In Georgia, future medical expenses are generally treated as special damages, which are the dollar losses a claim has to prove. Under O.C.G.A. § 51-12-2, special damages “actually flow from a tortious act” and “must be proved in order to be recovered.”

That makes future care costs a question of evidence, not just a question of what happened in the crash. The other main category is general damages, such as pain, worry, and loss of enjoyment of life. The same statute says general damages “may be recovered without proof of any amount.”

Future care bills don’t get that presumption. Someone has to show what the care will be and what it will cost. If a doctor has said your loved one will need therapy, surgery, or equipment later, that advice carries a price tag. The claim has to connect that price to the crash.

The answer depends on the facts of each claim, including the injury, the medical records, and the care doctors recommend.

If a doctor has told your loved one that future care is needed, you don't have to sort out those costs alone, and our team is glad to talk it through. Medical bills, lost paychecks, and repair costs are common examples. Georgia’s damages law separates them from general damages, and that split shapes how a claim is built.

Under O.C.G.A. § 51-12-7, necessary expenses caused by an injury are a legitimate item in the estimate of damages. Future medical care fits that idea when doctors say the care is needed because of the injury.

Georgia’s present-value statute also names “future medical expenses” alongside “lost wages, or other economic damages.” That language, found in O.C.G.A. § 51-12-13, shows the law treats future medical costs as economic losses.

Think of it this way. A jury can total up a future therapy schedule or the price of a wheelchair and assign it a number. General damages work differently. For injuries that are entirely to a person’s peace, happiness, or feelings, O.C.G.A. § 51-12-6 leaves the measure to “the enlightened consciences of impartial jurors.”

What Must Be Proven to Recover Future Medical Costs

Each point needs support from records, not guesses.

Need comes first. A note that says “may need surgery someday” carries far less weight than a written treatment plan.

Cost comes next. Georgia limits these damages to “the reasonable value of medically necessary care, treatment, or services,” under O.C.G.A. § 51-12-1.1. Evidence can include provider estimates, prescription prices, and equipment quotes.

Duration matters too. How many years of therapy, medication, or monitoring do the records support? A plan for a few months does not match a plan for lifelong care.

Speculation fails. Future costs need a reasonable basis in the medical evidence. Estimates with no support from a doctor or the records are easy for the other side to challenge.

How Future Medical Costs Are Estimated

Future medical costs are usually estimated by listing each expected item, how often it will happen, and what it costs today. Many claims use a life care plan to organize this work.

A life care plan is a structured projection prepared with medical input. It lists anticipated care, such as physician follow-ups, physical or occupational therapy, prescriptions, assistive devices, home modifications, and future surgeries. Each line gets a frequency and a current cost.

The total can then be reduced to present value. O.C.G.A. § 51-12-13 says the trier of fact may reduce future medical expenses to present value “based on a discount rate of 5 percent or any other discount rate as the trier of fact may deem appropriate.” In plain words, a future dollar is worth less than a dollar today.

Price changes over time also matter. Medical costs can rise, and a projection that ignores that may understate what care will cost. A careful plan explains how those trends were handled.

Why Future Costs Must Be Addressed Before a Settlement Is Final

A settlement usually ends the claim. That makes the timing of a settlement a serious decision.

Serious injuries can require lifetime care or monitoring. Records should show the current treatment plan, the expected future care, and the doctors’ notes that tie those needs to the crash. Gaps in that paperwork are hard to fix after the fact.

Government payers can add another layer.

Some bills are also deferred. According to Legality and Ethics of Lien Uses in Medicine, an uninsured crash victim may receive treatment under a provider lien, with payment deferred until the claim is settled or resolved. Those deferred bills can come due at settlement.

T. Madden & Associates, P.C. has been in practice since 1999. Terance Madden is the responsible lawyer for this page.

How Insurance Companies Challenge Future Medical Expense Claims

Insurers often dispute whether future care is needed, how often it will be needed, or whether the price is reasonable. They look for weak points in the paper trail.

Common challenges include pre-existing conditions, gaps in treatment, and future care that no doctor has written down. A long gap between visits can give an adjuster a reason to argue the injury has healed. Where the plaintiff has public or private health insurance, evidence of the reasonable value of medically necessary care must include both the amounts charged and the amounts actually necessary to satisfy those charges under the insurance contract or governmental workers’ compensation program, a point covered in O.C.G.A. § 51-12-1.1.

Fault can also shrink a recovery. Under O.C.G.A. § 51-12-33, Georgia reduces damages by the plaintiff’s percentage of fault. A plaintiff 50 percent or more responsible recovers nothing.

An early, complete medical record and a documented plan of care matter when these points come up.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Are Compensatory Damages Taxable Income?

Tax questions turn on the type of payment and on federal tax rules.
