Usually less than the headline number, because fees, case expenses, court costs, medical bills, repayment claims, and any fault reduction can all come out of it. Here’s how each step works in Georgia, so you can run the numbers on your own offer.

If you’re reading this after a crash, you may be reviewing an offer for yourself or for someone you love. An offer can feel urgent. Taking time to understand each deduction helps you decide with clear facts.

Why the $50,000 figure is not the amount you take home

A settlement figure is the gross amount paid to resolve a claim, before anything is paid out of it. It is the starting point for the math, not the amount that lands in your account.

Georgia law treats necessary expenses from an injury as a legitimate part of the damage estimate (O.C.G.A. § 51-12-7).

Damages come in two kinds. General damages, such as pain and suffering, can be recovered without proof of an exact amount. Special damages, such as medical bills, must be proved (O.C.G.A. § 51-12-2). Your losses need records behind them, so keep every bill, pay stub, and receipt.

Four deductions usually reduce the gross number. They are the attorney fee, case expenses and court costs, medical bills and repayment claims, and any reduction tied to fault. The sections below take each one in turn, starting with the fee.

If you are weighing an offer after a crash, or deciding for someone who was hurt, we are glad to walk through the numbers with you. T. Madden & Associates, P.C. works on a no-fee-unless-we-win basis, but the client may still be responsible for court costs and case expenses, even when there is no fee.

The fee is calculated under the written fee agreement, so that document controls the math. Before you sign anything, ask for it and confirm three points: the fee percentage, the amount the percentage is applied to, and whether case expenses are subtracted before or after the fee is figured.

The order matters. A fee applied before expenses leaves a different net amount than a fee applied after them. Ask for a worked example using your own offer, with every line labeled.

Check the example against your copy of the agreement. If a figure does not match, ask about it before you move forward.

Case expenses and court costs

Case expenses are the costs of investigating and proving a claim. They are separate from the attorney fee, and they can lower the amount you keep.

Common categories include:

Records fees for medical records and crash reports.

Accident reconstruction, when the crash scene needs to be rebuilt.

Medical record summaries prepared for negotiation.

Deposition costs, which cover recorded sworn testimony and the court reporter.

Filing fees and other court costs.

Court costs are charges tied to the court process itself. Ask which of them apply to your case.

Ask for an itemized statement of every expense before any money is divided. Compare each line to its receipt or invoice. Expenses can build up over the life of a case, so track the date and amount of each charge as it arrives. A clear list makes the net amount easier to check.

Medical bills, liens, and health insurance reimbursement

Medical bills and repayment claims often come out of the settlement, so the total owed must be confirmed before anything is divided.

Georgia law limits medical damages to the reasonable value of medically necessary care, treatment, or services (O.C.G.A. § 51-12-1.1).

Some providers treat patients under a letter of protection, which is a promise to be paid from a settlement or judgment.

Medicare works differently.

Other insurers and payers may also seek repayment. Gather every bill, lien notice, and payment record so the total can be checked.

How fault can lower the number

Georgia reduces damages by the injured person’s share of fault, and it bars recovery at 50 percent or more (O.C.G.A. § 51-12-33; Quynn v. Hulsey (2020)).

The judge reduces the damages in proportion to the plaintiff’s percentage of fault (O.C.G.A. § 51-12-33). A plaintiff who is 50 percent or more responsible may not receive any damages under the same statute.

Under Georgia law, the judge reduces the damages awarded to a plaintiff in proportion to the plaintiff’s percentage of fault, and a plaintiff who is 50 percent or more responsible for the injury or damages claimed is not entitled to receive any damages (O.C.G.A. § 51-12-33).

For illustration only: if a court found $50,000 in damages and a 20 percent share of fault, the award would drop by $10,000 to $40,000. Your case may not follow that pattern, because fault, injuries, and bills vary from case to case.

An insurer may dispute fault when it makes an offer. A lower offer can reflect that dispute, so ask what fault the insurer assigns and why.

Questions to ask before you accept an offer

Before you accept any offer, get written answers to five questions.

What is the fee percentage, and is it applied before or after case expenses?

What is each case expense, and can I see the receipt or invoice?

Which providers, insurers, or Medicare claim repayment, and how much?

Does the insurer dispute fault, and what share does it assign?

When would payment be made, and in what form?

Georgia’s insurance regulator advises claimants not to rush to accept an offer (Georgia insurance claim tips). Review the offer against the bills and the fee agreement side by side.

Timing matters too. Georgia generally requires a personal injury lawsuit to be filed within two years after the right of action accrues (O.C.G.A. § 9-3-33).
