This guide explains that deadline, the steps from demand to trial, and how Georgia divides fault. It is written for drivers, passengers, and families in Clayton County and Jonesboro who are deciding whether to file.

When a Car Accident Claim Becomes a Lawsuit

A car accident lawsuit is a civil complaint filed in a Georgia court. It asks for money for injuries, vehicle damage, and other losses caused by another driver’s negligence.

Most car accident claims are settled with insurers before any suit is filed. A lawsuit usually comes later, when talks stop moving.

Claims often stall in three ways:

The insurer makes an offer that does not cover your medical bills or lost wages.

The insurer denies that its driver was at fault.

You are still treating, so the full cost of your injuries is not yet known.

A stall does not mean your claim is lost. It means you need to decide whether to keep negotiating or file suit. That decision has a clock on it.

If your insurance claim has stopped moving after a Clayton County crash, our team can talk through whether filing suit makes sense for you now. Talks with an adjuster do not file a lawsuit. Plan around the two-year date from the first week.

A complaint must be filed before that date passes. That leaves time to gather records, draft the complaint, and prepare for service.

Some claims have shorter notice windows:

City claims. Under O.C.G.A. § 36-33-5, a claim against a municipal corporation for injuries to person or property must be presented in writing to its governing authority within six months of the event.

State claims. Under O.C.G.A. § 50-21-26, a written notice of a tort claim against the state under this article must be given within 12 months of when the loss was discovered or should have been discovered.

If a city or state vehicle was involved, review these windows right away.

Steps to File a Car Accident Lawsuit in Georgia

A Georgia car accident lawsuit moves from a written demand to a complaint, service, an answer, discovery, and resolution. The stages can overlap.

Demand and negotiation. The claim goes to the insurer with medical records, bills, and proof of lost wages. Your records must show why each treatment was needed.

Complaint. If talks fail, a complaint is drafted and filed in the Georgia court that has jurisdiction over the claim. It names the at-fault driver and any other responsible party.

Summons and service. Under O.C.G.A. § 9-11-4, the clerk issues a summons when the complaint is filed. The summons is then delivered for service on the defendant.

Answer. Under O.C.G.A. § 9-11-12, a defendant shall serve an answer within 30 days after the service of the summons and complaint upon the defendant, unless otherwise provided by statute. Unless the court sets a different time, serving a motion under this Code section alters the time for serving an answer.

Discovery. Both sides exchange written questions and document requests, and depositions are taken. Medical records are reviewed.

Resolution. Mediation, motions, or trial preparation follow if the case does not settle. Under O.C.G.A. § 51-12-15, in any action to recover damages for bodily injury or wrongful death, any party may elect, by written demand prior to the entry of the pretrial order, to have fault and any award of damages determined in separate phases. The court may reject an election by any party and order a concurrent trial of fault and damages only upon motion by any party in opposition to that election and upon the court’s determination of the conditions set out in subsection (b) of O.C.G.A. § 51-12-15. The first is that the plaintiff (or, if the plaintiff is the legal guardian of a minor, the minor) was injured by an alleged sexual offense and would be likely to suffer serious psychological or emotional distress from testifying more than once in a bifurcated proceeding. The second is that the amount in controversy is less than $150,000.00.

The pace depends on the facts of each case, the court’s schedule, and where each side stands.

How Fault Is Divided Under Georgia Law

Georgia reduces your damages by your share of fault. Under O.C.G.A. § 51-12-33, the judge reduces the damages awarded to you in proportion to your percentage of fault. Under the same statute, you receive no damages if you are 50 percent or more responsible for the injury.

Fault is not only between you and the other driver. The trier of fact (the jury or judge deciding fault) considers everyone who contributed to the injury. That includes people who were never named in the suit. A defendant can also give notice, no later than 120 days before trial, that a nonparty was at fault.

Insurers often argue that the injured driver was speeding or distracted. Each argument aims at your percentage. That is why early evidence matters: crash reports, photos, witness names, and vehicle data. According to the Georgia Department of Public Safety, the Georgia State Patrol investigates fatal and major-injury motor vehicle crashes. Victims and family members can request the status of that investigation.

What Our Team Does When We File Suit

Our team reviews the crash facts and insurance coverage.
