Which parties apply depends on who controlled the truck, who owned it, who arranged the load, and what caused the crash.

If you’re reading this after a crash, you may be dealing with injuries, a damaged vehicle, or the loss of a family member. You don’t have to make any decision about a claim today. This guide explains each possible party in plain terms. T. Madden & Associates, P.C. has been in practice since 1999, and Terance Madden is the responsible lawyer for this page.

Who Can Be Sued After a Truck Accident in Georgia: The Short Answer

Several parties may be named, and each one needs its own facts. A claim can reach past the person behind the wheel when a company made decisions about the truck, the driver, or the load.

This section maps the parties covered below: the driver, the motor carrier, the truck’s owner or lessor, the freight broker, and third parties such as loaders, maintenance providers, and parts makers. Each one is tied to a fact that matters, such as who hired the driver, who signed the lease, or who packed the trailer.

Many readers are researching this while still recovering or while a crash report is still being pulled. That is a hard place to start. The goal here is to show the full set of possible defendants so no one is left off the list by accident. For a broader look at truck claims, read our truck accident lawyer guide.

If a truck crash has left you or someone you love hurt, you may have a claim, and you don't have to work out who is responsible on your own. A driver’s own choices behind the wheel are the most direct basis for a claim against that person.

Distraction is a frequent issue in these cases. Phone use is examined closely after a crash. The truck driver cell phone guide explains how that evidence is reviewed.

Naming the driver is only part of the picture. A driver may have limited personal resources compared with the size of a serious injury claim. That is one reason the employer, the lease, and the insurance structure often shape who gets named. The driver’s role also connects to every other party on this list. The facts of each crash decide which claims apply.

The Trucking Company (Motor Carrier): Vicarious and Direct Liability

A trucking company can be held responsible for its driver’s negligence on the job.

Georgia’s employer-liability statute, O.C.G.A. § 51-2-2, makes a person liable for torts committed by a servant “in the prosecution and within the scope of his business.” That is the main route to the company when the driver was its employee.

Companies can also face direct claims. These focus on the company’s own choices, such as how it hired, trained, supervised, or kept drivers. Federal rules help define those duties. Under 49 C.F.R. § 390.11, a duty placed on the driver is also the motor carrier’s duty to require observance. Carriers must keep a driver qualification file for each driver.

Those records can show what the company knew and when. Federal drug and alcohol testing rules also apply to commercial truck drivers, including post-accident testing.

The Truck Owner and Leasing Arrangements: Who Owns the Rig Matters

The company that owns a truck can be a separate defendant from the company that ran it on the road. Ownership and lease paperwork often answer the question of who controlled the truck at the time of the crash.

Federal law sets rules for trucks a carrier uses but does not own. Under 49 U.S.C. § 14102, the carrier may be required to have a written arrangement. If the Secretary requires it under 49 U.S.C. § 14102, the carrier must also have control of and be responsible for operating those vehicles in compliance with safety requirements prescribed by the Secretary and other applicable law, as if it owned them.

Leasing comes in several forms. Some trucks are on long-term leases with leasing companies. Some are rented for short periods. Owner-operators often drive under a lease-on agreement with a carrier. Each setup can change which company is named.

Lease terms, trip records, and dispatch information usually show who had control that day. Insurers may make early settlement offers before those records are reviewed. Read the early settlement guide before you respond to any offer.

Brokers, Loaders, Maintenance Providers and Other Third Parties

A freight broker can be named in some cases, based on how it chose the carrier. Whether a particular broker is liable still depends on the facts of each case.

Other parties can matter too. Improper cargo loading or securement can support claims against the company that loaded the trailer. Maintenance or repair companies may be named when work they handled contributed to the crash. A defective part can lead to claims against manufacturers or sellers in some cases. These claims rely on different proof than driver or carrier claims, such as inspection and repair records.

Identify every party early. Each claim has its own timeline. The sooner the parties are known, the sooner their records can be requested, and the easier it is to keep deadlines in view.

How Georgia Divides Fault Among Multiple Defendants

Georgia reduces damages by the injured person’s own share of fault. It bars recovery entirely at 50 percent or more. Under O.C.G.A. § 51-12-33, the judge reduces the award in proportion to the plaintiff’s percentage of fault. A plaintiff who is 50 percent or more responsible “shall not be entitled to receive any damages.”

When more than one party is liable, each party’s share is its own. The statute says apportioned damages are “not a joint liability among the persons liable.” They are also “not subject to any right of contribution.”

The trier of fact must consider the fault of everyone who contributed to the injury. That includes people who were never named as parties. A defending party can also give notice, not later than 120 days before trial, that a nonparty was at fault. Fault assigned to a nonparty is used only in setting the percentages of the named parties. So leaving a party out can change the math.

Fault is decided on the evidence in each crash. Insurers and defendants often argue about how responsibility should be split. Keep copies of the police report and witness names, since both often matter in that debate.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Time Limits: How Long After a Crash Can You Sue in Georgia

Georgia generally allows two years to file an injury lawsuit. Under O.C.G.A. § 9-3-33, actions for injuries to the person must be brought within two years after the right of action accrues. The same statute sets different periods for other claims. Injuries to reputation have one year, and loss-of-consortium claims have four years.

The statute begins with “except as otherwise provided in this article.” So two years is the starting point, not a promise that the rule fits every case. Check the timing for each possible party as early as you can.

A deadline that passes can close a claim. That is why identifying every possible defendant early matters. Insurance calls and early offers can arrive while the clock is still running. Electronic crash data from the truck is another time-sensitive source. The black box data guide explains why that data is worth asking about early.

Damages You May Pursue, and Questions to Bring to a Lawyer

Damages depend on the harm, the proof, and the parties involved.
