Before you accept any settlement offer, talk with our team about what it covers. Before you respond, you need to know why the offer came so fast, what a signed release does, how long you have to file suit in Georgia, and how to read the amount.

This guide explains those points in plain language. It describes how these offers typically work in Georgia. T. Madden & Associates, P.C. handles truck accident claims, and the firm’s lawyers can review your offer with you.

Why a Trucking Company May Offer to Settle Early

A trucking company’s insurer often makes an early offer while the facts are still thin. In the first weeks, the police report and repair estimates may be the main records available. Your medical picture is usually still developing.

An offer is a proposal to close the claim. It comes from the other side’s insurer, not from a neutral party. Its purpose is to resolve the claim for the amount the insurer chooses. Think of it as the opening step of a negotiation, not the final word.

Calls and paperwork can arrive fast. An adjuster may ask for a recorded statement, a medical authorization or a quick decision. You don’t have to answer on the spot. You can ask for the offer in writing and take time to review it. Georgia’s insurance regulator advises injured claimants not to rush to accept an insurance offer, and says they may negotiate for a fair settlement (Georgia insurance commissioner’s claim tips).

For the wider picture of truck crash claims, see our truck accident guide for Georgia.

If a trucking company's insurer offered you money before your treatment ended, we can review that offer with you and the losses it may leave out. Once you sign and accept payment, the claim may be closed for good. Read the release before you sign anything.

A release is a written agreement, and its wording controls its reach. Some releases cover only property damage. Others reach bodily injury, future treatment and every party named in the document. Look for three things: who is released, which injuries are listed, and whether future losses are included.

Ask these questions before you sign. Does it cover medical bills that are still arriving? Does it cover future treatment or surgery? Does it cover lost income that hasn’t been counted yet? Does it release only the insurer’s insured, or also the driver and the trucking company?

Reopening a closed claim is usually hard. Treat your signature as final.

Injuries That Are Not Fully Known Yet

Many truck crash injuries are not fully known in the first weeks. Some symptoms appear days later. Soft-tissue, back, neck and head injuries can show symptoms or need further testing after the first visit. Follow-up appointments may still be scheduled when an early offer arrives.

An offer made before treatment ends puts a number on an incomplete picture. Under Georgia law, special damages for medical expenses are limited to the reasonable value of medically necessary care, and the trier of fact decides that amount (O.C.G.A. § 51-12-1.1). Records of what you still need matter for that reason.

Future losses also count. Georgia law allows a future economic loss to be reduced to present value, using a discount rate of 5 percent or another rate the trier of fact considers appropriate (O.C.G.A. § 51-12-13). That means the figure a jury sees can differ from the raw cost of future care.

Losses an Early Offer May Not Account For

Early offers often cover the losses that are easiest to count. They can leave out losses that build over time.

Lost income is one example. Missed shifts, reduced hours, and trouble doing the same job can continue long after an offer is made. Keep your pay stubs and a note of every day you miss.

Pain and quality of life are real losses too. Sleep loss, limits on lifting or driving, and emotional effects all count. Georgia law separates two kinds of damages. General damages are those the law presumes flow from a wrong, and they may be recovered without proof of an amount. Special damages must be proved (O.C.G.A. § 51-12-2).

Out-of-pocket costs add up. Mileage, household help and equipment all count. Georgia law says necessary expenses from an injury are a legitimate item in the estimate of damages (O.C.G.A. § 51-12-7). Start a running list of these costs from day one.

Who May Share Responsibility for the Crash

A truck crash can involve more than one responsible party. The driver, the motor carrier, a maintenance contractor or another motorist may each have its own insurer. An offer from one insurer may not resolve the claims against the others.

Georgia apportions damages by fault. Each liable person pays only the share assigned to that person, and the shares are not joint liability (O.C.G.A. § 51-12-33). So ask who the offer covers and who it releases.

Your own fault matters too. Your share of fault reduces the damages you can recover. Under the same statute, a plaintiff who is 50 percent or more responsible shall not be entitled to receive any damages (O.C.G.A. § 51-12-33 (Quynn v. Hulsey (2020))(g)).

Georgia also holds an employer liable for torts committed by its servant within the scope of the business (O.C.G.A. § 51-2-2). Federal rules add duties for motor carriers. Every motor carrier and intermodal equipment provider must systematically inspect, repair, and maintain, or cause to be systematically inspected, repaired, and maintained, all motor vehicles and intermodal equipment subject to its control (49 C.F.R. § 396.3). For how these records bear on responsibility, read our guide to truck maintenance and inspection records.

Evidence That May Still Be Gathered

Evidence collected after the first offer can change the value of a claim. Photos, witness names, dashcam footage and the truck’s data are often gathered in the weeks after a crash. An early offer may not reflect any of them.

Federal rules also point to records worth asking about. Commercial drivers face federal drug and alcohol testing rules, including post-accident testing (federal drug and alcohol testing rules). The results and related records can matter to who is at fault.

Keep your own records too. Save medical bills, pay stubs, and a daily log of symptoms and limits. Keep the police report and any photos you took. For a checklist, see what to save after a truck crash.

Reviewing this material before you answer the offer lets you compare it with the losses it is meant to cover.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

The Two-Year Deadline Under Georgia Law

Georgia generally requires a personal injury lawsuit to be filed within two years after the right of action accrues. That rule comes from O.C.G.A. § 9-3-33. Loss of consortium claims have four years under the same statute.

An insurance offer is not a lawsuit. Talks with an insurer can run for a long time, so keep the two-year date in view while you weigh the offer. The right deadline in your case depends on the facts.

Timing matters even while you decide whether to accept. A claim that is not filed in time may be lost.

Reading an Offer: Gross Amount, Fees and Liens

The gross amount is the headline number. The net amount is what you keep after fees, case costs, and any medical charges or liens paid from the settlement. Ask for a written breakdown of both.

Published averages don’t measure your offer. Settlement value follows the injuries, fault and losses in your case. No general figure tells you what one offer is worth.

Medical treatment billed under a letter of protection, where a provider waits for payment from a settlement, is also relevant. Georgia law makes the letter and itemized charges discoverable (O.C.G.A. § 51-12-1.1).

T.
