This guide explains who can file, what the claim can cover, the time limits, and what to expect after the first call.

This guide is for Georgia families searching for a fatal truck accident wrongful death lawyer. T. Madden & Associates, P.C. has been in practice since 1999. Terance Madden leads the firm, which has offices in Jonesboro (Clayton County), Atlanta, Decatur, Macon, and Augusta.

What a Fatal Truck Accident Wrongful Death Claim Is

A wrongful death claim is a lawsuit brought because someone died from another party’s negligent or wrongful act. In a truck case, that act is a crash involving a tractor-trailer, 18-wheeler, or other commercial vehicle.

Georgia’s rules for these claims start with O.C.G.A. § 51-4-2. That law covers the homicide of a spouse or parent and sets out who may recover.

A wrongful death claim is separate from any injury claim your loved one had before dying. If they were hurt in the crash and lived for a time, that injury claim may be handled alongside this one.

This page covers car-versus-truck crashes and other commercial vehicle crashes across Georgia, including those in the Clayton County, Atlanta, Decatur, Macon, and Augusta areas.

If a truck crash took your loved one's life in Georgia, you may have a claim, and you don't have to face the deadlines alone. The amount is not known at a first call.

Why Fatal Truck Crashes Involve More Parties and More Evidence

A truck crash can involve several responsible parties, and fault is shared among them. Under O.C.G.A. § 51-12-33, damages apportioned to each person are that person’s own liability, not a joint one. A nonparty’s fault is considered only after the plaintiff settles with that nonparty, or a defending party gives notice at least 120 days before trial that the nonparty was wholly or partially at fault, under O.C.G.A. § 51-12-33(d).

Possible parties include the driver, the motor carrier, a cargo loader or shipper, a maintenance contractor, and a parts maker.

Federal hours-of-service rules limit how long drivers can work. Under 49 C.F.R. § 395.3, a driver of a property-carrying commercial motor vehicle may not drive without first taking 10 consecutive hours off duty. It includes electronic logging device data, engine control module data, dash camera footage, dispatch messages, inspection records, and the truck itself. Early written requests to the carrier and insurers help protect it.

Georgia Time Limits to Know

Georgia’s general deadline for actions for injuries to the person is two years after the right of action accrues, except for actions for injuries to the person involving loss of consortium, which must be brought within four years after the right of action accrues, under O.C.G.A. § 9-3-33. Mark the date early. The clock can keep running while families wait for records or insurer answers.

For a state entity, written notice must be given within 12 months of when the loss was discovered or should have been discovered, under O.C.G.A. § 50-21-26. For a city, the written claim must be presented within six months of the event, under O.C.G.A. § 36-33-5.

How the Process Works, Step by Step

The process starts with a free first consultation.
