Only if your own auto policy includes it. MedPay, or medical payments coverage, is a separate coverage that appears on a policy only when it was bought. If it’s there, it can pay certain medical bills from the crash, up to the limit on your policy. Here’s how to check, and how it fits with an injury claim.

The Short Answer: Is MedPay Required in Georgia?

Whether a policy includes MedPay coverage depends on that policy, so the declarations page is the place to check. Whether you have it depends on your own policy wording.

When a policy includes MedPay, it generally pays reasonable medical bills from the crash, up to the policy limit. Your own insurer pays it, so the coverage comes from your policy, not from the other driver’s insurance.

That difference matters. A claim against the at-fault driver’s insurer is a separate matter. You can have MedPay and still pursue that claim, and each one follows its own rules.

An insurance information card lists key details about a policy, and keeping a current copy in the vehicle can help after a crash. Keep yours handy when you call your insurer, since it shows who insures your vehicle (Georgia Department of Revenue insurer requirements).

If your MedPay line is unclear and crash bills are arriving, our team can talk through your options with you in a free first consultation. Your own insurer handles that claim.

Common costs include ambulance rides, emergency room visits, hospital stays, and follow-up treatment. Exactly what is covered depends on your policy terms, so read the wording that applies to you.

The policy limit is the most MedPay will pay. The limit is written in the policy. Once the limit is used up, MedPay stops paying, and any remaining bills go to other sources.

Coverage also reaches certain people. The policy language sets who is covered, such as the named driver, household members, or passengers. If you were a passenger, the policy on the car you rode in may matter too.

Send bills to your insurer as they arrive. Keep a copy of everything you send, so you can show what was paid and what is still open.

How to Check Your Declarations Page for MedPay

Start with the declarations page of your auto policy. It’s the summary sheet that lists your coverages, limits, vehicles, and drivers.

Look in the coverage list, usually near your liability limits, for a line labeled medical payments or MedPay. A dollar amount beside that line means the coverage is on your policy.

No MedPay line means it was not bought on that policy. Having car insurance doesn’t automatically mean you have MedPay.

If the page is unclear, call your insurer or agent with your policy number. Ask them to confirm the MedPay limit in writing.

Policies can change at renewal. Check the current declarations page, not an old copy you saved months ago.

How MedPay Interacts With a Later Injury Claim

MedPay can pay bills while your injury claim is still open. You don’t have to wait for a settlement to get some bills paid.

Some policies include terms about repayment from a later settlement. Check your policy wording, and keep records of every MedPay payment you receive.

Your health insurance matters too. Under O.C.G.A. § 51-12-1.1(c), if you have health insurance, the evidence includes both the amounts charged for your care and the amounts actually needed to satisfy those charges under your insurance contract. That applies whether or not you used the insurance.

Medical costs are limited to the reasonable value of medically necessary care. O.C.G.A. § 51-12-1.1(b) sets that standard.

Under O.C.G.A. § 51-12-1.1(b), special damages for medical and healthcare expenses are limited to the reasonable value of medically necessary care, treatment, or services, and the trier of fact determines that amount.

Fault matters too. Under O.C.G.A. § 51-12-33, damages are reduced by your share of fault. You receive no damages if you are 50 percent or more responsible.

Steps to Take Now If You Were Hurt in a Georgia Crash

Get medical care first. Then notify your own insurer and keep every record of the crash.

The Georgia insurance commissioner auto claim tips advise promptly notifying police and your insurer. They also suggest collecting accident and witness information, documenting the scene, and avoiding statements about fault.

Ask your insurer in writing whether MedPay is open on your claim. A written answer gives you a clear record.

Keep a log of symptoms, missed work, and every medical visit. These records support any later claim.

Pause before you give a recorded statement or sign a release for the other side’s insurer. Understand how your own coverage fits first.

For the full overview of options after a crash, see our Georgia car accident lawyer page.

Talk With T.
