There is no single answer. A $50,000 offer is good only if it covers what the crash has cost you and will cost you. This guide shows you how to test that offer under Georgia law.

The short answer: $50,000 is only as good as what it has to cover

No single number tells you whether $50,000 is a good settlement. Every car accident claim has its own medical treatment, lost pay and fault facts. The useful test is whether the offer covers the full cost of your injury, including bills still coming in, as long as those charges are for medically necessary care at a reasonable value under O.C.G.A. § 51-12-1.1(b). It should also account for time you’ve lost from work.

A number that looks large can shrink fast. A $50,000 offer is not the same as a $50,000 check.

For the wider rules that apply to Georgia vehicle claims, read our truck and vehicle claims guide.

If an offer letter has you stuck between signing and waiting, you don't have to sort out the numbers alone. General damages are losses the law presumes flow from a wrongful act. You can recover them without proof of an amount. Special damages are actual losses, like bills and missed paychecks. You must prove those. See O.C.G.A. § 51-12-2.

Most claims include these losses:

Medical bills, past and future. Recoverable medical expenses are limited to the reasonable value of medically necessary care, treatment, or services, such as imaging, physical therapy and medication, under O.C.G.A. § 51-12-1.1(b). Section 51-12-1.1(c) also addresses amounts actually necessary to satisfy charges under insurance. See O.C.G.A. § 51-12-1.1.

Lost wages and lost earning ability. This applies if the injury keeps you from working the same hours or the same job.

Pain, suffering and loss of enjoyment of life. These are not on any bill. Offers often fall short here.

Vehicle repair or replacement and rental costs. These are often a separate property damage claim. Confirm whether the $50,000 includes them.

Out-of-pocket costs. Mileage to appointments and paid help at home count. Keep the receipts.

How injury severity, fault and insurance limits shape the number

Fault and insurance limits can cut or cap what you receive, even when your injuries are serious. Serious injuries, longer recovery and ongoing treatment generally support a higher claim value. A short recovery usually supports a smaller number.

Georgia uses modified comparative fault, which means shared fault. Under O.C.G.A. § 51-12-33, you cannot recover damages if you are 50 percent or more responsible. Under O.C.G.A. § 51-12-33, the judge reduces the amount of damages otherwise awarded to the plaintiff in proportion to his or her percentage of fault, and the plaintiff is not entitled to receive any damages if the plaintiff is 50 percent or more responsible for the injury or damages claimed. Each liable person pays only its own share. Those damages are not joint liability and are not subject to contribution.

An at-fault driver’s policy limit can cap what the insurer pays. A $50,000 offer may match that limit. Ask whether the at-fault driver has other coverage. Your own policy may also matter. See O.C.G.A. § 33-7-11. Review your own policy’s terms.

If a large commercial vehicle is involved, read about how much insurance a semi truck must carry in Georgia.

What you keep after fees, case costs and medical liens

Your net amount is the settlement minus fees, case expenses and liens. The $50,000 figure is rarely what lands in your account. T. Madden & Associates, P.C. handles personal injury claims on a no-fee-unless-we-win basis, but the client may still be responsible for court costs and case expenses.

Case expenses come out too. Ask for a written breakdown before you agree to anything.

Medical providers may hold a letter of protection. That is a promise to be paid from the settlement. Georgia law makes those arrangements discoverable. That includes itemized charges, the referral source and any sale of the receivables below invoice price. See O.C.G.A. § 51-12-1.1.

Each step can move the final number a lot.

Should you accept the first settlement offer?

Usually it is wise to wait until the medical picture is clear. Early offers often come before treatment ends or before future care is known. Signing a release generally ends the claim, so that choice carries weight.

Under O.C.G.A. § 9-3-33, most personal injury claims in Georgia must be filed within two years, but a claim for loss of consortium has four years and a claim for injury to reputation has one year. See O.C.G.A. § 9-3-33.
