Hazardous cargo can add parties, records and federal and Georgia rules to a claim. This page explains what those pieces mean for people hurt or killed, and how T. Madden & Associates, P.C. can review them with you.

What a Hazardous Materials Truck Crash Claim Involves

A hazmat truck crash claim is an injury or wrongful death claim that involves a truck carrying regulated cargo. The cargo doesn’t change the basic questions of fault and harm. It adds more people and paperwork to review.

Hazmat stands for hazardous materials. Common examples include fuel, industrial chemicals and compressed gases. More parties can be involved than in a standard wreck, including the driver, the company that operates the truck, the company that loaded the cargo and others.

The Georgia Department of Public Safety lists driver error, inadequate rest, defective brakes and defective steering among common contributing factors in commercial truck crashes.

Hazmat cases often take more sorting out than a standard wreck. Cargo papers, carrier files and training records may all need review before anyone can judge how the crash happened.

This page is for drivers, passengers, pedestrians and families of people hurt or killed when a hazmat truck is involved. Separately, 49 U.S.C. § 31139 directs the Secretary of Transportation to prescribe regulations setting minimum levels of financial responsibility for the transportation by motor vehicle, in interstate or intrastate commerce, of hazardous matter and oil. Those levels cover public liability, property damage and environmental restoration.

Why it matters: a review can ask whether the cargo was marked, packed and documented the way these rules require. Gaps in those records can be part of the story of a crash. Records that look complete don’t settle a case on their own.

What Our Team Reviews and What Costs May Arise

In a free case evaluation, our team looks at the cargo records, carrier files and crash facts tied to your claim.

Shipping records: bills of lading and shipping papers show what was loaded and where it was going.

Driver files: under 49 CFR § 391.51, a motor carrier must keep a driver qualification file for each driver it employs.

Trip communications: for shipments that need a safety permit, 49 CFR § 385.415 requires the carrier or driver to keep a record of communications for six months after the shipment is first accepted.

Scene evidence: photos, the truck’s position, cargo labels and names of witnesses.

Cleanup, fire response and evacuation can add to the losses a claim looks at. Georgia’s damages statute, O.C.G.A. § 51-12-4, treats damages as compensation for injury; generally, that compensation is measured where the injury can be estimated in money, but if an injury is small or the mitigating circumstances are strong, only nominal damages are given.

Medical bills have their own rule. Under O.C.G.A. § 51-12-1.1, medical expense damages are limited to the reasonable value of medically necessary care, treatment or services.

Early evidence matters. Scene details and records can be harder to find as time passes.

How the Process Works, Step by Step

The process starts with a free case evaluation. It then moves through records, investigation, damages and, when it’s the right path, negotiation or a lawsuit.

Free case evaluation. You describe the crash, the cargo if you know it, and your injuries. We explain possible next steps.

Records requests. We ask for cargo documents, carrier records and crash reports.

Investigation. We review whether the carrier and the cargo followed federal and Georgia hazmat and motor carrier rules.

Medical and damages documentation. We gather medical records and bills, and document lost income and other losses.

Negotiation or lawsuit. We talk with insurers, or file a lawsuit when that is the right path.

Timing depends on the injuries, the records and whether a lawsuit is needed. Georgia sets filing deadlines for these claims, so early review helps protect your options.

Our firm works on a no fee unless we win basis, but the client may still be responsible for court costs and case expenses.
