Yes. If another driver’s careless act caused your crash, you can bring a claim against that driver, even though you did nothing wrong. Many of these cases begin as an insurance claim and become a lawsuit only if they cannot be resolved. This guide explains how Georgia’s fault rules, filing deadlines and insurance coverage shape that path.

If another driver's choices left you hurt and the insurer is questioning fault, you don't have to sort it out alone. An injured driver who was not at fault can pursue the driver whose negligence caused the crash. Negligence means failing to use the care a prudent person would use in the same situation. Georgia defines ordinary negligence as the absence of that ordinary diligence (O.C.G.A. § 51-1-2). Georgia law also allows recovery when someone breaks a legal duty and that breach causes you damage (O.C.G.A. § 51-1-6).

Common examples include speeding, looking at a phone, running a red light, or changing lanes without checking the blind spot. Each one is a failure to use reasonable care.

Passengers can also be hurt in a crash they did not cause. Family members may have questions about who can bring a claim. The answer depends on the facts of the case.

Being not at fault does not mean the other side will accept blame. Insurers often dispute fault.

How Georgia’s fault rules affect your claim

Georgia reduces your damages by your percentage of fault. It bars recovery if you are 50 percent or more responsible. The judge reduces the award in proportion to your fault share (O.C.G.A. § 51-12-33).

Here is how the math works. Suppose a jury values your losses at $100,000 and finds you 20 percent at fault. Your award would drop by 20 percent, to $80,000. This is an illustration of the math, not a prediction for any case.

The jury must also weigh the fault of everyone who contributed to your injury.

Fault percentages depend on the facts of each crash. Two rear-end collisions can look alike and still end with different fault findings. That is why the details matter.

Claim with the at-fault driver’s insurer or file a lawsuit

Most not-at-fault claims start with the at-fault driver’s liability insurer. That insurer reviews the claim and may make an offer. A lawsuit becomes the next step when the insurer disputes fault, the injury value is contested, or the claim cannot be settled.

Liability coverage has limits. A serious injury can produce losses larger than the at-fault driver’s policy limit. Find out the limit early. It shapes what a settlement can cover.

The general sequence runs like this. You give notice of the claim. The insurer investigates. Your side sends a demand with your losses and proof. Both sides negotiate. If talks fail, a lawsuit is filed. Each stage builds on the records gathered before it.

When the at-fault driver is uninsured or underinsured

If the at-fault driver has no insurance, your own uninsured motorist coverage may apply. Georgia requires automobile liability policies to include provisions that pay the insured’s damages from an uninsured vehicle’s owner or operator (O.C.G.A. § 33-7-11). O.C.G.A. § 33-7-11 provides that no automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured’s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs as set out in the statute. Your own policy sets its terms.

Policy terms, notice requirements and coverage amounts vary. Pull your declarations page and read the coverage amounts. Check the notice steps your policy requires. Bring these papers to your conversation with our team.

A hit-and-run or unknown driver raises separate questions. When the owner or operator is unknown, Georgia law allows a suit against an unknown defendant called “John Doe.” The insurer that issued the policy is served as if it were a named defendant (O.C.G.A. § 33-7-11).

Other parties who may share responsibility

Yes, more than one party can share fault. Under Georgia’s apportionment rule, each liable person owes only their own share. Those damages are not joint, and they are not subject to contribution (O.C.G.A. § 51-12-33). So who gets named in the claim matters.

Commercial truck crashes often involve more than one company. Georgia law makes an employer liable for a contractor’s negligence in listed situations, including when the employer keeps the right to direct or control the time and manner of the work (O.C.G.A. § 51-2-5).

Roads and public property add another layer. A claim against a city over a road defect requires written notice to the city’s governing authority within six months of the event (O.C.G.A. § 36-33-5). A claim against the state requires written notice within 12 months of when the loss was discovered or should have been discovered (O.C.G.A. § 50-21-26). Notice comes before any lawsuit, so act early.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Georgia filing deadlines to keep in mind

Georgia generally gives two years from the injury to file a personal injury lawsuit (O.C.G.A. § 9-3-33). The clock starts when the right of action accrues, so track the date of the crash from day one. Claims for loss of consortium, such as a spouse’s claim for lost companionship, have four years under the same statute.

The shorter notice periods for cities and the state run on their own timelines. Those notices are covered above, and they come before a lawsuit.

Write the date of the crash down today. Keep it with your police report and insurance papers. Deadlines are easy to lose track of during months of treatment and insurance calls.

Evidence that supports a not-at-fault claim

Evidence turns a not-at-fault account into a claim you can prove. The strongest files usually include a crash report, photos, witness details, medical records and proof of costs. Georgia State Patrol troopers investigate crashes to see whether traffic laws were violated (Georgia Department of Public Safety).

Gather these items as early as you safely can:

Photos of the vehicles, roadway, skid marks, traffic signals and visible injuries.

Names and contact details for witnesses, plus any dashcam or nearby business video.

Medical records and bills that connect your injuries to the crash.
