What a Bicycle-Car Injury Claim Can Include<\/h2>\n

A claim can seek money for the losses the crash caused, including medical costs, lost income, and pain and suffering. Georgia treats some losses as general damages, which the law presumes flow from the wrongful act. Other losses are special damages, which must be proved (O.C.G.A. \u00a7 51-12-2<\/a>).<\/p>\n

Medical expenses are limited to the reasonable value of medically necessary care (O.C.G.A. \u00a7 51-12-1.1<\/a>). Necessary expenses that come from the injury are a legitimate part of the damages estimate (O.C.G.A. \u00a7 51-12-7<\/a>). Future economic losses, such as future medical expenses, living expenses and lost wages, can be reduced to present value, using a 5 percent rate or another rate the fact-finder considers appropriate (O.C.G.A. \u00a7 51-12-13<\/a>).<\/p>\n

Damaged property, such as a bike, e-bike, helmet or gear, can be part of the claim. Serious brain, spine or limb injuries can need long-term care, and those future costs need careful review.<\/p>\n

If a cyclist dies, a surviving spouse may recover the full value of the decedent’s life, as shown by the evidence. If there is no surviving spouse, the children may recover that value (O.C.G.A. \u00a7 51-4-2<\/a>). When a death results from negligence, the personal representative can recover funeral, medical and other necessary expenses (O.C.G.A. \u00a7 51-4-5<\/a>).<\/p>\n

Georgia Rules That Shape a Bicycle Crash Claim<\/h2>\n

Georgia reduces your damages by your share of fault, and it bars recovery entirely at 50 percent or more. This is a modified comparative fault<\/a> (shared-fault) rule. The judge reduces damages in proportion to the plaintiff’s percentage of fault (O.C.G.A. \u00a7 51-12-33<\/a>).<\/p>\n

Under O.C.G.A. \u00a7 51-12-33(g)<\/a>, a plaintiff who is 50 percent or more responsible for the injury or damages claimed is not entitled to receive any damages. When more than one person is liable, each person pays only the share assigned to them, not a joint amount. The jury also considers the fault of everyone who contributed, even people who were not sued.<\/p>\n

Georgia generally gives two years<\/a> after the right of action accrues to bring an injury lawsuit (O.C.G.A. \u00a7 9-3-33<\/a>). Some claims follow other deadlines, so early review matters. How fault is split depends on the facts of each crash.<\/p>\n
