It blends cases that have very little in common.

A death in a minor collision, a fatal truck crash, and a death after nursing home abuse or a medical error do not share the same facts, proof, or insurance. Putting them into one number hides those differences.

Read any number with those limits in mind, and ask what the figure actually counts.

A settlement reflects the losses, the evidence, and the insurance in one case. That is why a useful value discussion starts with the facts of the death, not with a number.

How Georgia law measures a wrongful death claim

Georgia measures a wrongful death claim by the full value of the life of the person who died, as shown by the evidence. The statute on surviving spouses and children says so directly. See O.C.G.A. § 51-4-2.

Under O.C.G.A. § 51-4-1, the value is figured “without deducting for any of the necessary or personal expenses of the decedent had he lived.” In plain words, the claim is not reduced by what the person would have spent to live.

The same definition of “homicide” covers deaths from a crime, from criminal or other negligence, and from defectively manufactured property. That reach matters for crash deaths and many other fatal incidents.

Some losses are proven separately. Under O.C.G.A. § 51-4-5, the personal representative may recover funeral, medical, and other necessary expenses when death results from a crime or from criminal or other negligence.

Special damages are losses that actually flow from the wrong, and they must be proved. See O.C.G.A. § 51-12-2. If there is no surviving spouse, the children may bring it. Those papers help determine who is entitled to recover.

What drives the value of a Georgia wrongful death case

The facts of the death, the proof of fault, and the insurance available shape value the most. Each of these can move a claim in either direction.

Evidence of the person’s life. Records and witness accounts can show what the person earned, what they gave to the household, and what the family lost. These facts go to the full value of life the law measures.

Fault. Fault can be shared. Under O.C.G.A. § 51-12-33, a plaintiff who is 50 percent or more responsible for the injury or damages claimed receives no damages. Below that line, damages are reduced in proportion to the plaintiff’s share of fault. The jury considers a nonparty’s fault only if the plaintiff settled with that nonparty or a defending party gave notice at least 120 days before trial that the nonparty was wholly or partially at fault, and each liable person pays only its own share.

Insurance. Uninsured motorist coverage can matter when the at-fault driver has no insurance. Under O.C.G.A. § 33-7-11, an uninsured motorist endorsement or provision undertakes to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured, sustained from the owner or operator of an uninsured motor vehicle, within the policy limits.

Future losses. The trier of fact (the judge or jury) may reduce future economic losses to present value. Under O.C.G.A. § 51-12-13, it may use a 5 percent discount rate or another rate it considers appropriate.

Medical records and time. If your loved one lived for a while after a serious injury, the medical records matter. They document the injury, the treatment, and the costs. A spinal injury, for example, is recorded in detail through imaging and treatment notes.

How long a family has to file a Georgia wrongful death lawsuit

The start date can turn on the facts of the death, so do not wait to learn the dates. Waiting can also make it harder to collect police reports, witness names, and medical records.

Some claims carry an earlier step. If the claim involves the City of Atlanta, the City says written notice is required within six months. That notice must describe the time, place, and extent of the injury, and the alleged negligence, before an action is brought. See City of Atlanta claim information.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Common questions about settlements and what the family receives
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is a settlement the same as a court verdict?

A settlement is an agreement reached through negotiation, not a decision by a judge or jury.
