Fees, case expenses, medical bills, liens and other repayments can all come out before you receive a dollar. So how much of a $100k settlement will I get? The honest answer depends on the facts. You can still learn each deduction and apply it to the number in front of you.

T. Madden & Associates, P.C. has practiced personal injury law since 1999. The firm represents people hurt in car and truck wrecks, motorcycle and e-bike crashes, and other injury claims. It has offices in Jonesboro, Atlanta, Decatur, Macon and Augusta. This page explains each step in plain terms.

Why a $100,000 Settlement Is Not the Amount You Take Home

A settlement figure is the gross amount paid to resolve a claim. It is the total before costs and repayments are subtracted.

General damages are presumed to flow from a wrongful act, so they can be recovered without proof of an exact amount. Special damages actually flow from the injury and must be proved. O.C.G.A. § 51-12-2 sets out that split.

Your net is what remains after the fee agreement, case expenses, medical balances and liens are paid. Each one can change the number. The sections below take them in order, so you can see where the money goes.

If an offer is on the table while bills and missed paychecks pile up, our team can talk through your numbers with you, starting with a free first consultation. T. Madden & Associates, P.C. handles personal injury matters on a no-fee-unless-we-win basis, but you may still be responsible for court costs and case expenses.

Case expenses are the costs of building the claim. They can include medical record copies, filing fees and fees for witnesses who testify. Georgia law treats necessary expenses from an injury as a legitimate part of the damages estimate. O.C.G.A. § 51-12-7 provides that necessary expenses consequent upon an injury are a legitimate item in the estimate of damages.

How the percentage and each expense are applied to your share is set out in your written fee agreement. Read that document line by line before you compare any figure.

Medical Expenses, Liens, and Reimbursement Claims

Medical bills are part of the claim, but the amount owed can be less than the amount billed. Georgia limits medical special damages to the reasonable value of medically necessary care. O.C.G.A. § 51-12-1.1 requires that, if the plaintiff has any form of public or private health insurance, the evidence include both the amounts charged and the amounts actually necessary to satisfy those charges under the insurance contract, and the trier of fact determines the amount.

Some payers may want their money back from the settlement. CMS explains the recovery process in detail. Other payers may have repayment rights under their own contracts.

Treatment under a letter of protection gets extra scrutiny. Under the same statute, the letter and the itemized charges are relevant and discoverable in a lawsuit.

Every lien should be identified and resolved before money is paid out to you. Ask each payer for a written payoff amount before you count any net figure.

Lost Income, Future Care, and Other Damages in the Total

Lost wages, future medical care and pain and suffering can all be part of a settlement figure. Each one needs its own proof.

Future medical costs and lost earnings can be reduced to present value. Georgia law lets the trier of fact use a 5 percent discount rate or another rate it finds appropriate. O.C.G.A. § 51-12-13 covers that adjustment.

Pain, suffering and loss of enjoyment do not come from a bill. Where an injury is to feelings alone, Georgia law leaves the amount to the enlightened consciences of impartial jurors. O.C.G.A. § 51-12-6 states that rule.

When you review an offer, check whether it covers future care and lost income, or only past bills.

A Worked Example: From $100,000 Gross to Net

This is a hypothetical with made-up numbers. It is not a prediction of any real case, and the fee is a placeholder, not the firm’s rate.

Gross settlement (includes $8,000 in lost wages): $100,000

Less attorney fee (placeholder for illustration only): $30,000

Less case expenses: $3,500

Less health plan lien repaid: $12,000

Net to the client in this example: $54,500

The lost wages are part of the $100,000 gross. They are not a separate deduction. A larger fee, expense or lien lowers the net, while a smaller lien raises it.

The $30,000 in medical bills in this example does not reduce the net by itself. Only the lien amount paid from the settlement does, which is why the payoff letters matter.

Insurance Limits and Why They Can Cap What Is Available

A claim’s full value and the money behind it are not always the same. Insurance coverage shapes what can be collected.

Georgia auto policies must contain an uninsured motorist endorsement. That endorsement pays for bodily injury caused by the owner or operator of an uninsured vehicle. O.C.G.A. § 33-7-11 sets out this requirement, which does not apply where any insured named in the policy rejects the coverage in writing. If that insurer pays under the uninsured motorist coverage, it is subrogated to your rights against the person who caused the injury, to the extent of the payment it made (O.C.G.A. § 33-7-11(f)). O.C.G.A. § 33-7-11 reads: “provided that the bringing of an action against the unknown owner or operator as “John Doe” or the conclusion of such an action shall not constitute a bar to the insured, if the identity of the owner or operator who caused the injury or damages complained of becomes known, bringing an action against the owner or operator theretofore proceeded against as “John Doe”; provided, further, that any recovery against such owner or operator shall be paid to the insurance company to the extent that the insurance company paid the named insured in the action brought against the owner or operator as “John Doe,” except that the insurance company shall pay its proportionate part of any reasonable costs and expense incurred in connection therewith, including reasonable attorney’s fees.”

Trucks follow federal rules.
