That surprises many families. Medicare and Medicaid are public programs that pay medical bills, and a later injury claim can bring their repayment rights into play.

A truck crash often brings emergency care, hospital stays, and follow-up treatment all at once. Bills can arrive before anyone explains who paid them.

This page explains how repayment generally works in Georgia. Medical costs are limited to the reasonable value of medically necessary care, and the trier of fact, the judge or jury who hears the case, decides that amount (O.C.G.A. § 51-12-1.1). If you have any public or private health insurance, the evidence includes both the amounts charged and the amounts actually needed to satisfy those charges. That rule applies even if the insurance was never used.

Medicaid is a form of public health coverage. Ask how Medicaid calculates its claim, and request the amount in writing.

How Medicare’s Repayment Right Works After a Truck Wreck

Medicare can pay bills while your claim is still open, then seek repayment from the settlement. CMS calls these conditional payments, and its recovery process guidance explains how Medicare handles them.

Medicare’s claim is separate from Medicaid’s. A single case can involve both programs, and each can claim a different amount.

Don’t assume the number. Ask for the conditional payment amount in writing, then check it against the bills you received. A claimed figure is a starting point for review, not a final answer.

Hospital and Provider Liens That Can Sit Alongside Repayment Claims

Hospitals and other medical providers can also ask to be paid from your settlement, so a repayment claim is not the only bill to check. A provider may treat you under a letter of protection, which is a promise of payment from a later judgment or settlement.

Georgia law makes these arrangements visible in a claim. In any claim for medical and healthcare expenses rendered under a letter of protection or any other arrangement, where the provider is to be paid from any judgment or settlement of a civil action to recover damages resulting from injury or death to a person, a copy of the letter of protection, itemized and coded charges, and the referral details are relevant and discoverable, meaning they can be requested in a lawsuit (O.C.G.A. § 51-12-1.1). The same section covers whether a provider sold its accounts below the invoice price.

Collect every lien notice that arrives. Lien totals don’t always match the bills you received. Request an itemized list of charges and compare it line by line.

Can the Repayment Amount Be Reduced?

A repayment claim isn’t final just because it was sent. In a civil action to recover damages for injury or death, O.C.G.A. § 51-12-1.1 limits special damages for medical and healthcare expenses to the reasonable value of medically necessary care, treatment, or services, and it does not limit either party’s right to present evidence challenging the reasonableness of medical and healthcare expenses, whether incurred or projected, or the medical necessity of any treatment.

In a civil action, either party may challenge whether the medical expenses claimed were reasonable and necessary. You can ask how the number was reached, what records support it, and whether each charge was medically necessary.

Many injured people don’t know they can ask these questions. Asking them early gives you a clearer picture before any money changes hands.

How Truck Accident Medical Bills and Lost Wages Fit Into a Settlement

Medical bills and lost income are separate parts of a truck crash claim. Repayment claims come from the medical side. Georgia law treats necessary expenses from an injury as a legitimate part of damages (O.C.G.A. § 51-12-7).

Medical expenses often include emergency care, hospital stays, surgery, imaging, rehabilitation, and prescriptions. Special damages, which are losses that actually flow from the crash, must be proved to be recovered (O.C.G.A. § 51-12-2). Keep every bill, statement, and treatment record.

Truck crashes also leave official records. Under federal rules, commercial truck drivers are subject to post-accident drug and alcohol testing only in specified circumstances, as explained on the FMCSA page on when testing is required and when it occurs. The Georgia Uniform Motor Vehicle Accident Report is official crash data used in resolving legal matters.

For a fuller view of truck crash claims, read our truck accident lawyer guide.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Questions to Answer Before Accepting Any Settlement

Before you accept any settlement, get a written list of everyone who has a claim against it. Ask these questions first:

Has Medicare or Medicaid been notified of the claim?

Has Medicare or Medicaid stated any conditional payment or lien amount in writing?

Has every hospital, provider, and government claim been listed in an itemized list?

Does each listed charge match the bills you received?

Fault matters too. Under Georgia law, damages are reduced in proportion to the injured person’s share of fault. A plaintiff who is 50 percent or more responsible for the injury or damages claimed is not entitled to receive any damages (O.C.G.A. § 51-12-33).

Don’t sign a release until the lien amounts are known.
