One covers how the insurer must handle your claim. The other is the deadline to file a lawsuit, and missing it can end your case. This guide explains both so you can plan while you wait.

Georgia has no single settlement deadline

How long a claim takes depends on the crash, the coverage involved, and whether fault is disputed. Your claim may move quickly or slowly for reasons that have nothing to do with the law’s timing rules.

Think of it as two clocks. The first clock belongs to the insurer. The second clock belongs to you. It is the court deadline to file suit, and it runs whether or not the adjuster is still reviewing your file.

The filing deadline: how long you have to sue

Georgia law generally gives you two years after an injury to bring an injury lawsuit (O.C.G.A. § 9-3-33; Kenneth B. Under O.C.G.A. § 9-3-99, the deadline for a tort claim by a crime victim is paused from the date of the commission of the alleged crime or the act giving rise to the claim until the prosecution of such crime or act has become final or otherwise terminated. That pause cannot exceed six years. Under O.C.G.A. § 9-3-90(b), a person who was under 18 when the claim arose gets the same time to sue after turning 18 as other people get.

Phone calls and an open claim file do not file a lawsuit. A missed filing date can cost you the court claim, even if talks with the insurer are still going on.

What Georgia’s claims-handling rules require from insurers

It is a set of handling standards.

If you believe an insurer is handling your claim unfairly, you can file a complaint. The Georgia Office of the Commissioner of Insurance and Safety Fire takes consumer complaints. The Office can review claim handling and policy compliance.

The Office’s insurance claim tips also advise claimants not to rush into accepting an insurer’s offer. You can negotiate for a fair settlement. Ask the insurer in writing what it still needs, and keep copies of everything you send.

Why investigations take time after a truck or car crash

Investigations take longer when a crash involves more people, more records, or injuries that are still being treated. Adjusters usually start with the police report. Then they request medical records and decide who was at fault. Each step can add weeks.

Fault also affects what a claim is worth. Under O.C.G.A. § 51-12-33, damages are reduced in proportion to the injured person’s share of fault. If that person is 50 percent or more responsible, they cannot recover damages. Disputes over fault can stretch out a claim for this reason.

Truck crashes add layers. Federal rules set minimum public liability levels for certain motor carriers. For example, a for-hire carrier in interstate commerce with a gross vehicle weight rating of 10,001 or more pounds hauling nonhazardous property must meet a $750,000 minimum, per 49 C.F.R. § 387.9. More coverage and more parties can mean more reviews. Georgia law also limits when a motor carrier’s insurer can be joined in a lawsuit, under O.C.G.A. § 40-2-140.

If Medicare paid for your treatment, it may have a recovery claim. The Centers for Medicare & Medicaid Services describes these conditional payments and repayment demands after a settlement.

What can be done when an insurer stalls

When talks stop moving, the step that protects your claim is filing a lawsuit before the deadline. Waiting for a better offer can use up time you need. Plan your filing date early, and do not let it slip while the file sits.

Start a written record now. Save every letter, email, and claim number. Write down the date, time, and name for each phone call. Track each request for information and when you answered it. This record shows the timeline if a dispute arises.

If the at-fault driver has no insurance, your own policy may apply.

If you are handling a claim after a death, the right to sue depends on who is entitled. Under O.C.G.A. § 51-4-2, the surviving spouse or, if there is no surviving spouse, a child or children, either minor or sui juris, may recover for the homicide of the spouse or parent the full value of the life of the decedent, as shown by the evidence. If there is no surviving spouse, a child or children may recover.

Common questions: quick settlements and the longest claims
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Do insurance companies want to settle quickly?

Not always. Insurers handle claims on their own timelines.
