It is one part of the injury claim, alongside the physical harm from the wreck.

That means your claim is built on two kinds of proof: the physical injury and the emotional symptoms that followed. When both appear together in your records, they are easier to review with your lawyer.

If you’re weighing an emotional distress car accident Georgia lawsuit, start with the physical injury and its paperwork. A crash that left a documented injury, such as a neck strain, a fracture or a head injury, is recorded in medical files that a lawyer will review. Whether emotional distress can be part of a claim depends on the facts of each case and on Georgia law. Whether a claim meets the impact rule depends on the facts of each case, including how the injuries and records line up.

Here’s what matters in practice. The physical injury and the emotional symptoms should appear together in the same medical notes. A common mistake is telling the emergency room about neck pain but never mentioning the nightmares or the panic when you drive. If those symptoms first show up three weeks later in a therapist’s notes, the link becomes harder to draw. Tell your doctor about every symptom, even the ones that feel small.

What Emotional Harm Can Be Included in a Georgia Injury Claim

Mental suffering can be part of an injury claim. It isn’t measured by a formula, though. Under O.C.G.A. § 51-12-6, when the entire injury is to a person’s peace, happiness or feelings, the amount is left to the enlightened consciences of impartial jurors. The same section bars punitive damages in that kind of action.

In an emotional distress car accident Georgia lawsuit, common symptoms people describe include anxiety, nightmares, sleep loss, fear of driving, flashbacks and depression. The key question is how those symptoms affect your daily life. Can you still get to work? Do you avoid the highway you used every day? Do you skip time with family or activities you used to enjoy? Write down specific changes.

Expect the other side to ask about stress or sleep problems you had before the crash. Symptoms that are part of the same injury are different from stress that was already there. Be honest about your history. Your records and your own account should match.

How to Prove Emotional Distress After a Crash

Proof starts with records made close to the crash. Emergency room notes, primary care visits and any symptoms reported at those visits are the first pieces of evidence. Mental health treatment records, when you have them, can document symptoms and show how they changed over time.

Keep a symptom journal. Note your sleep, panic episodes, days you avoided driving, and activities you missed. Dates and specific details carry more weight than general statements like “I’ve been stressed.” Save the crash report, photos of the vehicles and scene, and any messages from family or coworkers who noticed changes after the wreck.

Public records can help too. Gaps in treatment are another problem. If you stop going to appointments, the other side may argue the symptoms came from something else. Keep your appointments, and tell your provider if you can’t attend.

Ongoing Symptoms and Future Care

Emotional harm can last for months after a crash. A claim may need to account for symptoms that continue and for future effects a doctor expects. Counseling or medication costs that come later can be part of a claim when records support them.

Medical bills have their own rules. Under O.C.G.A. § 51-12-1.1, special damages for medical expenses are limited to the reasonable value of medically necessary care, treatment or services. Under O.C.G.A. § 51-12-13, future economic losses may be reduced to present value, using a 5 percent discount rate or another rate the judge or jury (the trier of fact) finds appropriate.

Keep a running list of out-of-pocket costs, mileage to appointments and time missed from work. Save receipts and pay stubs. Under O.C.G.A. § 51-12-7, necessary expenses that come from an injury are a legitimate item in the damages estimate.

Deadlines and Fault Rules That Affect Your Claim

Georgia generally requires an action for injuries to the person to be brought within two years after the right of action accrues; injuries to the reputation have one year, and loss of consortium claims have four years, under the same section. That rule comes from O.C.G.A. § 9-3-33. Claims for loss of consortium have four years under the same section.

Fault matters too. Under O.C.G.A. § 51-12-33, if you are 50 percent or more responsible for the injury or damages claimed, you cannot receive damages. Under O.C.G.A. § 51-12-33, the judge reduces the amount of damages otherwise awarded to the plaintiff in proportion to the plaintiff’s percentage of fault, and the plaintiff is not entitled to receive any damages if the plaintiff is 50 percent or more responsible for the injury or damages claimed. When several people share fault, each liable person pays its own share, and that share is not joint liability.

Georgia also says that if you could have avoided the consequences caused by the defendant’s negligence with ordinary care, you are not entitled to recover; in other cases, the defendant is not relieved even if you contributed to the injury in some way, under O.C.G.A. § 51-11-7. Early documentation protects the claim because evidence fades.
