For most injuries to the person, Georgia requires that suit be brought within two years after the right of action accrues (O.C.G.A. § 9-3-33). This guide explains what starts that clock, what a late filing can mean, why an insurance claim doesn’t stop it, and which exceptions can change the date. For the broader picture, read our Georgia car accident lawyer guide. T. Madden & Associates, P.C. has practiced in Georgia since 1999.

Georgia’s Statute of Limitations for Car Accident Claims

Georgia generally requires an injury lawsuit to be brought within two years after the right of action accrues. That rule appears in O.C.G.A. § 9-3-33. Lawyers call this a statute of limitations, which is simply a filing deadline.

The rule covers injuries to the person, including injuries from a car, truck, or motorcycle crash.

Many people assume the clock starts when treatment ends. That assumption can cost valuable time, so count from the crash itself.

If the two-year date is close, or may already have passed, our team can review your timeline with you in a free, confidential consultation. Cameron v. Jmp Pizza, Inc (2026)). It isn’t a window for settling with an insurer, and it isn’t a safe target to aim for at the end.

Count from the accident date, using a calendar rather than memory. A date recalled months later, or a rough guess, can be off by weeks. Write the date down and check it against the crash report.

Two other rules are worth knowing. A spouse’s loss of consortium claim, meaning a claim for lost companionship and marital benefits, has four years under the same statute, O.C.G.A. § 9-3-33.

When a crash kills someone, Georgia law lets an administrator or executor bring the action for the next of kin if no one else is entitled to bring it, under O.C.G.A. § 51-4-5. Families should ask about the timing early, since the person filing may not be the person who was hurt.

What Happens If the Deadline Passes Before a Lawsuit Is Filed?

If the deadline passes before a lawsuit is filed, the court can dismiss the case, and the claim may end there. A late filing is generally open to dismissal on a statute of limitations defense, whoever caused the crash.

The at-fault driver and their insurer can raise the expired deadline as a defense. A judge then decides whether the lawsuit was filed in time. Clear fault, serious injuries, and large medical bills don’t usually reopen a claim once the period has run.

Waiting on an insurer’s decision is how time can slip away without anyone noticing. A claim can stay open for months while the court deadline keeps running.

Dismissals have their own rules. Georgia’s dismissal statute, O.C.G.A. § 9-11-41, governs how a case can end and be filed again. A case that was filed and then dismissed needs its own timing review. Don’t assume it can simply be refiled.

Is Filing a Claim the Same as Filing a Lawsuit?

No. An insurance claim asks the insurer to pay, and it doesn’t file a case in court.

The statute sets the deadline from the day the right of action accrues, and its text names no pause for insurance talks. A claim can stay open for months while the court deadline keeps running.

The Georgia Office of the Commissioner of Insurance and Safety Fire lists practical auto claim steps. Those steps protect the claim, but they don’t file a lawsuit. Keep a separate calendar entry for the court deadline.

Personal Injury vs. Property Damage Lawsuits After an Auto Accident in Georgia

Injury and property claims are separate. One crash can produce both, and each can carry its own date. Protect the injury date first, because Georgia’s two-year period for injuries to the person runs from when the right of action accrues (O.C.G.A. § 9-3-33).

It’s an easy mix-up when a crash causes both kinds of harm. Don’t assume the longer period covers your injuries. Injury claims can also include future medical costs, which matter when treatment continues for months. Our guide to future medical costs explains how those costs fit into a claim.

Exceptions That Can Extend Your Deadline

Georgia law can give more time to some minors and to some people who are legally incompetent. Under O.C.G.A. § 9-3-90, a minor who is under 18 when the claim arises gets the usual time after turning 18.

These rules are narrow. They turn on the injured person’s status when the claim arose. They don’t create a general pause for injured adults.

Whether any exception applies depends on the facts. Don’t assume one. Have the dates reviewed against the file.

If the at-fault driver cannot pay, the timing question and the payment question are separate. Our guide on at-fault drivers without assets covers that situation.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

The Shorter Notice Rules When a Government Vehicle Is Involved

Under O.C.G.A. § 36-33-5, a claim against a municipal corporation must be presented in writing to the governing authority of that municipal corporation within six months of the event on which the claim is based. Each level of government has its own rule.

For a city, the claim must be presented in writing to the governing authority within six months of the event, under O.C.G.A. § 36-33-5. The statute also suspends the limitations period while a demand for payment is pending without action by the authorities.

For a county, claims must be presented within 12 months after they accrue or become payable, or they are barred, under O.C.G.A. § 36-11-1. Minors and persons under disabilities get 12 months after the disability is removed.

For the State of Georgia, written notice must be given within 12 months of the date the loss was discovered or should have been discovered, under O.C.G.A. § 50-21-26. No lawsuit can start until the claim is denied or more than 90 days pass without action by the Department of Administrative Services.

These notice periods can close well before the two-year date. A crash involving a government vehicle needs its own deadline check from the start.

Reporting the Crash Is a Separate Duty From Filing Suit

Reporting a crash and filing a lawsuit are different steps with different purposes. Reporting builds the record. Filing starts the court case.

A crash report and prompt notice to your insurer help show what happened while details are fresh. Photos, witness names, and notes about the scene can matter later if fault is disputed. These steps belong to the auto claim process described in the state tips above.

Think of it this way: reporting is about the record, and the deadline is about the court. Keep the two timelines on separate calendar entries so one isn’t mistaken for the other.

Talk With Our Team About Your Timeline Before the Date Passes

If you’re reading this near the two-year date, or after it, you still have questions worth answering.
