Each claim’s value is built from its own medical records, lost income, available insurance, and how fault is divided under state law. This page explains those parts. It does not predict what any one claim will pay.

If you’re asking how much on average you can get for a personal injury from a car accident, you may also be dealing with pain, medical visits, and calls from insurers. You may be researching for someone you care about. Understanding what drives the amount can make the next decisions easier.

Why a single average number is hard to pin down

No reliable average exists, because every injury claim turns on its own facts. Two people hurt in similar crashes can end up with very different claims. One may need months of therapy and miss weeks of work. The other may recover in a few visits.

Georgia law also treats different kinds of money differently. Some damages are presumed from the injury itself. Others must be proved with records and bills. O.C.G.A. § 51-12-2 says general damages may be recovered without proof of any amount, while special damages “must be proved in order to be recovered.”

So a fair starting point is not an average. It is a close look at what the claim can document, what insurance is available, and who is at fault.

If a crash has left you or someone you love hurt and unsure what comes next, our team is glad to talk it through in a free, confidential consultation. These include medical bills, prescriptions, and lost wages. O.C.G.A. § 51-12-7 says necessary expenses from an injury are a legitimate part of the damages estimate. Keep every bill, receipt, and pay record.

General harms are harder to count. These include pain, emotional distress, and loss of enjoyment of life. When the injury is only to a person’s peace, happiness, or feelings, O.C.G.A. § 51-12-6 says “no measure of damages can be prescribed except the enlightened consciences of impartial jurors.” That means no formula sets the number.

Vehicle repair or replacement is usually handled as a separate item from bodily injury. Keep the repair estimate and photos in their own file so each part of the claim stays clear.

How medical treatment and lost income shape the claim

Medical and wage records carry most of the proof in a claim. Prompt evaluation after a crash creates a record that links your injuries to the collision. Gaps in treatment, missed visits, or vague notes give the other side an easy argument that the injury is smaller than it looks.

Under O.C.G.A. § 51-12-1.1, in any civil action to recover damages resulting from injury or death to a person, special damages for medical and healthcare expenses are limited to “the reasonable value of medically necessary care, treatment, or services.” If the plaintiff has any form of public or private health insurance, including benefits under a governmental workers’ compensation program, the evidence shall include both the amounts charged and the amounts actually necessary to satisfy those charges under the insurance contract or program, regardless of whether the health insurance has been used.

Some injured people cannot pay bills up front. Providers may treat them with payment deferred until the claim is resolved. A medical-ethics review of lien uses describes how these arrangements work. Under O.C.G.A. § 51-12-1.1, a letter of protection and itemized charges can be discoverable.

For lost pay, keep pay stubs, time-off records, and a letter from your employer. Show any reduced hours. For future care or lost future earnings, a jury may reduce those amounts to present value. Under O.C.G.A. § 51-12-13, the trier of fact may use a 5 percent rate or another rate it deems appropriate.

How the seriousness and lasting effects of injuries factor in

The more serious and longer-lasting an injury, the more medical support a claim usually needs. Severity and recovery length come from what providers document. That includes diagnoses, treatment plans, progress notes, and work restrictions.

Permanent impairment, scarring, or reduced function change the scope of a claim. A claim that covers future surgery or ongoing care needs medical support that describes those needs clearly.

Catastrophic injuries, such as traumatic brain injury or spinal cord injury, often mean larger future care needs and a more detailed evaluation. If your injuries may be long-term, our catastrophic injury lawyer page covers those issues in more depth.

Insurance limits, coverage, and who pays

A claim can only be paid as far as the coverage behind it allows. Under Georgia law, uninsured motorist coverage is generally included in auto liability policies, but the policyholder may reject it in writing. O.C.G.A. § 33-7-11 requires an endorsement or provisions that pay the insured for bodily injury caused by an uninsured vehicle, within the limits the insured chooses. O.C.G.A. § 33-7-11 reads: “(a)(1) No automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state to the owner of such vehicle or shall be issued or delivered by any insurer licensed in this state upon any motor vehicle then principally garaged or principally used in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured’s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs which at the option of the insured shall be.”

If the at-fault driver’s policy limits are lower than your losses, the gap matters. Your own uninsured or underinsured coverage may come into play, depending on the policy you have.

Questions about bills paid by Medicare or other health plans can come up in an injury claim, and they are worth discussing with a lawyer. The Centers for Medicare & Medicaid Services explains these repayment claims.

Georgia fault and deadline rules that can change what is recoverable

In Georgia, fault can cut off a claim or reduce it. Under O.C.G.A. § 51-12-33, the plaintiff “shall not be entitled to receive any damages if the plaintiff is 50 percent or more responsible.” If you are less than 50 percent at fault, the judge reduces your award by your share.

A separate rule applies when a person could have avoided the harm with ordinary care. Under O.C.G.A. § 51-11-7, that person is not entitled to recover in that situation.

When more than one driver is involved, the jury considers the fault of everyone who contributed, whether or not they were sued. Each liable person pays only its own share, and those shares are not joint liability. See O.C.G.A. § 51-12-33.

The clock matters too.
