After a crash, the driver’s electronic logs can show whether those limits were followed. This page explains how that works in Georgia claims, what a log mismatch can mean, and what to do next.

What Do Federal Hours-of-Service Rules Require?

Federal hours-of-service rules set daily and weekly limits on how long a property-carrying truck driver may drive and work. These are the main limits:

Start of shift: A driver may not drive without first taking 10 consecutive hours off duty (49 CFR § 395.3).

14-hour window: A driver may not drive after 14 consecutive hours on duty that follow 10 hours off.

Driving limit: Within that window, a driver may drive a total of 11 hours.

Break rule: Driving is not allowed after more than 8 hours of driving without a 30-minute break. Some short-haul drivers have exceptions.

Weekly caps: A driver may not drive after 60 hours on duty in 7 days, or 70 hours in 8 days, depending on whether the carrier runs every day of the week.

Reset: A period of 34 or more consecutive hours off duty can end a 7- or 8-day period.

These numbers matter because fatigue makes driving unsafe. Federal rules bar a driver from operating a commercial vehicle when ability or alertness is so impaired, or so likely to become impaired, through fatigue, illness or any other cause, as to make it unsafe to operate it (49 CFR § 392.3).

You can check a log against these limits line by line.

If a truck driver's logs don't match the trip before your crash, you may have a claim, and our team can review it with you in a free, confidential consultation. That timeline can be compared with the crash time, the route and other trip records.

Carriers that run commercial trucks must install ELDs and require drivers to use them to record duty status (49 CFR § 395.8), unless an exception applies: a motor carrier may require a driver to record duty status manually, rather than require an ELD, if the driver is operating a commercial motor vehicle under the conditions listed in § 395.8(a)(1)(ii). The driver and carrier must keep those ELD records accurate (49 CFR § 395.30). Neither may make a false report about duty status (49 CFR § 395.8(e)(1)); a motor carrier also may not coerce a driver to make a false certification of the driver’s data entries or record of duty status (49 CFR § 395.30(e)).

Common warning signs include:

Mileage between stops that is impossible at the logged times

Gaps or unexplained off-duty entries

Edits that lack an annotation explaining the change

Logs that conflict with fuel receipts, bills of lading or dispatch messages

A conflict is not proof on its own. It is a question the records must answer.

Timing matters. Carriers must keep records of duty status and supporting documents for at least 6 months from receipt (49 CFR § 395.8). That is a short window, so early requests help make sure the records still exist.

Which Truck Crashes Can Involve Log Violations?

Log and fatigue questions can come up in crashes with 18-wheelers, box trucks, tankers and other commercial vehicles on Georgia roads, including along I-75, I-16 and I-20. The driver is not always the only party to review.

Under Georgia law, a company can be liable for torts its servant commits within the scope of its business (O.C.G.A. § 51-2-2).

Some crashes cause catastrophic injuries or death. Under Georgia’s wrongful death statute, a surviving spouse, or children if there is no surviving spouse, may recover the full value of the decedent’s life, as shown by the evidence (O.C.G.A. § 51-4-2).

T.
