It can show how fast the truck was moving, how the driver braked, and when key events happened. The data works best when it is preserved early, before the truck is repaired and records are overwritten.

This page explains what truck black box data is, what it can record, and how it fits into a claim. It is general information for people trying to understand 18 wheeler black box data after crash Georgia cases.

Do 18-Wheelers Have a Black Box?

Yes, many heavy trucks carry an event data recorder, which people often call a black box. The recorder is often part of the engine control module (ECM), the truck’s main computer. It usually saves data when something sudden happens, such as hard braking or a collision.

The device keeps only a short window of information. That means it may not capture the whole trip. It is also only one source of truck data.

A modern truck also creates electronic logs, GPS records, maintenance files and dispatch messages. Federal rules cover electronic logging devices that record driving hours. Each source can show a different part of the story, and the pieces work best together.

If a truck crash has left you or someone you love hurt and unsure what comes next, you may have a claim, and our team is ready to listen. Time stamps show when each item happened. That helps line the data up with other evidence, such as the crash report or witness statements.

The details depend on the equipment installed and on the make and model of the truck. Two trucks may not save the same items. That is why the records should be checked against the specific truck involved.

Electronic logging devices follow a federal list. Under 49 C.F.R. § 395.26, the device automatically records the date, time, the truck’s location, engine hours, vehicle miles, driver and vehicle identification, and motor carrier identification data. When the truck is moving and no duty status change or other intermediate recording has been recorded for an hour, the device automatically makes an intermediate entry (49 C.F.R. § 395.26). That rule creates regular entries while the truck is on the road.

How Black Box Data Can Show the Cause of a Crash

Black box data can help test whether the driver’s account matches what the truck was doing. Speed data can show whether the truck was traveling faster than the posted limit or faster than conditions allowed. That matters when a crash happens on a busy stretch of highway or during bad weather.

Braking and throttle records can show the order of events in the seconds before impact. For example, a record showing the brakes were applied late could raise questions about when the driver saw a hazard. A record showing steady speed before a stop could answer other questions.

Analysts read these details together, not one at a time. The data is one piece of a larger picture. Investigators compare it with the scene, the roadway, photos and the other records in the file.

What the Data Can Show About the Force of the Crash

Some recorders capture how much the truck’s speed changed during a collision. Analysts can use that change to estimate how severe the impact was. Crash severity can matter when injuries, vehicle damage or the way the crash happened are disputed.

Injuries that look minor at the scene can still be serious. The mechanics of the crash can help explain why a person was hurt. That is one reason the force of an impact can matter in a claim.

Still, this is only one input. Medical records, photos and witness statements also help explain what a person went through. A single reading does not decide a claim. Its value depends on how it lines up with the rest of the evidence.

Why Timing Matters: Preserving the Data

Recorder data can be overwritten. A damaged truck can also be repaired or returned to service. That is why early steps matter.

A written request to preserve evidence is a common early step in a truck claim. It asks the trucking company to keep the truck, its module and its records. Federal rules also set minimum retention periods. A motor carrier must keep a back-up copy of its ELD records for 6 months on a separate device.

Under 49 C.F.R. § 379.3, companies must keep records for minimum periods. After those periods, the rule says company management may destroy them at its discretion. Minimum periods are not a promise that records will last.

Timing also matters after a serious crash. Under 49 C.F.R. § 382.303, the employer must test surviving drivers for alcohol and controlled substances as soon as practicable in certain cases. If an alcohol test is not given within two hours, the employer must keep a record stating why.

Other Truck Records That Can Sit Alongside Black Box Data

Electronic logging device records, driver logs, maintenance files, dash camera footage and dispatch messages can all sit alongside black box data. Each one can help show where the truck was, how long it had been driving and how it was kept up.

Federal rules require motor carriers to make accident records available to authorized representatives when asked. Under 49 C.F.R. § 390.15, a carrier must keep an accident register for 3 years after each accident. The register must contain at least the following: the date, the city or town and state where the accident occurred, the driver’s name, the number of injuries and fatalities, and whether hazardous materials, other than fuel spilled from the fuel tanks of motor vehicle involved in the accident, were released, along with copies of all accident reports required by State or other governmental entities or insurers (49 C.F.R. § 390.15).

Under 49 C.F.R. § 395.30, a motor carrier must not alter or erase the original hours-of-service information.

Phone use is a separate topic. It deserves its own review in a truck claim.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Can Black Box Data Be Used in a Georgia Truck Crash Claim?

Questions about who pulled the data, how it was stored and whether it is complete are often part of that review. A court can look at these questions, and so can the other side.

Georgia’s fault rule also matters. Under O.C.G.A. § 51-12-33, damages are reduced by the injured person’s percentage of fault. A person who is 50 percent or more responsible recovers nothing. Under O.C.G.A. § 51-12-33, the judge reduces the damages otherwise awarded to the plaintiff in proportion to the plaintiff’s percentage of fault, and the plaintiff is not entitled to receive any damages if the plaintiff is 50 percent or more responsible for the injury or damages claimed.

Timing matters too. Under O.C.G.A. § 9-3-33, a Georgia personal-injury lawsuit generally must be filed within two years after the right of action accrues. How a court treats this evidence depends on the facts and the procedure in each case.

Why an Early Settlement Offer Can Come Before the Data Is Reviewed

An insurer or trucking company can make an early settlement offer before black box data, logs and other records have been reviewed. Early offers often come while key facts are still unknown. That is the main reason to slow down.

A quick offer does not mean the case is fully understood. Before deciding, it helps to know which records exist and whether they have been preserved. Ask whether the truck and its data are being kept.

Keep every offer and communication in writing. Save letters, emails and text messages. If someone calls, write down the date, the caller’s name and what was said. Notes made close to the call are easier to recall later.

Talk With Our Team About the Truck Crash You Are Researching

If you’re reading this for an injured relative or friend, you may be juggling medical visits, insurance calls and contact from the truck company.
