Trucking company insurance requirements set how much coverage that is, and the answer depends on the carrier’s operations and cargo. For a for-hire carrier hauling nonhazardous freight across state lines, the federal minimum is $750,000. This guide explains those numbers, how Georgia rules fit alongside them, and what limits mean after a crash.

What Trucking Company Insurance Requirements Are and Who They Protect

Trucking company insurance requirements are the rules that make a motor carrier keep liability insurance in force before it runs a truck. Liability insurance for a truck pays people hurt or property damaged in a crash involving that truck. It is not the injured person’s own auto policy.

Think of it as the coverage that answers for the truck’s conduct. It is not a fund the injured person pays into.

Federal rules say a carrier may not operate a truck until it has the required coverage in place. 49 C.F.R. § 387.7 sets that rule. The carrier must also keep proof of that coverage at its principal place of business.

The amount is not the same for every truck. It depends on the carrier’s operating authority, the truck’s weight, and the cargo it hauls. The people this coverage protects include:

Injured drivers and passengers

People in other vehicles

Pedestrians

Families in wrongful death claims

If a commercial truck hurt you or someone you love, you may have a claim, and our team can talk it through with you in a free, confidential consultation. See 49 U.S.C. § 31139.

Applicable federal safety regulations are reflected in the Georgia Department of Public Safety transportation rules.

A minimum is a floor, not a ceiling. For one category of carrier, a ‘motor private carrier’ as defined in 49 U.S.C. § 13102, 49 U.S.C. § 31139(c) permits the Secretary of Transportation to require the carrier to file evidence of financial responsibility in an amount not less than the greater of the minimum amount required by § 31139 or the amount required for that carrier to transport property under the laws of the State or States in which it operates. 49 U.S.C. § 31139 reads: “except that the amount of the financial responsibility must be sufficient to pay not more than the amount of the financial responsibility for each final judgment against the motor private carrier for bodily injury to, or death of, an individual resulting from negligent operation, maintenance, or use of the motor vehicle, or for loss or damage to property, or both.” Which figure applies depends on the facts, including routes, cargo, and truck weight.

What the Coverage Pays For and Where Limits Fall Short

A trucking company’s liability policy pays the damages the company or its driver owes to people hurt in the crash, up to the policy limit. Injury claims often include medical bills, lost wages, pain and suffering, and vehicle damage. Wrongful death claims seek damages for the family’s loss.

The limit is the most that policy pays for a single crash. If several people were hurt, they may share that same limit. Serious injuries such as spinal cord damage, traumatic brain injury, or amputation can create losses above a minimum limit. In those cases, the amount of coverage matters a great deal.

More than one party can be responsible. Under O.C.G.A. § 51-12-33, each liable person pays only its own percentage share, and that liability is not joint. Negligence or fault of a nonparty is considered if the plaintiff entered into a settlement agreement with the nonparty, or if a defending party gives notice not later than 120 days prior to the date of trial that the nonparty was wholly or partially at fault.

An employer can answer for its driver’s work-related wrongs under O.C.G.A. § 51-2-2, but under O.C.G.A. § 51-12-33 damages are apportioned by each person’s percentage of fault and shall not be a joint liability among the persons liable. O.C.G.A. § 51-2-2 makes a person liable for torts of a servant committed within the scope of the business.

How a Truck Crash Claim Moves: Steps and Timeline

A truck crash claim usually moves through evidence gathering, an insurance demand, negotiation, and, if needed, a lawsuit.

Get medical care and record the scene. Keep photos, witness names, and the truck’s company name and USDOT number.

The insurer investigates. The trucking company’s insurer opens a claim file. It may review driver logs, maintenance records, and dashcam video.

A demand follows treatment. A demand is usually sent once treatment shows how serious the injuries are.

Negotiation, then a lawsuit if needed. Talks may resolve the claim. If they don’t, a lawsuit may be filed.

Testing can happen fast after a crash. Under 49 C.F.R. § 382.303, following an occurrence involving a commercial motor vehicle operating on a public road in commerce, each employer shall test for alcohol each of its surviving drivers as soon as practicable, in the circumstances the regulation sets out. If an alcohol test isn’t given within two hours, the employer must record why. Attempts stop after eight hours, and drug tests stop after 32 hours. That is one reason early steps matter.

Georgia’s general deadline for a personal injury lawsuit is two years, under O.C.G.A. § 9-3-33. No fixed timeline can be promised. Timing depends on the injuries, the number of parties, and how fast records come in.

Calls From the Trucking Company’s Insurer and Early Settlement Offers

The insurer’s adjuster may call soon after a crash, and you can pause before you answer. The adjuster works for the insurance company. An early call is part of the insurer’s process, not a favor to you.

Early offers come before the full picture. Follow-up care, surgery, or time away from work may not be known yet.

Recorded statements can be used later. Think carefully before giving one. If you can, contact T. Madden & Associates, P.C. first to schedule a free consultation.

Avoid guessing. Don’t guess about speed or distance, and don’t say you feel fine when you don’t.

Don’t shrink your pain. Calling an injury minor can be used to reduce a claim later.

Keep records. Track medical visits, missed work, and out-of-pocket costs. That way, any offer can be measured against them.

Fault also matters. Under O.C.G.A. § 51-12-33, damages are reduced by the injured person’s percentage of fault.
