In short, a late or missing report can cause administrative problems, complicate an insurance claim, and weaken your proof. The effects depend on the facts of the crash. Many articles online quote 10-day rules from other states, such as California. This page covers Georgia law only.

Why the 10-day question comes up after a crash

Most people search this question after a crash has already happened. They aren’t sure what they still owe.

You may be sore, dealing with a damaged car, or worried about a family member who was hurt. You may also have read 10-day rules online and wondered whether they apply to you.

Those articles often describe other states. California, for example, has its own DMV reporting rule that many pages cite. Georgia has its own duties and deadlines, and mixing the two up causes confusion.

This page answers three questions. What does Georgia law require after a crash? What can a late or missing report affect? What should you do now?

If a crash has already happened and you're unsure what the reporting steps mean for you, our team can talk it through in a free, confidential first consultation. The GDOT Accident Reporting System covers crash data on Georgia public roads. It also explains how to get police crash reports, which injury claims often need.

Which duties and which report apply depends on the facts of the crash.

What can happen if the report is late or never filed

A late or missing report can create problems with the state crash process. Whether a report is required depends on the crash facts; when the owner or operator is unknown, reporting rules may apply to the insured.

The bigger risk is often proof. An unreported crash may leave no police record. The other driver’s details may be harder to track down later.

Fault is another issue. Georgia’s fault rules can reduce or bar a claim. Under O.C.G.A. § 51-12-33, a plaintiff’s damages are reduced in proportion to the plaintiff’s percentage of fault. A plaintiff who is 50 percent or more responsible is not entitled to receive any damages.

Under O.C.G.A. § 51-11-7, if the plaintiff by ordinary care could have avoided the consequences of the defendant’s negligence, the plaintiff is not entitled to recover. In other cases, the defendant is not relieved even if the plaintiff contributed to the injury.

When a crash is never recorded, these disputes get harder to settle. Clear early facts make your side of the story easier to support.

How a delayed report can affect an insurance claim

A delayed report can lead an insurer to question when and how the crash happened. Timing matters in that review.

Your policy likely sets a notice requirement for losses. Check its wording, and tell your insurer about the crash promptly.

Georgia law also addresses uninsured drivers. Under O.C.G.A. § 33-7-11, an automobile liability policy issued or delivered in Georgia on a motor vehicle principally garaged or principally used in Georgia must include an endorsement or provisions that pay the insured for bodily injury, loss of consortium or death, or for injury to or destruction of property, sustained from the owner or operator of an uninsured motor vehicle.

If the other driver has no insurance, your own uninsured motorist coverage may become part of the claim.

Keep copies of everything you send and receive. That includes emails, claim forms, and notes from calls with any insurer.

How waiting can affect evidence and proof of injury

Waiting usually makes evidence harder to collect. The earliest proof often carries the most weight.

Witness memories fade over time. Video from nearby businesses is often overwritten after a set period. Footage that was available in the first week may be gone by the time someone asks for it.

An injury diagnosed weeks later can be harder to link to the crash. Early medical records help show when symptoms started and what they followed.

Under O.C.G.A. § 51-12-2, general damages are presumed and may be recovered without proof of any amount. Special damages actually flow from the wrong and must be proved. Medical bills and lost pay are common examples of special damages, so records matter.

Photos of the scene, the vehicle damage, and the road layout are most useful when collected soon after the crash.

Reporting deadlines are different from the time limit to file an injury claim

The reporting steps and the filing deadline are separate clocks. The filing deadline is usually two years.

Under O.C.G.A. § 9-3-33, actions for injuries to the person must be brought within two years after the right of action accrues, except injuries to reputation (one year) and actions for injuries to the person involving loss of consortium (four years). The statute has some exceptions.

A late report mainly affects proof and insurance handling. The filing clock runs on its own track.

So how long after a crash can you make a claim? For most personal injury claims in Georgia, the general limit is two years under that statute. Other deadlines can apply depending on the type of claim and the facts. Don’t assume the two-year period is the only one that matters.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What to do now if the 10 days have already passed

If 10 days have passed, the most useful step is to act on the steps you can still take now.

Report the crash to law enforcement if that hasn’t happened yet.

Notify your insurer and describe the crash, the injuries, and the vehicle damage.

Gather evidence. Collect photos, medical records, and the names and contact details of any witnesses.

Keep a written timeline. Record the crash date, symptoms, missed work, and every call with an insurer or the other driver.

Write down what you remember about the other driver, including the plate number or vehicle description if you saw them.

Get medical care now.
