Georgia lets an injured person sue when another driver’s carelessness caused the crash and the injuries and losses that followed.

The Short Answer: Yes, Often, but It Depends on Fault

Yes, you can usually sue when another driver’s negligence (carelessness) caused your injuries.

A lawsuit is also a separate step from an insurance claim. Most injury cases start with a claim to the at-fault driver’s liability insurer. Many of those claims settle without a case ever going to court. Some do not, and that is when a lawsuit becomes necessary.

This page is general information, not legal advice about your case. Every crash has its own facts, and those facts decide the answer.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Is It Wrong to Sue Someone After a Car Accident?

Courts exist to decide these disputes. A fair claim asks for real losses, such as medical bills, lost wages, and the physical pain and daily hardship an injury causes.

A claim becomes a real problem only when it lacks a factual basis. Blaming a driver who did not cause the crash, or inventing an injury, is wrong. An honest claim backed by records is a different matter.

Many people worry about how a lawsuit will affect a friendship, a job, or their insurance costs. Those worries are common and understandable. Filing a claim is not an accusation against a neighbor or friend. It asks the responsible party’s insurer to cover losses the law recognizes. A good first step is talking through the situation before you decide anything. Our team can explain the process in plain terms.

How Georgia Fault Rules Affect Your Right to Recover

Georgia uses a modified comparative-fault rule (shared fault). You can still recover a reduced amount if you share some of the blame. You recover nothing if you are 50 percent or more at fault (O.C.G.A. § 51-12-33).

Under O.C.G.A. § 51-12-33, if the plaintiff is to some degree responsible for the injury or damages claimed, the judge reduces the damages otherwise awarded to the plaintiff in proportion to the plaintiff’s percentage of fault. The award is reduced “in proportion to his or her percentage of fault.” Under subsection (g), a plaintiff “shall not be entitled to receive any damages if the plaintiff is 50 percent or more responsible.”

For example, if a judge or jury put your fault at 20 percent, your award would drop by 20 percent. Under O.C.G.A. § 51-12-33, the trier of fact determines the plaintiff’s percentage of fault, and the judge reduces the damages otherwise awarded in proportion to that percentage.

A separate rule applies when someone could have avoided harm with ordinary care. Under O.C.G.A. § 51-11-7, if the plaintiff could have avoided the consequences of the defendant’s negligence by ordinary care, the plaintiff is not entitled to recover.

Fault is decided from the evidence, such as the police report, citations, witness accounts, photos, vehicle damage, and the other driver’s statements. A traffic ticket helps tell the story, but it does not settle fault by itself. Insurers and juries may weigh the same evidence differently than you do.

Who Can You Sue in a Georgia Car Accident?

The at-fault driver is usually the main defendant. A defendant is the person a lawsuit names. That driver may have lived in Georgia or in another state.

If the defendant lived out of state, the case may still be filed in Georgia. These rules are technical, so review them early with the facts of your crash in hand.

Other parties can matter too. A vehicle owner may be involved in some cases. A trip to work or a personal errand is often treated differently. Those details can change the answer.

Lawsuits usually name the driver or another responsible party. They usually do not name the insurance company itself. Your claim with the insurer is a separate step.

If the other driver had no insurance, your own policy may help. O.C.G.A. § 33-7-11 generally requires an auto liability policy to include coverage that pays an insured, within policy limits, for bodily injury caused by the owner or operator of an uninsured motor vehicle, unless the named insured rejects that coverage in writing or selects different limits in writing.

Deadlines: How Long After an Accident Can You Sue in Georgia?

For most injury claims, you generally have two years. Under O.C.G.A. § 9-3-33 (Cameron v. JMP Pizza, Inc. (2026)), actions for injuries to the person must be brought within two years after the right of action accrues. Loss of consortium claims, which involve a spouse’s injury, have four years under the same statute.

Property damage has a different clock.

Some deadlines can pause. For a crime committed in Georgia, O.C.G.A. § 9-3-99 tolls the limitation period for the victim’s tort claim from the date of the alleged crime until the prosecution becomes final or otherwise terminates, for no more than six years. The pause cannot exceed six years. Do not count on it, because it applies only in specific situations.

Missing a deadline can bar your claim completely. Insurance talks do not replace a filed lawsuit. The clock keeps running while you negotiate, so do not wait for an offer before you learn your dates.

Have questions about what happened?

Ask our team directly. Economic damages are money losses you can document. They include medical bills (past and future), lost wages, lost earning ability, and out-of-pocket costs such as prescriptions and travel to appointments.

Non-economic damages cover harm that has no bill. Examples include pain and suffering, emotional distress, and loss of enjoyment of life. No formula sets these amounts. The facts of each case shape them.

Medical bills have limits. For claims governed by Georgia’s 2025 tort-reform law, O.C.G.A. § 51-12-1.1 limits recoverable medical expenses to “the reasonable value of medically necessary care, treatment, or services.”

Punitive damages are different. Under O.C.G.A. § 51-12-5.1, they are awarded “solely to punish, penalize, or deter a defendant,” not as compensation. They are not automatic and must be specifically requested in the complaint. For most ordinary tort cases, the statute caps them at $250,000. That cap does not apply when the defendant acted with specific intent to harm, or while under the influence of alcohol or drugs to the point that judgment is substantially impaired.

No general dollar figure fits every case. The value depends on your injuries, evidence, and the facts of the crash.

Is $50,000 a Good Settlement for a Car Accident?

No single number answers this. A settlement that fits one injury may be too low or too high for another. Each case turns on its own facts.

The facts that usually matter include medical treatment and records, how long recovery takes, any lasting impairment, lost work, and how fault is divided. If you share some fault, the 50 percent rule and proportional reduction discussed above apply.

Medical bills count in a special way. For claims governed by that 2025 law, if you have health insurance, the evidence under O.C.G.A. § 51-12-1.1 includes both the amounts charged and the amounts actually needed to satisfy those charges under the insurance contract. That applies whether or not your insurance was used.

Do not accept or reject an offer before you understand your injuries and future care. Symptoms often change over time. Some injuries show their full effects weeks or months after a crash.

Protecting Your Claim in the First Days After the Crash

Get a medical check soon after the crash, even if the pain seems minor. Keep every visit note, referral, and prescription receipt. Gaps in treatment can make later proof harder.

Report the crash to your own insurer as your policy requires. Be careful with recorded statements and signed releases until you understand your injuries. A signed release can close a claim, so read it closely before you sign.

Preserve evidence. Take photos of the scene and vehicles, and write down the police report number. Collect witness names and phone numbers, repair estimates, and receipts for rentals, tows, and medication.

Keep a journal of symptoms and missed work. Note how the crash changes your job and daily life. These details support the damages discussed above.

How a Georgia Car Accident Claim Is Paid

Most compensation comes from liability insurance. Many claims settle before any lawsuit is filed. A lawsuit is usually a later step, used when a fair settlement cannot be reached.

If a case moves forward, costs add up. Court filing fees, records fees, and witness and report costs can all apply. T. Madden & Associates, P.C. handles personal injury cases on a no-fee-unless-we-win basis, but you may still be responsible for court costs and case expenses.

Can you sue for a car accident in Georgia if you were not seriously hurt?

Possibly. A claim requires proof of harm, and the size of your injury and losses affects what you can recover.

How long after a car accident can you sue in Georgia?

For most injury claims, the general limit is two years under Georgia law.

Can you sue if you were partly at fault?

Yes, but your recovery is reduced by your share of fault (O.C.G.A. § 51-12-33).
