Which insurance policy covers an Uber or Lyft driver in Georgia depending on whether the app was off, on, waiting for a ride, or carrying a passenger?<\/h2>\n

In Georgia, the driver’s app status decides which insurance applies. With the app off, the driver’s personal auto policy is the starting point. With the app on and waiting, or a ride underway, the rideshare company’s coverage comes into play.<\/p>\n

Georgia’s rideshare statute, O.C.G.A. \u00a7 33-1-24<\/a>, measures the company’s coverage in two parts. The first starts when a driver is logged on and available for ride requests, and ends when the driver logs off. The second runs from accepting a ride request until the ride is complete or the transaction ends, whichever is later.<\/p>\n

When the Rideshare Driver Is Offline and Not Using the App<\/h2>\n

When the app is off, the driver’s personal auto policy is the main place to look for coverage. The statute ties the rideshare coverage period to time logged on, available, or on an accepted ride. Time with the app closed falls outside that definition.<\/p>\n

The rideshare driver’s personal policy limits and terms decide what is available in this stage. Uninsured motorist coverage terms may pay the insured for injuries caused by the owner or operator of an uninsured vehicle, and the insured may affirmatively choose uninsured motorist limits lower than the liability limits (O.C.G.A. \u00a7 33-7-11<\/a>). Under O.C.G.A. \u00a7 33-7-11(a)(1)<\/a>, an automobile liability policy issued or delivered in Georgia must, unless the insured rejects it, contain an endorsement or provisions to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of an insured’s property, sustained from the owner or operator of an uninsured motor vehicle. The insured may affirmatively choose uninsured motorist limits in an amount less than the limits of liability, and under paragraph (3) of subsection (a) the insured may reject uninsured motorist coverage in writing.<\/p>\n

A common mistake is assuming a personal policy covers every minute a driver spends near a rideshare platform. Read the policy’s terms about driving for hire. The rideshare coverage described below applies to the logged-on and ride periods, not to time when the app is closed.<\/p>\n

When the Driver Is Logged In but Has Not Accepted a Ride<\/h2>\n

When a driver is logged in and available, Georgia’s rideshare law treats that time as part of the company’s coverage period. During that period, the company must maintain a primary motor vehicle insurance policy (O.C.G.A. \u00a7 33-1-24<\/a>).<\/p>\n

The company’s coverage can take the form of an endorsement on the driver’s personal policy, combined with an excess policy from the company. It does not wait for the driver’s personal insurer to deny a claim first.<\/p>\n

Personal policies can exclude coverage while a driver provides these services. Under O.C.G.A. \u00a7 33-1-24<\/a>, the transportation network company must include the disclosures required by that subsection in the driver’s terms of service in a distinctive clause, and the lienholder notice is one of those disclosures.<\/p>\n

Save your timing records. On request from the driver’s personal insurer, the company must provide within 15 days the crash date and the precise log-on and log-off times for the 12 hours before and after the crash. Keep any app screenshots you have, because those times can be matched against the company’s records.<\/p>\n

When the Driver Has Accepted a Ride or Is Carrying a Passenger<\/h2>\n

Once a driver accepts a ride, the company’s coverage period runs from acceptance until the trip is over. The statute ends that period when the transaction or the ride is complete, whichever is later (O.C.G.A. \u00a7 33-1-24<\/a>). That includes the drive to pick up a rider and the ride with a passenger on board.<\/p>\n

When the company provides primary coverage, its insurer covers the costs of defense and indemnification. Those are the costs of defending the claim and paying covered damages. If the company disputes primary coverage, it must tell the driver and the driver’s insurer within 25 business days of receiving notice of the accident.<\/p>\n

For an injured passenger, this stage is the one to document first. Keep the trip record, the driver’s name and vehicle details, and any messages about the ride.<\/p>\n

A passenger may also have health insurance and an auto policy of their own. How those coverages fit with the rideshare company’s policy turns on the specific policies involved.<\/p>\n

Insurance Requirements in Georgia and What Happens If Another Driver Caused the Crash<\/h2>\n

When another driver caused the crash, that driver’s liability insurance is a separate source of recovery. A serious crash can involve injuries that exceed available insurance limits.<\/p>\n

If the at-fault driver has little or no coverage, your own uninsured or underinsured motorist coverage may help. The Insurance Information Institute says that coverage may reimburse policyholders after accidents involving uninsured, underinsured or hit-and-run drivers (Insurance Information Institute<\/a>). Georgia’s insurance regulator’s auto page<\/a> says uninsured motorist coverage may protect against injuries to the insured and passengers when an uninsured driver causes the accident.<\/p>\n

Fault also matters. Under O.C.G.A. \u00a7 51-12-33<\/a>, damages are reduced by the injured person’s share of fault. A person who is 50 percent or more at fault recovers nothing.<\/p>\n

Can the Rideshare Company’s Insurance Be Involved?<\/h2>\n

Yes, the rideshare company’s coverage can be involved during the logged-on and ride-accepted stages. The policy in force at the exact moment of the crash is what matters, so timing is central.<\/p>\n

Georgia law also limits when a rideshare company can be held liable for a driver’s operation of a personal car. Under O.C.G.A. \u00a7 40-1-201<\/a>, that protection applies only if the company was not negligent or involved in criminal misconduct. It also applies only if the company meets the law’s requirements, including background checks at least once every two years.<\/p>\n

If an officer reasonably suspects improper operation, the driver must allow access to that phone’s record (O.C.G.A. \u00a7 40-1-193<\/a>).<\/p>\n

Write down what you remember now. Note the time of the crash, the app status you recall, and where the trip stood. Save screenshots, and list the names and contact details of any witnesses.<\/p>\n\n
