A gap is a stretch when recommended care stops or gets delayed after a crash. How much it matters depends on how long the pause lasted, why it happened and what the medical records show. T. Madden & Associates, P.C. has been in practice since 1999, with offices in Jonesboro, Atlanta, Decatur, Macon and Augusta, Georgia.

What a Gap in Treatment Means in a Georgia Car Accident Claim

A gap in treatment is a period when care a doctor recommended stops or gets delayed after a crash. It is measured against the plan the injured person was given. Say a doctor orders eight weeks of physical therapy. The patient goes twice, then stops for three months. That three-month silence is the gap.

Two things shape how a gap gets read. The first is length. A short delay is different from months with no care. The second is the reason. A pause caused by a clear barrier reads differently from one with no explanation at all.

A gap is not automatically fatal to a claim. The medical records, the timing and the explanation all matter. Most people in this position ask one question: can I still recover? The answer depends on the facts of each case, so the whole timeline deserves a look, not just one missed appointment.

If you stopped physical therapy or missed follow-ups because of cost, transportation or work, you don't have to sort out that gap alone. An adjuster might point to a missed follow-up and suggest the pain came from something else. Others argue the treatment itself was not needed.

Georgia law gives the other side room to test medical care. Under O.C.G.A. § 51-12-1.1, medical expenses are limited to the reasonable value of medically necessary care. Either side may challenge that reasonableness or the medical necessity of treatment. A gap gives the other side a reason to ask those questions.

Fault is a second issue. Under O.C.G.A. § 51-12-33, a jury sets the plaintiff’s percentage of fault, and the award is reduced in proportion. A plaintiff who is 50 percent or more responsible may not receive any damages.

The gap is usually argued alongside the medical records, not on its own. Each period of care should connect to injuries from the collision, and the doctor’s notes should explain that link.

Legitimate Reasons Treatment Pauses Happen After a Crash

Many pauses have ordinary causes. A documented reason makes a gap much easier to explain. Common reasons include these:

Cost and insurance approval. A copay, a denied imaging request or a bill that arrives late can stop a visit before it happens.

Work and family. Missed shifts, lost pay and childcare can push appointments back, especially for hourly workers.

Transportation. A car that was totaled or towed may leave no ride to the clinic.

Confusion about referrals. Many people don’t know which provider to see or what a referral requires.

Pain that seemed manageable. Some injuries feel mild at first and worsen over the following weeks.

Each reason should leave a trail. A bill, a notice or a text to the office can show why care paused.

Why Delayed Symptoms Do Not Automatically End a Claim

A delayed first visit is a different problem from a long break after care has started. Many people feel stiffness, headaches or numbness days after a crash, once the shock of the collision wears off. Pain can also grow over time.

A delayed start can still be explained. The key is to get evaluated once symptoms show up, and to describe when each one began. A doctor can record the timeline and link the symptoms to the crash.

Keep a simple symptom journal from the first day. Write the date, the body part, the pain level and what the pain stopped you from doing. A journal does not replace medical care. It helps a doctor and the claim show a clear, honest timeline.

What to Do Right Away If You Paused Your Care

The first step is to schedule a return visit and tell the doctor about the pause. Describe the reason plainly, even if the reason was cost or confusion. Doctors need an accurate history to treat you well.

Ask the provider to note your current symptoms, your limits and how the injury affects daily tasks like driving, lifting or sleeping. Then follow the plan you are given, including physical therapy and referrals.

Be careful with the insurer. The Georgia Office of the Commissioner of Insurance and Safety Fire lists steps for auto claims, including avoiding statements about fault. Think before giving a recorded statement about your treatment history. Talking with a lawyer first can help you decide what to say.

Records That Help Explain a Gap in Treatment

Records are what explain a pause. They show what happened, when it happened and why. Start collecting them now, while the details are fresh.

Medical bills, explanation-of-benefits letters and appointment reminders

Pay stubs, schedule records or an employer letter showing missed work or lower hours

Receipts for rides, towing or storage fees tied to the crash

A dated symptom journal and a list of calls made to providers or insurers

Necessary costs matter. Keeping receipts for crash-related costs, even small ones, helps the full picture.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Georgia Deadlines That Keep Running During a Treatment Gap

Georgia generally allows two years from the injury date to file most personal injury lawsuits. Under O.C.G.A. § 9-3-33, actions for injuries to the person must generally be brought within two years after the right of action accrues, except as otherwise provided in that article; for example, actions for injuries to the person involving loss of consortium must be brought within four years after the right of action accrues. Some other periods are shorter or longer, so the exceptions in that statute matter.

A pause in treatment does not stop this clock. Claims against a city or the state can have much shorter notice deadlines, and those rules work differently. Write down the date of the crash today and keep it where you can find it. A missed deadline can end a claim that would otherwise be valid.

Talk With T.
