.A. § 51-4-2(b)(3).

Medicare Repayment, Fault Rules and Records to Check Early

Medicare may pay accident-related bills first.

Fault also shapes the number. Under O.C.G.A. § 51-12-33, damages are reduced by the plaintiff’s share of fault, and a plaintiff who is 50 percent or more responsible recovers nothing, as the Quynn v. Hulsey opinion explains.

Federal rules add records to request early. Commercial truck drivers must take federal post-accident drug and alcohol testing, under FMCSA testing requirements. Federal rules at 49 C.F.R. § 390.15 require motor carriers to maintain an accident register for 3 years after the date of each accident.

Ask that the settlement agreement describe what each payment covers. Keep bills, receipts, settlement statements, and any structured settlement paperwork. Tax questions about those payments fall outside this page, and T. Madden & Associates, P.C. does not give tax advice.

Connecting the Settlement Question to Your Truck Crash Claim

If an insurer or trucking company’s offer is on the table, review the claim and the settlement terms together before you sign. How each payment is described affects what the money pays for, and the deadline and fault rules above run in the background.

Our team at T.
