That is the short answer to what happens if I miss the deadline to sue after a car accident in Georgia. The main rule is in O.C.G.A. § 9-3-33. It says actions for injuries to the person must generally be brought within two years after the right of action accrues, except that injuries to reputation must be brought within one year and loss-of-consortium actions within four years.

This guide explains when the clock starts, why insurance talks don’t pause it, which exceptions may apply, and which other deadlines run on their own schedules. The evidence may be strong, but the timing rule can still end the case.

This is why the date matters so much.

When the Two-Year Clock Starts in a Georgia Car Accident Case

The statute runs from the time “the right of action accrues.” In a typical crash, that is the day it happens. Count two years forward from that date. A crash on March 3, 2025 would point to a filing deadline of March 3, 2027. That is an example, not a rule for your case.

Some injuries show up days or weeks later. Others build slowly. In those situations, the start date can be harder to pin down. A dated review of the facts sets the start date, not a guess.

A calendar reminder helps, but it can’t answer every question. It can’t tell you whether an exception applies, whether a city or the state is involved, or whether a different deadline governs part of your claim.

Why Insurance Talks and Medical Treatment Do Not Stop the Clock

Insurance talks happen outside the courthouse.

Georgia’s insurance regulator advises drivers to promptly notify the police and their insurer after a crash. It also advises collecting accident and witness information and avoiding statements about fault. Prompt reporting protects the claim, but reporting is not a lawsuit.

Medical care works the same way. Treatment and records often take a long time. Keep following your doctor’s advice, and track the filing date at the same time.

Exceptions That Can Extend the Georgia Deadline

A few Georgia statutes can pause or extend the filing period. Each one fits a narrow set of facts.

Minors. Under O.C.G.A. § 9-3-90, a person under 18 when the claim arises gets the same time after turning 18 that other people get to sue. That rule is subject to a separate exception in § 9-3-33.1, so the exact timing needs review.

Under O.C.G.A. § 9-3-90, a person who is legally incompetent because of intellectual disability or mental illness when the cause of action accrues gets the same time after that disability is removed to bring an action.

Crimes. Under O.C.G.A. § 9-3-99, the running of the limitation period for a tort claim by the victim of an alleged crime is tolled from the date of the alleged crime or the act giving rise to the claim until the prosecution of that crime or act has become final or otherwise terminated, provided that the tolling does not exceed six years, except as otherwise provided in O.C.G.A. § 9-3-33.1. That pause cannot exceed six years. This can matter in a crash that also led to a criminal case.

Refiled cases. Under O.C.G.A. § 9-11-41, when an action is automatically dismissed for want of prosecution because no written order is taken for five years, and the plaintiff recommences it within six months, the renewed action keeps the original timing for limitation purposes.

Whether any of these fits your situation depends on the facts of the crash, the injured person’s status and the parties involved.

Other Deadlines That Run on Their Own Schedule

Vehicle damage, wrongful death and claims against governments can run on different clocks than the injury lawsuit.

That is separate from the injury deadline.

Wrongful death. Wrongful death claims follow their own rules. Identify the right person to file and the correct dates early.

City vehicles. A claim against a city must be presented in writing to its governing authority within six months of the event the claim is based on, before any lawsuit can be brought. That rule comes from O.C.G.A. § 36-33-5. The statute also pauses the limitation period while a demand is pending without action.

State vehicles. For a tort claim against the state, written notice is due within 12 months of when the loss was discovered or should have been discovered. See O.C.G.A. § 50-21-26. A suit can’t begin until the state denies the claim or 90 days pass without action, whichever comes first.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What Has to Be Proven in a Georgia Car Accident Lawsuit

The facts of how the crash happened, including each driver’s conduct, shape the case.

A police report, witness accounts, photos and vehicle damage can all help answer those questions.

How Evidence and Online Activity Affect the Case Before the Deadline

Evidence is easiest to gather in the weeks after a crash, so waiting can make the timeline harder.

Photos of the scene and vehicles fade in value as cars are repaired. Witness names and the police report number are easy to lose. Medical records and repair estimates also come together faster early on.

Social media deserves care. Posts, photos and messages can be requested by the other side in a lawsuit. They can be used to test claims about injuries and activities.
