Much of that proof sits with the trucking company, not with the people who were hurt. This page explains the main records, what federal rules say about keeping them, and why timing matters. T. Madden & Associates, P.C. has practiced personal injury law since 1999, with offices in Jonesboro, Atlanta, Decatur, Macon and Augusta.

What Truck Crash Evidence Is and Who Controls It

Truck crash evidence is the records, data, parts and footage that show how a commercial truck was driven, kept and loaded. Most of it is held by the trucking company, its insurer or outside vendors, not by the injured person.

This matters to injured drivers, passengers and pedestrians. It also matters to families of someone killed in a Georgia truck crash. Memory of a sudden crash is often incomplete. Machine data and written logs can record details in order.

Some of this proof is easy to lose. Repairs, routine record cycles and equipment sales can remove it. Knowing what exists, and who holds it, is the first step. If you have a crash to discuss, our team offers a free, confidential first consultation with no obligation to continue.

Electronic Control Module (Black Box) Data

Many heavy trucks store crash-related information in an electronic control module, often called a black box. It can record details such as speed, braking, throttle position and some engine faults. What it stores depends on the make, model and equipment.

Stored data can be overwritten, cleared or lost. Repairs, rewiring or returning the truck to service can cause that. Once the data is gone, it may not come back.

When you ask about this data, focus on four items:

The module itself, and whether it still exists

The download of the data, and who made it

The data file, in its original form

A record of who accessed the module, and when

The practical step is a written preservation request. Send it to the trucking company early, before the truck is repaired, sold or sent to salvage.

Electronic Logging Device and Hours-of-Service Records

An electronic logging device (ELD) records a driver’s duty status, driving time and rest breaks. Subject to listed exceptions in which a motor carrier may require a driver to record duty status manually instead of using an ELD, a motor carrier operating commercial motor vehicles must install and require each of its drivers to use an ELD to record duty status no later than December 18, 2017 (federal log rules).

Hours-of-service limits set how long a driver may drive. Under hours-of-service limits, and except as otherwise provided in § 395.1, a driver of a property-carrying commercial motor vehicle may drive a total of 11 hours during the 14-hour period that begins after coming on duty following 10 consecutive hours off duty. Driving is not permitted after more than 8 hours of driving time without at least a consecutive 30-minute interruption in driving status, which may be off-duty, sleeper berth or on-duty not-driving time, with limited short-haul exceptions.

Logs can be checked against other records. Supporting documents include expense receipts and electronic mobile communication records (supporting document rules). Expense receipts, dispatch records and electronic mobile communication records are among the supporting documents a motor carrier must retain to verify on-duty not-driving time. A lawyer reviews any gaps or mismatches closely.

Maintenance, Inspection, and Driver Qualification Files

Trucking companies must keep maintenance records, inspection reports and driver files for set periods. Those periods matter, because records can be discarded once they end.

Maintenance records must show inspection, repair and maintenance dates and what was done. They must be kept for one year where the vehicle is housed or maintained, and for six months after it leaves the carrier’s control (maintenance records rule). A defect listed on an inspection report and never fixed can matter to how a crash happened.

The carrier must keep the driver qualification file while the driver is employed and for three years after, although certain records, such as the medical examiner’s certificate, may be removed from the file three years after their date of execution (driver file rule).

A motor carrier must maintain an accident register for 3 years after the date of each accident (accident register requirements).

Dashcam, In-Cab Camera, and Scene Evidence

Dashcam and in-cab camera footage can show the road, traffic and the driver before and during a crash. That footage is useful only if it is saved. Some systems record over older footage automatically, so a saved clip may be the only copy.

Scene evidence can disappear quickly too. Skid marks fade, debris gets cleared and vehicles get moved. Useful scene evidence includes:

Photos of vehicle positions, skid marks and debris

Traffic camera and business surveillance video

Names and contact details of witnesses

The police report and 911 call records

Cell phone and dispatch communications can help establish timing. Keep your own records too. Save photos of your injuries and vehicle, medical records, bills and repair estimates. Be careful about posting about the crash online, because the other side can read those posts.

Why Evidence Disappears and What Preservation Letters Do

Evidence often disappears through routine steps like automatic overwrites, repairs and equipment sales. Lawyers use the term spoliation for the loss or change of relevant evidence.

A preservation letter is written notice to the trucking company and its insurer. It lists the records, data, parts and footage that must be kept. A written request creates a clear record of what was asked for, and when.

Deadlines matter just as much. In Georgia, many personal injury claims must be filed within two years after the right of action accrues (O.C.G.A. § 9-3-33). Other rules and exceptions can apply.

When the NTSB investigates a crash, its report states a probable cause, but it does not determine fault or legal liability.

How a Truck Crash Evidence Case Typically Proceeds

A typical case moves from a first talk about the facts to written preservation demands, then records review and regular updates. Each step builds on the one before.

First consultation. We review the crash facts, your injuries and any evidence you already have. The consultation is free, confidential and comes with no obligation to continue.

Preservation demands. We send written requests to the trucking company, its insurer and relevant vendors. They cover the truck, module data, logs, files and footage.

Collection and tracking. Records arrive over time. We track what has been produced, what is missing and what needs follow-up.

Review. We go over the evidence with you. Some data needs technical review before its meaning is clear.

Ongoing updates. You receive updates on the claim and next steps, with the responsible lawyer named and reachable.

Our firm works on a no-fee-unless-we-win basis, though you may still be responsible for court costs and case expenses.

Why Work With T.
