Yes, it can. A letter sent too early, with the wrong number, or with careless sentences can weaken a Georgia car accident claim. This guide explains how that happens and what to check before you send anything. It is general information, not legal advice about your case.

What a demand letter does in a Georgia car accident claim

A demand letter is a written request asking the at-fault driver’s insurer to pay a set amount to settle your injury claim. It describes the crash, your injuries and treatment, your bills, and any lost income. Then it asks for a specific sum.

The letter becomes part of the claim file. The adjuster reads it, compares it with the police report and your medical records, and decides how to respond. Anything you write can be quoted back to you later, so treat each sentence as evidence.

The at-fault driver’s coverage matters too. A claim can be larger than that minimum.

If you're weighing whether a demand letter could help or hurt after your Georgia crash, you don't have to make that call alone. It can, when the number, the facts, or the wording don’t match your records. Insurers use gaps like these to lower what they offer. Watch for these common problems.

A number that is too low. An early low figure can become the starting point for every later offer.

A number the records don’t support. General damages, like pain, can be recovered without proof of an amount. Special damages, like bills and lost wages, must be proved (general and special damages).

Admissions about fault. Georgia reduces damages by the injured person’s share of fault. Someone who is 50 percent or more responsible receives no damages (fault apportionment). A careless line about speed or attention can be used for that.

Bills that don’t fit the treatment. How medical bills are valued in a Georgia injury claim depends on current Georgia law and the facts of each case.

Sending too soon. If treatment isn’t finished, the injury may not be fully understood yet.

Timing: sending too early or missing the filing deadline

For injuries to the person, the deadline is two years after the right of action accrues (O.C.G.A. § 9-3-33).

Talks with an adjuster are not a pause button.

Don’t let an open negotiation hide that date.

Is a demand letter a lawsuit?

No. A demand letter is a pre-suit request sent to the insurer. It is not a complaint filed in court, and no case number exists just because a letter was sent.

A lawsuit is a separate step. It may follow if the claim does not settle. The letter’s facts and numbers can show up again in a later case, so the wording shapes how that case looks.

Treat the letter as a legal document, not a quick note. Every statement in it should be something you can prove.

What happens if the insurer does not respond or pushes back

An insurer that counters, asks for records, requests a recorded statement, or goes quiet has not ended your claim. Each reply is one step in the process.

A counteroffer. Compare it with your records before you respond.

A request for records. Send what you have, and keep a copy of what you sent.

A recorded statement. Answer only what you know, and say so when you don’t. Don’t guess about speed, pain, or past injuries.

Silence. Check your dates. Silence is a reason to review the timeline, not a sign the claim is closed.

A rude or dismissive reply does not end the claim either. Answer in short, plain sentences, and avoid reacting in anger. A casual phone call can still produce a statement you later wish you had not made.

Before you send anything: evidence to gather and a next step

Gather your records before you write a number.
