Some parts can be, and some parts generally are not. How a settlement or award is treated for tax purposes can depend on the facts behind each payment. This page breaks a crash settlement into its main parts so you can see where the lines fall. It is general information, not tax or legal advice. T. Madden & Associates, P.C. has practiced in Georgia since 1999 and represents people hurt in car and truck wrecks, motorcycle and e-bike crashes, and other injury cases.

Are Injury Settlements Taxable Income?

Injury settlements are not automatically taxable, and they are not automatically tax-free either. That makes the key question what each dollar pays for, not what the case is called.

Georgia’s damages law helps sort those payments. It separates general damages, which the law presumes flow from a wrong, from special damages, which must be proved (O.C.G.A. § 51-12-2). Each category leads to different proof and different paperwork. For the broader picture of Georgia claims, read our Georgia car accident lawyer guide.

If you're weighing a settlement offer after a crash and can't tell which part might be taxed, our team can talk it through. A payment for a broken wrist and a payment for a sprained back are judged by their purpose.

Georgia law treats necessary expenses from an injury as a legitimate part of damages (O.C.G.A. § 51-12-7). Medical damages are limited to the reasonable value of medically necessary care, and the jury decides that amount (O.C.G.A. § 51-12-1.1).

Future treatment works differently. The jury may reduce future medical costs, living expenses and lost wages to present value, using a 5 percent discount rate or another rate it finds appropriate (O.C.G.A. § 51-12-13). That reduction can change how much future care is worth in a settlement. Ask how future costs were figured before you accept any number.

Emotional Distress Without a Physical Injury Is Treated Differently

When the whole injury is to a person’s feelings, Georgia law leaves the value to the jury. The statute says no measure of damages can be set for that kind of claim except the consciences of impartial jurors (O.C.G.A. § 51-12-6). Punitive damages are also barred in that kind of action.

The tax answer for this money is not settled by that rule alone. The IRS looks at the facts of each payment (IRS guidance on settlements). Distress that comes with a physical injury is a different fact pattern than distress that stands alone.

The wording of the claim matters. Demand letters, complaints and settlement agreements that describe the harm show whether distress came from a physical injury. Keep copies of every document that describes what you went through. Treatment notes from doctors and counselors can show the link to the crash.

Lost Wages and Taxes: Depends on the Facts of the Claim

Lost pay is an actual loss, and in Georgia it must be proved. The code says special damages are those that actually flow from a wrong, and they must be proved to be recovered (O.C.G.A. § 51-12-2).

Whether a wage payment is taxable depends on the facts of the claim. Lost wages tied to a physical injury are read differently than wages tied to other causes. The paperwork decides which side a payment falls on.

Build a clear record. Pay stubs, time sheets, and employer letters that show the dates you missed and why all help. If you may lose future earnings, the trier of fact may reduce those economic damages to present value (O.C.G.A. § 51-12-13).

Punitive Damages, Interest and Taxes

Punitive damages and interest work differently from compensation. Georgia’s punitive damages statute says these awards are not compensation to the plaintiff. They exist to punish, penalize or deter a defendant (O.C.G.A. § 51-12-5.1).

The statute also requires that punitive damages be specifically prayed for in a complaint. For most tort cases outside its exceptions, the amount is capped at $250,000 (O.C.G.A. § 51-12-5.1).

Interest on a settlement or judgment is a separate item too. Some settlement agreements list these amounts apart from the injury payment. That separation helps when the return is prepared. Read each line of the agreement, and ask a tax professional how the amounts should be reported before you file.

Property Damage Payments and Your Vehicle’s Tax Basis

A payment for your damaged vehicle is a separate item from money for your injuries. Property damage pays to repair or replace what was harmed. It does not pay for pain or medical care.

Keep repair estimates, invoices, total-loss valuation letters, and proof of what you paid for the car. These records show what the payment covered and what the vehicle was worth. They also help you keep property money separate from injury money in your files.

Tax treatment of vehicle payments depends on the vehicle’s history and cost. Bring those records to a tax professional. A clean paper trail makes that review faster and keeps each payment tied to its purpose.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Wrongful Death Settlements and Georgia State Income Tax

In a wrongful death case, Georgia’s wrongful death statutes set who may recover and what they may recover. A surviving spouse may recover the full value of the decedent’s life, as shown by the evidence, but the amount recovered is divided among the spouse and the children, and the surviving spouse receives no less than one-third of the recovery. If there is no surviving spouse, a child or children may recover that amount (O.C.G.A. § 51-4-2).

When death results from criminal or other negligence, the personal representative may recover funeral, medical and other necessary expenses from the injury and death (O.C.G.A. § 51-4-5).

If you’re handling this for a family member, the person who receives the settlement holds the paperwork. Georgia state income tax is a separate question from federal treatment. A tax professional should confirm how a state return treats the payment.

Keeping Records That Show What Each Payment Covers

Your settlement paperwork should show what each payment is for. The settlement agreement and release describe the claim and the money. Read the wording before you sign. Pair it with the records behind each part, such as medical bills, pay stubs, insurer letters and repair invoices.

Medicare can be part of the picture. Medicare questions can come up after an accident, and our team can discuss them with you during a free first consultation.

If a provider treated you under a letter of protection, that arrangement is relevant evidence. The law makes the letter and itemized charges relevant and discoverable (O.C.G.A. § 51-12-1.1).

Early steps matter too. Georgia’s insurance regulator advises promptly notifying police and your insurer, collecting accident and witness information, documenting the scene, and avoiding statements about fault (Georgia auto claim tips).

Talking Through Your Own Settlement Offer

If you hold a settlement offer, start by asking which parts of it pay for what. Maybe a crash left you hurt and an insurer’s number arrived on a letter. Maybe a family member is handling a claim for someone who cannot. Either way, the tax question often arrives while bills and time off are already pressing.

Bring the offer, the release and the records described above. Ask how each part is described, whether any Medicare repayment applies, and whether a tax professional should review the return before you sign.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Are car accident settlements taxable income in Georgia?

Some parts may be taxable, and some generally are not.
