That figure applies to non-hazardous freight hauled across state lines. This page explains the federal and Georgia rules in plain words. It also explains why these numbers matter if you were hurt in a truck crash or are helping someone who was.

The Short Answer: Most Semi Trucks Must Carry $750,000 in Liability Coverage

Most for-hire semi trucks hauling non-hazardous freight in interstate commerce must carry at least $750,000 in public liability insurance. The federal table in 49 CFR § 387.9 sets that minimum for trucks rated at 10,001 pounds or more.

Federal regulations set minimum levels of financial responsibility for motor carriers, as referred to in 49 CFR § 387.7. Those levels are set out in a schedule of limits for public liability.

Public liability means money owed to other people. It covers injury and property damage the truck causes to others on the road.

Think of $750,000 as a floor, not a measure of any crash’s worth. It is the lowest amount the federal rules allow for this kind of haul. The limit is the insurance available to pay covered claims, and a claim’s value is decided by its own facts. Whether this minimum applies to a particular truck turns on the facts, including its cargo and whether it crosses state lines.

If a semi truck crash has left you with bills and insurance calls you didn't expect, you don't have to sort it out alone. The load and its shipping papers show what is being carried. Federal rules tie each amount to a specific commodity and type of carriage, so the load is the first thing to check. Hazardous materials are where the numbers climb fastest. A truck carrying certain bulk hazardous substances falls under the highest tier in the table.

Interstate vs. Intrastate Trucks: Which Rules Apply

Federal minimums govern trucks hauling freight across state lines. Georgia sets its own rules for certain trucks that stay inside the state.

Before a motor carrier of property or passengers domiciled in the United States or Canada begins interstate operations, it must register with FMCSA and receive a USDOT number. For-hire carriers must also get operating authority, unless they are exempt. 49 CFR § 385.301T sets out these steps.

Interstate carriers must keep proof of financial responsibility at their principal place of business. A member of the public can ask to review that proof. 49 CFR § 387.7 covers both points.

Georgia’s rules are separate. Under O.C.G.A. § 40-2-140(d)(2) in the Georgia motor carrier code, a for-hire intrastate carrier cannot be registered unless a certificate of insurance is filed with the commissioner. O.C.G.A. § 40-2-140 reads: “(2) No for-hire intrastate motor carrier shall be issued a registration unless there is filed with the commissioner a certificate of insurance for such applicant or holder, on forms prescribed by the commissioner, evidencing a policy of indemnity insurance by an insurance company licensed to do business in this state.” The commissioner decides the insurance amounts.

The route and the carrier’s registration records help show which set of rules applies. That is why the facts of the trip matter.

How Georgia’s Personal Auto Minimums Compare

A semi truck’s federal minimum sits on a separate track from the rules for passenger cars. Minimum means the lowest level the law allows. Carriers can carry more.

Ordinary passenger vehicles follow different insurance rules. If you were hurt in a car crash, the firm’s car accident lawyer service covers those claims.

Read the federal minimum as a starting line. This page focuses on commercial trucks. The policy, the carrier’s filings and the cargo all shape what coverage exists.

What the MCS-90 Endorsement Must Include

The MCS-90 is a federal endorsement, and the policy and the carrier’s filings decide how it applies after a crash.

An endorsement is a form attached to an insurance policy. Under 49 CFR § 387.15, the MCS-90 and the MCS-82 surety bond must follow the form FMCSA prescribes and that OMB has approved. The MCS-82 is a surety bond, a different way a carrier may show financial responsibility.

The endorsement must say coverage stays in effect continuously until it is ended. It must also be issued in the exact name of the motor carrier.

Under 49 CFR § 387.7, required policies stay in effect until terminated. Cancellation needs 35 days’ written notice from the insurer or the insured carrier, except that Mexican motor carriers insured under the border exception are exempt from the notice of cancellation requirements stated on Form MCS-90.

Why does this matter after a crash? The carrier’s exact legal name helps you match the paperwork to the company behind the truck. Keep the carrier’s name and any endorsement paperwork you receive.

Who Is Named on the Policy: Carrier, Trucking Company, Owner-Operator, and Lessor

Several companies can be tied to one truck, so the lease and insurance paperwork matter.

Trucks are often leased. 49 CFR § 376.12 sets out those lease terms.

Who controls the driver’s work also matters. Under O.C.G.A. § 51-2-5, an employer can be liable for a contractor’s negligence in listed situations. One is when the employer keeps the right to direct the time and manner of the work.

That is why the independent contractor question is common. Whether a trucking company answers for an independent driver depends on those listed situations.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why the Policy Limit Matters After a Serious Truck Crash

The policy limit sets how much liability insurance is available for a claim.

Serious truck crashes can involve medical care and time away from work that stretch over a long period. Those losses can be large, so the limit matters.

O.C.G.A. § 51-12-2 says general damages are those the law presumes to flow from a wrongful act. They can be recovered without proof of an amount.

Special damages actually flow from the act. They must be proved to be recovered.

That split is why records matter. Keep medical bills, pay records and treatment notes from the start. They help show what the crash actually cost.

A claim’s worth is decided by its own facts. A policy limit alone cannot tell you what a claim is worth. Factors generally examined include the injury, the medical care and the proof of losses.

Talk With Our Team About Your Truck Crash

You can talk with our team about a truck crash, and the first consultation is free, confidential and carries no obligation to continue.

You might be the person who was hurt.
