The value comes from three things: your own underinsured motorist (UIM) limit, the at-fault driver’s liability limit, and the losses you can prove.

This guide explains how those pieces fit together under Georgia law. Many readers are still recovering, or are caring for an injured family member. Clear facts can make the next step easier to think through.

What underinsured motorist coverage is and when it applies

Underinsured motorist coverage is part of your own auto policy. It helps when the at-fault driver has insurance, but not enough to cover your losses. The Insurance Information Institute says uninsured and underinsured motorist coverage may reimburse policyholders after accidents involving uninsured, underinsured, or hit-and-run drivers.

Georgia law requires this protection. O.C.G.A. § 33-7-11 reads: “(a)(1) No automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state to the owner of such vehicle or shall be issued or delivered by any insurer licensed in this state upon any motor vehicle then principally garaged or principally used in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured’s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs which at the option of the insured shall be.”

Uninsured motorist (UM) coverage is a related but different case. It applies when the at-fault driver is an uninsured motorist as described in § 33-7-11, which is not limited to drivers with no insurance at all. UIM applies when the at-fault driver has some insurance, but the limits are too low.

Even though another driver caused the crash, your UIM claim runs under your own policy. Your insurer is the company you deal with on that claim.

If you're recovering from a crash while sorting out your GEICO policy, our team can talk through your limits and the facts with you. GEICO wrote the policy that contains the UIM coverage, so that is where the claim starts.

The at-fault driver’s insurer handles a separate liability claim. The two claims run on separate tracks. Your claim against your own insurer is about your policy. The claim against the other driver is about their liability coverage. People often mix the two up, because one crash creates both.

Check your declarations page. It lists your policy limits and shows whether UIM coverage is on your policy. Your policy file shows what you chose.

How your UIM policy limit sets the ceiling on a claim

Your UIM limit is the most your own policy pays for this coverage. It appears on your policy, so you can see that ceiling before any claim begins.

The other driver’s liability limit comes next. Under § 33-7-11, your UIM coverage is extra coverage. Under § 33-7-11, the policy may exclude the insurer’s liability for bodily injury or death already compensated under medical payments coverage or workers’ compensation laws, and for property already compensated by other property or physical damage insurance. So that liability payment matters.

Under the add-on (“in addition to”) form of uninsured motorist coverage, the statute limits what an insured can recover from UM benefits and the at-fault driver’s liability insurance together to no more than the total of the insured’s economic and noneconomic losses. Your policy limit is one ceiling. Your actual losses are another.

The reduced-limits form under subdivision (II) of § 33-7-11(b)(1)(D)(ii), which an insured selects in writing, applies only to the gap between the other driver’s liability limit and your UM limit. Which form applies depends on your policy and your written choice.

Factors that influence the value of a UIM claim

The injury, the proof, and fault shape the value of a claim most. Several factors stand out:

Severity and length of the injury. A short injury differs from a lasting one. Under § 51-12-4, damages compensate for injury, and where an injury is small, nominal damages only are given. Serious or permanent injuries usually need longer treatment and more proof.

Medical records and treatment history. Records that show a clear path from the crash to care make the injury easier to prove.

Liability evidence. A police report, photos, and witness statements help show how the crash happened.

The insurer’s evaluation. The claim may settle, or it may move to a dispute or lawsuit.

Your share of fault. Georgia reduces damages in proportion to your fault. Under § 51-12-33, the judge reduces what you would otherwise receive by your percentage of fault. If you are 50 percent or more responsible, you receive no damages.

How the value of your claim is estimated

Damages fall into two groups. General damages are the harms the law presumes flow from a wrongful act. You can recover them without proof of an exact amount, under § 51-12-2. Special damages actually flow from the crash, and you must prove them.

Medical expenses are limited to the reasonable value of medically necessary care, under § 51-12-1.1. If you have health insurance, the evidence includes both the amounts billed and the amounts actually needed to satisfy those charges.

Some providers treat patients under a letter of protection, which is a promise to be paid from any settlement. Under the same statute, that letter, the itemized charges, and any sale of the bills below invoice price can be relevant and open to discovery (the formal exchange of evidence before trial).

Necessary expenses from an injury are a legitimate part of the damages estimate, under § 51-12-7. Future economic losses can be reduced to present value. Under § 51-12-13, a trier of fact may use a 5 percent discount rate or another rate it considers appropriate.

These categories are weighed together. No fixed formula produces one number for every case.

Steps to take with GEICO after an underinsured crash

Report the crash to your insurer promptly. Write down the date, the name of each person you speak with, and the claim number. Keep copies of every letter.

Gather the core records. These include the police report, medical records, bills, and proof of lost income such as pay stubs or a letter from your employer. Special damages must be proved, so these records carry weight under § 51-12-2.

Read anything before you sign it. A recorded statement or settlement release can affect what you can claim later. A release usually closes the claim for the amounts it names.

Keep a daily log. Record your symptoms, the days you missed work, and the everyday tasks the injury makes harder. A simple notebook or phone note works well. Dates and details give a clear picture of the losses.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What the final number depends on

The amount you recover depends on your UIM limit, the other driver’s liability limit, your losses, your share of fault, and the proof you can show.
