Early offers often arrive before you know the full cost of your injuries. This guide explains the risks to weigh before you accept a rideshare insurer early settlement offer or sign a fee agreement. It applies Georgia law in plain words.

Why a rideshare insurer may make an early settlement offer

A rideshare insurer often makes an early offer while medical treatment is still going on. At that point, the full cost of your injuries is usually not known.

The insurer starts with the crash details. It looks at the police report, photos, and the driver’s app status at the time of the crash. Those facts shape the number it offers, and they may not include your medical records.

If you’re handling this for an injured parent, spouse, or child, you may feel pressure to reply fast. That pressure is normal. It is also the reason to slow down and check the details first. Georgia’s insurance regulator advises claimants not to rush to accept an offer, and to negotiate for a fair settlement (Georgia Office of the Commissioner of Insurance and Safety Fire).

If a rideshare insurer has made you a quick offer after a crash, you don't have to decide alone; our team can talk through your situation with you. Both decisions can be hard to undo, so review them before you sign anything.

Signing a release can end the claim

A release is the document in which you agree to end your claim, usually for a payment. Read it closely before you sign. Ask whether it covers future medical care or only bills you already have.

Plan on a signed release being the end of the claim for this crash. Whether an injured person can bring a claim involving an insurance company depends on the facts of each case, and our team can review those facts with you during a free consultation, which is confidential and carries no obligation to continue.

An early offer may miss future costs

An early offer may leave out treatment that hasn’t happened yet. It may also leave out work you haven’t missed yet, or symptoms that appear weeks later. Head injuries, back injuries, and fractures can take time to evaluate.

Understand the fee agreement

Many injury cases are handled on a contingency basis, meaning no fee unless we win. You may still be responsible for court costs and case expenses even if there is no recovery.

A clear fee agreement should state, in plain terms:

The percentage the firm will take.

Whether that percentage is figured before or after case expenses are deducted.

How court costs and case expenses are handled if there is no recovery.

Who pays medical bills and liens from the settlement.

Medical bills and liens

Health insurance can affect the value of a claim. Where the plaintiff has any form of public or private health insurance, including benefits under a governmental workers’ compensation program, Georgia law requires the evidence to include both the amounts charged and the amounts actually necessary to satisfy those charges under the insurance contract or the applicable governmental workers’ compensation program, regardless of whether the health insurance has been used, is used, or will be used to satisfy such charges (O.C.G.A. § 51-12-1.1). Letters of protection, where a provider treats you in exchange for a promise of payment from a settlement, are relevant and discoverable in the claim under the same section. Other liens may need to be paid out of any settlement.

How the driver’s app status at the time of the crash affects which insurance applies

The driver’s app status at the moment of the crash can change which insurance applies. Georgia law defines rideshare services as the period a driver is logged on to the rideshare company’s digital network and available to accept a ride request until logged off, plus the period from accepting a ride request until the driver completes the transaction or the ride is complete, whichever is later; rideshare services do not include transportation provided using a taxi, a limousine carrier as defined in Code Section 40-1-151, or any other commercially registered motor vehicle and commercially licensed driver (O.C.G.A. § 33-1-24).

Personal auto insurers may exclude coverage for losses during that window. The same statute says a rideshare company’s policy does not depend on a personal insurer first denying a claim.

The app records are central evidence. The statute requires the rideshare company, upon a personal insurer’s request for claims coverage investigation, to provide within 15 days of that request the date and time of the accident and the precise times, within 12 hours before and after the accident, that the driver logged on and off (O.C.G.A. § 33-1-24). An injured person often has not seen those records. An offer may rest on them anyway.

Liability of the app company is also limited. Under Georgia’s ride share statute, the service is not liable for a driver’s operation of a personal car unless the service itself was negligent or committed criminal misconduct, among other conditions (O.C.G.A. § 40-1-201). Don’t assume the first offer reflects the full picture of who may be responsible.

How long a rideshare injury claim can take and why offers often come first

A rideshare injury claim usually moves through several stages. These include investigation, medical treatment, a written demand, negotiation, and a lawsuit if needed. No fixed schedule applies to every case.

Insurers often make offers early, before the medical picture is complete. An early offer may come before you know how your condition will change.

Georgia generally requires a personal injury lawsuit to be filed within two years after the right of action accrues (Cameron v. JMP Pizza, Inc., quoting O.C.G.A. § 9-3-33). A negotiation can run alongside that deadline, so track the date from the start.

Fault also matters. A person who is 50 percent or more responsible recovers nothing (O.C.G.A. § 51-12-33). An insurer may raise fault early, so be ready to answer those questions with care.

For a fuller walk-through of the stages, see our rideshare claim timeline for Georgia (page link to be added).

What damages a rideshare settlement offer may not include

A settlement offer may not include every category of loss Georgia law recognizes. Georgia separates general damages from special damages. General damages are presumed to flow from a wrong and can be recovered without proof of an amount. Special damages must be proved (O.C.G.A. § 51-12-2).

Necessary expenses from an injury are a legitimate part of the damages estimate (O.C.G.A. § 51-12-7). When figuring the present value of future medical expenses, living expenses, lost wages, or other economic damages, the jury may reduce them to present value using a 5 percent discount rate or another rate it finds appropriate (O.C.G.A. § 51-12-13).

Some harm is to a person’s peace, happiness, or feelings. In a tort action in which the entire injury is to a person’s peace, happiness, or feelings, the law leaves the measure to the enlightened consciences of impartial jurors, and punitive damages are not awarded (O.C.G.A. § 51-12-6).

A first offer often prices the bills you can see today. It may not price the future care, lost time, or pain that follow. For more detail on how damages are measured, see our Georgia rideshare damages guide (page link to be added).

Why the location of the crash can matter for a rideshare case

Where a case is filed can affect how it moves through the courts. In a crash with more than one at-fault party, Georgia’s rule considers the fault of everyone who contributed to the injury. That includes people who were not named in the suit, if the plaintiff entered into a settlement agreement with them or a defending party gives notice not later than 120 days prior to the date of trial that they were wholly or partially at fault (O.C.G.A. § 51-12-33).

Clayton County is one location our team serves.
