Georgia law allows injured people to seek this loss, but you must prove it. This guide explains what lost wages and lost earning capacity mean, which records matter, and the deadline that applies. T. Madden & Associates, P.C. has been in practice since 1999, with offices in Jonesboro, Atlanta, Decatur, Macon and Augusta.

What Lost Income Means in a Georgia Truck Crash Claim

Lost income is money an injured person loses because of the crash. It is separate from medical bills and pain and suffering. You can seek the pay you missed and the future earning ability the injury took away.

General damages are losses the law presumes flow from a wrongful act. Special damages actually flow from the act, and the law says they must be proved to be recovered.

Georgia’s rule is that damages compensate for the injury when the injury can be estimated in money. The amount depends on the facts of your case.

Truck claims often involve more than one party. The driver, the trucking company, or an insurer may be involved. That is one reason trucking records matter. For the wider picture, read our Georgia truck accident guide.

If a truck crash has cut into your pay, our team can review your records with you in a free first consultation. They cover missed shifts, reduced hours, unpaid leave, and time away for surgery, therapy, and medical visits.

Start with your pay rate and the hours you were scheduled to work before the crash. If you were set for 40 hours a week, that schedule is the starting point. Pay stubs and a letter from your employer can confirm both.

Paid leave you used also counts. Vacation days and sick days are paid time you lost to the injury. Write them down with dates.

Track the timeline. Note the crash date, each medical visit, each missed shift, and your return date. A simple calendar with reasons keeps the gaps easy to explain.

Lost Earning Capacity: Income You May Lose Later

Lost earning capacity is the drop in your ability to earn over your working life. It looks forward, not back. It is a different claim from past wages.

Examples from trucking injuries include a permanent lifting limit, a medical restriction on driving a commercial truck, or a move from long-haul routes to local work. Medical opinions on restrictions and prognosis support this part of the claim. The value depends on your age, work history, and the injury.

Georgia law lets the judge or jury, the trier of fact, reduce future economic losses to present value. The statute allows a discount rate of 5 percent or another rate the trier of fact finds appropriate. In plain terms, a future paycheck is worth less today. That is why future losses get discounted.

This category often needs more proof than past wages. Expect questions about your skills, job history, and what your doctor says you can still do.

Overtime, Bonuses, and Commissions

Irregular pay can count when it was a regular part of what you earned before the crash. Overtime, bonuses, and commissions are the usual examples.

Overtime shows up on pay stubs and W-2 forms over several months or years. A steady pattern of extra hours helps show what you would have kept earning. A common mistake is claiming base pay alone when overtime was part of the job.

Bonuses and commissions need more context. Gather the plan terms, the payment history, and any written notice of how the pay works. Show whether the payment was expected or earned.

Keep your own log of each payment and the date you received it. Employers don’t always hand over that history on request.

Fringe Benefits and Owner-Operator Income

Fringe benefits and owner-operator income can both be part of a lost income claim. Each needs its own type of proof.

Fringe benefits can include employer health coverage, retirement contributions, and reimbursements that work as real pay. A per diem or mileage payment counts only when it is compensation, not repayment of costs you paid. Ask your employer for a benefits statement that lists each item’s value.

Owner-operators and independent drivers often have no pay stubs. They prove income through settlement statements, invoices, bank deposits, and tax filings. Keep business and personal money in separate accounts. Mixed accounts make income harder to show.

Business expenses and taxes are reviewed when net income is calculated. If a truck was damaged or a contract was lost, those losses raise separate questions. They are reviewed on the facts.

How to Document Lost Wages

The core proof is your pay history, your tax records, and a written record of every missed shift. Start collecting these before you need them.

Use this checklist:

Pay stubs for the months before the crash

W-2s and tax returns for several recent years

A written statement from your employer with your pay rate and scheduled hours

A calendar of every missed shift, with the reason

Doctor’s notes that describe your work restrictions

Messages about schedule changes, light duty, or termination

The doctor’s words matter. A note that says what you can and cannot do ties your absence to the injury. A vague note leaves gaps.

Keep copies of everything, including texts and emails with your employer. If your job changed after the crash, those messages show when and why.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Preserving Evidence and Proving Who Is at Fault

That is why trucking evidence matters early.

Federal rules limit how long a commercial driver may drive. Under 49 C.F.R. § 395.3, a driver of a property-carrying commercial motor vehicle, except as § 395.1 provides otherwise, may not drive without first taking 10 consecutive hours off duty. A driver may not drive after 14 consecutive hours following that break. A driver may drive a total of 11 hours in that period. Logs can show whether these limits were followed.

Drivers must also record their duty status. Under 49 C.F.R. § 395.8, except for a private motor carrier of passengers (nonbusiness), a motor carrier subject to the requirements of this part must require each driver to record duty status for each 24-hour period. Under 49 C.F.R. § 379.7, records may be preserved by any technology that accurately reflects all of the information and remains accessible in a form that can be accurately reproduced later for reference.

Federal guidance also covers testing after a crash. FMCSA guidance on operators involved in accidents addresses post-accident testing deadlines. It also covers the employer’s duty to keep records explaining why a required test was not promptly given.

Photos, witness names, and the police report also help. Photograph the vehicles, the road, and your injuries as soon as you can.

Georgia Deadlines, Insurance Limits, and Fault Rules

Georgia generally gives two years to sue for injuries to a person (O.C.G.A. § 9-3-33; Kenneth B.
