Yes. Any driver who believes you caused a crash can file a claim or lawsuit against you, even if that driver was hurt too. Filing is the easy part. The claim still has to prove who was at fault and what damages followed. This page explains how fault works in Georgia, how insurance responds, and which deadlines matter.

Short Answer: Yes, the Other Driver Can File a Claim Against You

Yes, the other driver can file a claim against you. Fault is usually the main fight, and the other side often says you caused the wreck.

A claim has two core parts. First, the other driver must show that you were negligent. Georgia defines ordinary negligence as the failure to use the care an ordinarily prudent person would use in similar circumstances, under O.C.G.A. § 51-1-2. Second, the claim must show real damages that came from the crash.

Filing a claim is not the same as winning it. A claim that cannot prove fault or damages can fail. That is why the next section matters: it explains how fault gets divided in Georgia.

Get a free consultation

Get a free consultation

How Georgia’s Modified Comparative Fault Rule Affects a Claim Against You

Georgia reduces an award by the injured person’s share of fault. It bars recovery completely at 50 percent. This is called modified comparative fault, or shared fault. Under O.C.G.A. § 51-12-33, the jury decides each person’s percentage of fault, and the judge reduces the award in proportion to the injured person’s share.

The 50 percent line is the key number. The statute says a plaintiff who is 50 percent or more responsible “shall not be entitled to receive any damages (O.C.G.A. § 51-12-33; Quynn v. Hulsey (2020)).” If you are less than 50 percent at fault, your award is reduced but not erased.

A Simple Example

Suppose a jury sets total damages at $100,000 and finds you 20 percent at fault. The award drops by 20 percent, to $80,000. If the jury found you 50 percent at fault, you would receive nothing. This is a hypothetical example, not a prediction for any case.

When more than one person is liable, each one pays only its own share. Those shares are not joint liability, and no one can seek contribution from another for that share.

Fault can also be assigned to someone who is not in the lawsuit. A defendant can give notice, not later than 120 days before trial, that a nonparty was at fault. Georgia also has an avoidance rule. Under O.C.G.A. § 51-11-7, if you could have avoided the consequences to yourself caused by the defendant’s negligence by using ordinary care, you are not entitled to recover.

Fault is usually proved with the police report, photos of the vehicles, the damage pattern, and witness accounts. Each piece of that evidence can point to a different driver.

What a Counterclaim Is and When an Injured Driver Gets Sued Back

A counterclaim is a claim that a defendant files back against the person who sued them. In a car case, a driver who was blamed may claim the other driver owes them for their own injuries or damaged vehicle.

A dispute usually moves through three stages:

Demand letter: a written request for money, often from the other side or its insurer. It is not a court filing.

Insurance claim: an adjuster reviews the crash, the fault, and the damages.

Lawsuit: the claim is filed in court. Under Georgia’s summons statute, the clerk issues a summons when the complaint is filed and delivers it for service.

Court papers set a deadline to respond. Missing that deadline can seriously hurt your position. Read anything you receive quickly, and do not set it aside. A blame claim that starts as a demand letter can grow into a two-sided case, with counterclaims from the same crash.

How Insurance Defends and Pays When the Other Driver Blames You

Liability coverage generally pays for a defense and covers settlements or judgments up to the policy limit. Coverage is capped by that limit. Any amount above the limit can become your problem.

Insurance rules for vehicles can affect how a crash claim is handled, so questions about coverage are worth raising with a lawyer.

If the other driver has no insurance, uninsured motorist coverage may matter. Under O.C.G.A. § 33-7-11, Georgia auto liability policies generally must include an endorsement or provisions that pay the insured for bodily injury caused by an uninsured motor vehicle, unless the insured rejects that coverage in writing. O.C.G.A. § 33-7-11 reads: “(a)(1) No automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state to the owner of such vehicle or shall be issued or delivered by any insurer licensed in this state upon any motor vehicle then principally garaged or principally used in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured’s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs which at the option of the insured shall be.”

Report the crash to your own insurer promptly. Your insurer and the other driver’s insurer owe different duties to different people. Ask your insurer in writing what it will do if a lawsuit names you. An insurer can deny or dispute coverage in some situations, so get its answer on paper.

Statements, Photos, and Records That Shape Who Was at Fault

What you say at the scene and afterward can be used to argue fault. Stick to what you saw and what you felt. Avoid guessing about speed, distance, or who had the right of way.

An insurer may ask you for a recorded statement. What you say on that recording can be used later. You can talk with a lawyer before you agree to give one.

Useful evidence includes:

Photos of both vehicles, where they came to rest, and the damage to each.

Names and phone numbers of anyone who saw the crash.

The police report number.

Requests for video from traffic cameras or nearby businesses, which may be kept only for a limited time.

Medical records that tie your injuries to the crash.

Medical records matter most if the other side argues that your injury came from something else.

Deadlines That Apply Even When You Are Being Blamed

Georgia generally gives two years from the date of injury to file an injury claim. The statute, O.C.G.A. § 9-3-33, says such actions “shall be brought within two years after the right of action accrues.” It begins with “except as otherwise provided,” so other rules can apply to some claims.

Claims for loss of consortium, which means a spouse’s loss of companionship, have a four-year period under the same statute.

Deadlines differ in length for different claims, but each runs from when the right of action accrues. Do not assume one date covers everything. When court papers arrive, a response period starts. Those papers set the timing, so act on them quickly.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Facing a Blame Claim or Court Papers?
