An out of state trucking company accident lawyer in Georgia looks at who owned, leased, drove and insured the truck. Georgia’s core injury rules still apply, and a claim can reach the trucking company, the driver and other businesses tied to the truck or its load.

What an Out-of-State Trucking Company Crash Case Involves

An out-of-state trucking company crash case is a Georgia injury claim where the carrier, the driver’s employer, or the insurer is based in another state. The truck may have been operated for a carrier, leased to one, or insured by a company with its home base somewhere else.

This page is written for:

Drivers, passengers, pedestrians and cyclists hurt in a crash with a commercial truck

Family members handling a wrongful death claim after a fatal crash

Relatives or friends helping an injured person decide what to do next

Crashes like these often happen on Interstate 75 and Interstate 16, and on city and rural roads in Clayton County, Atlanta, Decatur, Macon and Augusta. First contact often comes from an insurer or claims office far from the crash scene. That is often where the timeline starts.

Under 49 C.F.R. § 395.1, the rules in this part apply to all motor carriers and drivers, except as provided in paragraphs (b) through (x) of this section. Three rules matter most in these cases:

Hours of service: A driver of a property-carrying commercial motor vehicle may not drive after 14 consecutive hours on duty that follow 10 consecutive hours off, except as otherwise provided in 49 C.F.R. § 395.1. The driver may drive 11 hours within that period (49 C.F.R. § 395.3).

Driver qualification files: The carrier must keep a file for each driver. It must keep that file while the driver works there and for three years after (49 C.F.R. § 391.51).

Post-accident testing: Under 49 C.F.R. § 382.303, an employer must test drivers for alcohol and drugs after a crash only in the listed circumstances, such as a fatality, or a citation issued within the set time windows together with an injury requiring immediate medical treatment away from the scene or a disabling vehicle damage requiring a tow-away. If an alcohol test is not given within two hours, the employer must record why. Under 49 C.F.R. § 382.303, if an alcohol test is not administered within eight hours following the accident, the employer shall cease attempts to administer an alcohol test, and if a controlled substances test is not administered within 32 hours following the accident, the employer shall cease attempts to administer a controlled substances test.

Those windows are short. Testing records and the driver’s hours can decide what proof exists later. A carrier may also operate through several companies. Identifying every party that controlled the truck is an early task.

Who Can Be Sued in a Trucking Crash and What Can Be Recovered

Several parties can be sued after a trucking crash. The trucking company, the driver, and others whose conduct contributed to the harm may all be part of the claim.

Georgia law makes a person liable for torts committed by a servant within the scope of the business, Georgia liability for employees, O.C.G.A. § 51-2-2.

The driver: Fatigue, distraction, speeding or impairment can support a claim against the driver.

Others: A freight broker, cargo loader, maintenance contractor or trailer owner may share responsibility.

Georgia’s fault rules look at everyone who contributed to the injury. Damages are split among the liable people by fault, and each one pays only its own share, not a joint amount (Georgia fault apportionment, O.C.G.A. § 51-12-33).

Damages fall into two groups. General damages are presumed from the wrong and need no set amount of proof. Special damages, such as bills and lost pay, must be proved (Georgia damages types, O.C.G.A. § 51-12-2). Punitive damages are meant to punish, not compensate. In most tort cases outside the listed exceptions, they are capped at $250,000 (Georgia punitive damages, O.C.G.A. § 51-12-5.1).

Evidence That Matters Most in the First Days

The most useful proof in a truck case is often held by the carrier. Written requests should go out early, before routine records are lost. Key items include:

The driver qualification file and drug and alcohol testing records.

Engine data, dashcam video and GPS data. These can be overwritten or lost if no one asks for them to be kept.

The police crash report, photos of the scene and vehicles, and witness names.

The driver’s phone records, when distraction may be part of the facts.

A preservation letter is a written notice asking the carrier and its insurer to keep these records. Sending one early puts them on notice of the claim.

How the Process Typically Works, Step by Step

Most truck cases move in stages. The timeline depends on the injuries and the number of parties.

First conversation. The crash facts, injuries and any insurance contact are reviewed.

Preservation and investigation. Letters go to the carrier, driver and insurer, and records are gathered.

Medical and damages review. Treatment records and the financial effect of the injury are organized.

Demand and negotiation. The claim is presented to the insurer. This step can take several months, depending on the injuries and the parties.

Filing suit. If a fair resolution is not reached, a lawsuit is filed within Georgia’s deadline (Georgia personal injury deadline, O.C.G.A. § 9-3-33).

Georgia State Patrol investigates many fatal and major-injury crashes. The Georgia Department of Public Safety explains how victims and family members can ask about the status of an investigation.
