That is the core of the work.

There are two main insurance paths. The first is a claim against the at-fault driver’s liability insurance. The second runs through your own auto policy. If the at-fault driver has no insurance, your uninsured motorist coverage may matter. Under O.C.G.A. § 33-7-11, Georgia auto liability policies must include uninsured motorist coverage-pdf.pdf)-pdf.pdf)-pdf.pdf) that pays for bodily injury caused by an uninsured driver, within policy limits, unless the insured rejects that coverage in writing or selects lower limits in writing. Your own policy may also include underinsured motorist coverage, depending on what you bought.

A lawyer’s work usually starts with gathering the crash report, medical records, and bills. It also means handling calls and letters from insurers, so you don’t have to. If a claim can’t be settled, a lawyer can file a lawsuit on your behalf.

Truck and motorcycle crashes follow the same basic path, but they add steps. This firm also handles truck accident and motorcycle accident claims. You can read more on the personal injury lawyer Decatur page.

How Personal Injury Law Works in Georgia

Georgia uses modified comparative fault, so you can recover only if you are less than 50 percent responsible for the crash. Your damages are reduced by your share of fault. Under O.C.G.A. § 51-12-33-pdf.pdf)-pdf.pdf)-pdf.pdf)-pdf.pdf), a plaintiff who is 50 percent or more responsible recovers nothing.

Here is a simple example. Suppose your total damages were $10,000 and you were 20 percent at fault. Your award would be reduced by 20 percent, to $8,000. Real cases often involve more than two people, and fault can be split among several of them.

Georgia also sets a filing deadline. Most injury claims must be filed within two years after the right of action accrues, which means the date your claim arose. Loss of consortium claims have a four-year period. Other deadlines can apply, so check your timeline early.

Insurance adjusters often ask for recorded statements early. They may also make quick settlement offers. Read any offer carefully before you respond, and ask what it does and doesn’t cover.

How Much Do Car Accident Claims Settle For?

No one can predict what your car accident claim will settle for. Amounts depend on your injuries, your treatment, fault, and the insurance that applies. Numbers from other people’s cases do not decide your claim.

Damages usually fall into a few groups. They include medical bills, lost wages, vehicle repair or replacement, and pain and suffering. Georgia limits medical bill damages to the reasonable value of medically necessary care. Under O.C.G.A. § 51-12-1.1-pdf.pdf)-pdf.pdf)-pdf.pdf)-pdf.pdf), the trier of fact, meaning the judge or jury, decides that amount.

If you have health insurance, the evidence can include both the amount billed and the amount your insurance contract requires to satisfy the bill. That rule applies even if you never use your insurance on the bill.

Policy limits matter too. Every auto policy has a maximum it will pay. That limit can cap what you recover under that policy. Keep bills, receipts, and treatment notes together from the start, so nothing gets lost.

Can You Sue a Truck Driver After a Decatur Crash?

Yes, you may be able to sue a truck driver after a crash. The trucking company or other parties may also share responsibility, depending on how the crash happened.

Truck cases often involve more parties and more records. The driver, the carrier that hired the driver, and the company that leased the truck may each have a role. In Georgia, an injured person generally cannot sue an at-fault driver’s liability insurer directly before a judgment is entered (Hartford Ins. Co. v. Henderson & Son, 1988), although filing an insurance claim is allowed. For a motor carrier (trucking company) crash on or after July 1, 2024, the carrier’s insurer may be joined in the lawsuit only if a related carrier is insolvent or bankrupt, or if the driver or carrier cannot be served (SB 426, 2024). Under O.C.G.A. § 40-1-112-2024-pdf.pdf)-2024-pdf.pdf)-2024-pdf.pdf)-2024-pdf.pdf), that joinder is allowed only in limited situations. Examples include when a related carrier is insolvent or bankrupt, or when personal service can’t be made after reasonable diligence.

Federal rules also set insurance minimums for certain carriers. The federal schedule of limits for public liability sets the minimum levels of financial responsibility referred to in § 387.7. For for-hire carriage of nonhazardous property in interstate or foreign commerce, by vehicles with a gross vehicle weight rating of 10,001 or more pounds, it lists $750,000. That number is a legal minimum. It is not the value of any claim.

Records don’t last forever. Federal duty-status recordkeeping rules require a motor carrier subject to that part, other than a private motor carrier of passengers (nonbusiness), to have each driver it uses record the driver’s duty status for each 24-hour period, generally by using an electronic logging device (ELD). Federal vehicle inspection report rules require the qualified inspector to prepare a report that identifies the inspector, the motor carrier or intermodal equipment provider, the date, the vehicle, and the components inspected along with the results. The motor carrier, intermodal equipment provider, or other entity responsible for the inspection must keep the original or a copy of that report for fourteen months from the date of the report. Early requests for evidence matter for that reason.

What Not to Say After a Car Accident

The simple answer is honesty. Share every detail with your lawyer, including past injuries and symptoms that seem unrelated. A claim is easier to protect when the facts are complete.

Don’t guess about speed, fault, or injuries. Say what you know, and say when you don’t know. Be careful with recorded statements to an insurance adjuster. You can ask for time to think before you give one.

Avoid posting about the crash, your injuries, or your physical activities on social media. Insurers may review posts, and a photo can be read out of context. Keep your medical appointments too. Gaps in treatment can give an insurer an argument against your claim.

If the other driver left the scene, the law still applies.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Free Consultation, No Fee Unless We Win (Court Costs and Case Expenses May Still Apply)

Your first consultation with T.
