In Georgia, these costs can be part of an injury claim, but they must be medically necessary, tied to the crash, and supported by proof. T. Madden & Associates, P.C. is a Georgia personal injury firm led by attorney Terance Madden, in practice since 1999, with offices in Jonesboro, Atlanta, Decatur, Macon and Augusta. This guide explains how the process works.

Why Future Medical Costs Matter After a Georgia Car Accident

Future medical costs are the expected cost of care you still need because of a crash. They are separate from bills you already paid or still owe for past treatment.

Many crash injuries take time to show their full effect. A person may leave the emergency room with a diagnosis and still need surgery, physical therapy, medication, or injections months later. Some people only learn about long-term limits after treatment has run for a while.

Georgia law treats these costs as part of the damages picture. O.C.G.A. § 51-12-7 says necessary expenses consequent upon an injury are a legitimate item in the estimate of damages. Medical costs are special damages. O.C.G.A. § 51-12-2 says special damages “actually flow from a tortious act” and must be proved. That is why records matter from the start.

Timing matters too. Under O.C.G.A. § 9-3-33, most injury lawsuits must be filed within two years after the right of action accrues.

What Future Medical Costs Can Include

Future medical costs can include care that a treating provider says you will need because of your crash injuries. The care has to be recommended, not just possible.

Common examples include planned surgeries, follow-up imaging, visits with other treating doctors, and physical or occupational therapy. Ongoing prescriptions, pain management, and assistive devices can also appear in a claim. So can home modifications and attendant care when a medical provider recommends them.

Georgia limits what you can claim for medical care. O.C.G.A. § 51-12-1.1 limits special damages for medical and healthcare expenses to the reasonable value of medically necessary care, treatment, or services. The trier of fact, usually a jury, decides that amount. The same statute lets a party challenge the reasonableness of projected future expenses and the medical necessity of treatment. A future cost needs a clear medical reason behind it.

Costs must also connect to the crash. A condition that existed before the wreck needs careful separation from harm the crash caused. Records from before and after the accident help show what changed.

Finally, future money is usually worth less today. O.C.G.A. § 51-12-13 lets the trier of fact reduce future medical expenses and other economic damages to present value, using a 5 percent discount rate or another rate the trier of fact considers appropriate.

How Future Costs Are Proven: Medical Opinions and Records

Future costs are proven with medical records and medical opinions about the care likely to be needed. An opinion should explain what treatment is needed, how often, and why.

Two kinds of proof work together. Treatment records show what your providers found, ordered, and recommended. A written opinion from a treating provider, or from a medical professional retained for the claim, links those findings to future care.

A life care plan is one way to put this together. It is a written projection of anticipated care, prepared with medical input, that lists future needs and estimated costs in one document. The right tool depends on the injury and the treatment plan.

Health insurance affects the proof, too. O.C.G.A. § 51-12-1.1 says that when the plaintiff in any such civil action has any form of public or private health insurance, including benefits under a governmental workers’ compensation program, the evidence on reasonable value includes both the amounts charged and the amounts actually necessary to satisfy those charges under the insurance contract or the applicable governmental workers’ compensation program. This applies whether or not the insurance was used. A bill’s listed price is not the whole story.

Daily habits make proof stronger. Keep appointment notes and follow the treatment plan. Write down pain, limits, sleep problems, and missed work in a simple journal. Gaps in treatment are a common problem. Medical records can only document care that was actually given.

Which Insurance Sources May Help Pay: Med Pay, Bodily Injury Liability, and Uninsured Motorist Coverage

Several insurance sources may pay parts of a car accident claim, and each works differently. Your own policy and the at-fault driver’s policy can both matter.

Medical payments coverage, often called med pay, is an optional part of some auto policies. It can pay medical bills after a crash, subject to the policy’s limits and terms. It does not decide who caused the wreck.

Bodily injury liability coverage belongs to the at-fault driver’s policy. It is usually the main source for an injury claim against that driver. It pays covered damages up to the policy limit, so the limit matters early on.

Uninsured motorist coverage applies when the at-fault driver has no insurance or not enough. O.C.G.A. § 33-7-11 provides that Georgia auto liability policies generally must contain an endorsement undertaking to pay the insured damages for bodily injury caused by the owner or operator of an uninsured motor vehicle, unless the insured rejects that coverage as the statute allows. Under O.C.G.A. § 33-7-11, an automobile liability policy issued or delivered in Georgia must contain uninsured motorist coverage for bodily injury, loss of consortium or death of an insured, and for injury to or destruction of an insured’s property sustained from the owner or operator of an uninsured motor vehicle. The insured may affirmatively choose uninsured motorist limits in an amount less than the policy’s liability limits. Under O.C.G.A. § 33-7-11(a)(2), a motor vehicle shall be deemed to be uninsured if the owner or operator of the motor vehicle is unknown.

Health insurance may also pay treatment bills. How it fits with a claim depends on the policy and the facts.

Medical Liens and Provider Bills Explained

A medical lien is a claim to be paid from a future settlement or judgment. Some providers treat injured patients under a letter of protection, which is a promise to be paid from the case result. O.C.G.A. § 51-12-1.1 makes these arrangements open to scrutiny. Relevant and discoverable items include the letter itself, all itemized and coded charges, any sale of the provider’s receivables below invoice price, and whether a referral was made and by whom.

Health insurers and med pay carriers may also seek reimbursement from a recovery. These claims can reduce what a client keeps, so each one must be tracked and negotiated.

A common mistake is signing treatment paperwork without reading it. Ask every provider for an itemized bill and whether they treated under a letter of protection. Before any settlement talks, write a list of every lien and payer claim.

Time Limits: When a Georgia Car Accident Claim Must Be Filed

Most Georgia personal injury lawsuits must be filed within two years after the right of action accrues. O.C.G.A. § 9-3-33 sets that two-year rule for injuries to the person. The statute also has exceptions, such as a four-year period for loss of consortium claims involving an injury.

Long treatment can make the deadline easy to forget. Then review it early, while treatment is still going on.

Keep a simple file. Record the accident date, every treatment date, and every insurance claim number. The Georgia Office of the Commissioner of Insurance advises people to promptly notify police and the insurer, gather accident and witness information, document the scene, and avoid statements about fault. See its Georgia auto claim tips.

Common Questions About Future Medical Costs and Settlements
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does bodily injury liability cover pain and suffering?

Bodily injury liability can pay covered damages up to the policy limit.
